Chapter I General Provisions (Articles 1 and 2)
第一章 総則
第一条(目的)
The purpose of this Act, in light of the recognized need to prevent hindrances to transmission and reception of electronic mails due to simultaneous transmission, etc. of specified electronic mails to many persons, is, by specifying measures, etc. for regulating transmission of specified electronic mails, to prepare a preferable environment for the use of electronic mails, and thereby to contribute to the sound development of an advanced information and communications society.
第二条(定義)
In this Act, the meaning of the terms listed in the following items is as prescribed respectively in those items.
この法律において、次の各号に掲げる用語の意義は、当該各号に定めるところによる。
the term "electronic mail" means telecommunications (referring to telecommunications as specified under Article 2 item (i) of the Telecommunications Business Act (Act No. 86 of 1984)) to transmit information, including texts, to specified persons by having screens of communications terminals (including input/output devices; the same applies hereinafter) used by the specified persons that display the information, and which uses communications methods specified by Order of the Ministry of Internal Affairs and Communications;
電子メール 特定の者に対し通信文その他の情報をその使用する通信端末機器(入出力装置を含む。以下同じ。)の映像面に表示されるようにすることにより伝達するための電気通信(電気通信事業法(昭和五十九年法律第八十六号)第二条第一号に規定する電気通信をいう。)であって、総務省令で定める通信方式を用いるものをいう。
the term "specified electronic mail" means electronic mail, which a person who engages in the sending of electronic mail (limited to sending from telecommunications facilities located in Japan (meaning telecommunications facilities as specified under Article 2 item (ii) of the Telecommunications Business Act; the same applies hereinafter) or sending to telecommunications facilities located in Japan; the same applies hereinafter) (limited to an organization for profit and an individual in cases where the individual is engaged in business; hereinafter referred to as a "sender") sends as a means of advertisement for their own sales activities or those for others;
特定電子メール 電子メールの送信(国内にある電気通信設備(電気通信事業法第二条第二号に規定する電気通信設備をいう。以下同じ。)からの送信又は国内にある電気通信設備への送信に限る。以下同じ。)をする者(営利を目的とする団体及び営業を営む場合における個人に限る。以下「送信者」という。)が自己又は他人の営業につき広告又は宣伝を行うための手段として送信をする電子メールをいう。
the term "electronic mail address" means characters, numerical characters, marks, and other codes for identifying a user of electronic mail;
電子メールアドレス 電子メールの利用者を識別するための文字、番号、記号その他の符号をいう。
the term "fictitious electronic mail address" means an electronic mail address falling under all of the following:
架空電子メールアドレス 次のいずれにも該当する電子メールアドレスをいう。
an electronic mail address as produced by using a program (referring to a set of directives to a computer, which are combined for obtaining a single result) with a function to automatically generate many electronic mail addresses
多数の電子メールアドレスを自動的に作成する機能を有するプログラム(電子計算機に対する指令であって、一の結果を得ることができるように組み合わされたものをいう。)を用いて作成したものであること。
an electronic mail address actually not being used by anyone as an electronic mail address
現に電子メールアドレスとして利用する者がないものであること。
the term "electronic mail service" means telecommunications service pertaining to electronic mail as provided for in Article 2, item (iii) of the Telecommunications Business Act.
電子メール通信役務 電子メールに係る電気通信事業法第二条第三号に規定する電気通信役務をいう。
Chapter II Measures for Regulating Transmission of Specified Electronic Mail
第二章 特定電子メールの送信の適正化のための措置等
Article 3Restriction on Transmission of Specified Electronic Mail
第三条(特定電子メールの送信の制限)
A sender must not send specified electronic mail to any person other than the following persons:
a person who has notified the sender or the entrusting party (meaning a person who has entrusted the sending of electronic mail (limited to an organization for profit and an individual in cases where the individual is engaged in business); the same applies hereinafter) in advance that the person requests the sending of specified electronic mail or consents to its sending;
beyond what is set forth in the preceding item, a person who has notified the sender or the entrusting party of the person's own electronic mail address as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order;
beyond what is set forth in the preceding two items, a person who has a business relationship with a person engaged in the business for which advertisement or publicity is conducted by means of the specified electronic mail;
beyond what is set forth in the preceding three items, an organization or individual (limited, for an individual, to a person engaged in business) that has made public its own electronic mail address as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order.
