Supplementary Provisions, Article 1Effective Date
第一条（施行期日）
This Cabinet Order comes into effect on April 1, 2005.
この政令は、平成十七年四月一日から施行する。
Supplementary Provisions, Article 2Transitional Measures Concerning the Calculation of the Amount of Income
第二条（所得の額の計算に関する経過措置）
The provisions of Article 6-2, paragraph (1), Article 6-11 and Article 6-12, paragraph (1) of the Order for Enforcement of the National Pension Act as amended by the provisions of Article 1, and the provisions of the row for Article 6-2, paragraph (1) in the table of Article 52, paragraph (1) of the 1986 Transitional Measures Cabinet Order as amended by the provisions of Article 3, apply to the calculation of the amount of income for 2004 and after prescribed in Article 36-3, paragraph (1), Article 90, paragraph (1), items (i), (iii) and (iv), Article 90-2, paragraph (1), item (i) and Article 90-3, paragraph (1), item (i) of the National Pension Act (Act No. 141 of 1959) and in Article 66, paragraphs (1) and (2) of the National Pension Act prior to amendment by the provisions of Article 1 of the Act Partially Amending the National Pension Act, etc. (Act No. 34 of 1985; hereinafter referred to as the "1985 Amendment Act") that remains in force pursuant to the provisions of Article 32, paragraph (11) of the Supplementary Provisions of the 1985 Amendment Act (hereinafter referred to as the "Former National Pension Act"), as applied mutatis mutandis pursuant to Article 79-2, paragraph (5) of the Former National Pension Act.
第一条の規定による改正後の国民年金法施行令第六条の二第一項、第六条の十一及び第六条の十二第一項並びに第三条の規定による改正後の昭和六十一年経過措置政令第五十二条第一項の表第六条の二第一項の項の規定は、国民年金法（昭和三十四年法律第百四十一号）第三十六条の三第一項、第九十条第一項第一号、第三号及び第四号、第九十条の二第一項第一号並びに第九十条の三第一項第一号並びに国民年金法等の一部を改正する法律（昭和六十年法律第三十四号。以下「昭和六十年改正法」という。）附則第三十二条第十一項の規定によりなおその効力を有するものとされた昭和六十年改正法第一条の規定による改正前の国民年金法（以下「旧国民年金法」という。）第七十九条の二第五項の規定により準用するものとされた旧国民年金法第六十六条第一項及び第二項に規定する平成十六年以後の所得の額の算定について適用する。
The provisions of Article 6-2, paragraph (2), item (ii) and Article 6-12, paragraph (2), item (ii) of the Order for Enforcement of the National Pension Act as amended by the provisions of Article 1, and the provisions of the row for Article 6-2, paragraph (2), item (ii) in the table of Article 52, paragraph (1) of the 1986 Transitional Measures Cabinet Order as amended by the provisions of Article 3, apply to the calculation of the amount of income for 2005 and after prescribed in Article 36-3, paragraph (1), Article 90-2, paragraph (1), item (i) and Article 90-3, paragraph (1), item (i) of the National Pension Act and in Article 66, paragraphs (1) and (2) of the Former National Pension Act as applied mutatis mutandis pursuant to Article 79-2, paragraph (5) of the Former National Pension Act that remains in force pursuant to the provisions of Article 32, paragraph (11) of the Supplementary Provisions of the 1985 Amendment Act, and the provisions then in force continue to govern the calculation of that amount of income for 2004 or earlier.
第一条の規定による改正後の国民年金法施行令第六条の二第二項第二号及び第六条の十二第二項第二号並びに第三条の規定による改正後の昭和六十一年経過措置政令第五十二条第一項の表第六条の二第二項第二号の項の規定は、国民年金法第三十六条の三第一項、第九十条の二第一項第一号及び第九十条の三第一項第一号並びに昭和六十年改正法附則第三十二条第十一項の規定によりなおその効力を有するものとされた旧国民年金法第七十九条の二第五項の規定により準用するものとされた旧国民年金法第六十六条第一項及び第二項に規定する平成十七年以後の所得の額の算定について適用し、平成十六年以前の当該所得の額の算定については、なお従前の例による。