前三号に掲げるもののほか、総務省令・内閣府令で定めるところにより自己の電子メールアドレスを公表している団体又は個人(個人にあっては、営業を営む者に限る。)
A person who has received the notice referred to in item (i) of the preceding paragraph must, as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order, retain records proving that there was a request for the sending of specified electronic mail or consent to its sending.
If a sender has received from a person set forth in any of the items of paragraph (1), as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order, a notice to the effect that the person requests that specified electronic mail not be sent (or, in the case where the person requests that specified electronic mail concerning certain matters not be sent, a notice to that effect) (including when the entrusting party has received that notice), the sender must not send specified electronic mail against the intention indicated in that notice; provided, however, that this does not apply in the case where advertisement or publicity is conducted incidentally in electronic mail sent, based on the intention of the person who receives the electronic mail, with a principal purpose of an act other than advertisement or publicity, or in any other similar case specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order.
第四条(表示義務)
When sending specified electronic mail, a sender must, as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order, ensure that the following matters (excluding, in the case specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order referred to in the proviso to paragraph (3) of the preceding Article, the matter set forth in item (ii)) are correctly displayed on the screen of the communications terminal used by the person who receives it:
the name of the sender (or, in the case where there is an entrusting party with respect to the sending of the electronic mail, of whichever of the sender or the entrusting party is responsible for the sending);
an electronic mail address for receiving the notice referred to in the main clause of paragraph (3) of the preceding Article, or characters, numerical characters, marks, and other codes for identifying telecommunications facilities, which are specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order;
other matters specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order.

Article 5Prohibition of Transmission under False Sender Information
第五条(送信者情報を偽った送信の禁止)
A sender must not send specified electronic mails falsifying the following information on the sender (hereinafter referred to as "Sender Information") for sending or receiving electronic mails:
electronic mail address used for sending those electronic mails;
characters, numerical characters, marks, and other codes for identifying the telecommunications facilities used for sending those electronic mails.
Article 6Prohibition of Transmission Using Fictitious Electronic Mail Address
第六条(架空電子メールアドレスによる送信の禁止)
A sender must not send electronic mails to fictitious electronic mail addresses for the purpose of sending many electronic mails for their own or others' sales activities.
送信者は、自己又は他人の営業のために多数の電子メールの送信をする目的で、架空電子メールアドレスをそのあて先とする電子メールの送信をしてはならない。
第七条(措置命令)
Where the Minister for Internal Affairs and Communications (hereinafter referred to as "Minister") and the Prime Minister (or the Minister, where it concerns the transmission of electronic mails to fictitious electronic mail addresses) find that with respect to transmission of electronic mails, including simultaneous transmission of specified electronic mails to many persons, a sender does not comply with the provisions of Article 3 or Article 4, or where they find that a sender has sent electronic mails using false Sender Information or electronic mails to fictitious electronic mail addresses, and when they find that it is necessary for preventing disturbances upon transmission and reception of electronic mails, they may order that sender (or, in the case where an entrusting party for those electronic mails has carried out part of the operations relating to the sending of the electronic mails, such as receiving the notice referred to in Article 3, paragraph (1), item (i) or (ii) or retaining the records referred to in paragraph (2) of that Article for the sending of the electronic mails, and it is found that there are grounds attributable to that entrusting party with respect to the sending of the electronic mails, that sender and that entrusting party) to take necessary measures for improving the methods for electronic mail transmission.
総務大臣及び内閣総理大臣(架空電子メールアドレスをそのあて先とする電子メールの送信に係る場合にあっては、総務大臣)は、送信者が一時に多数の者に対してする特定電子メールの送信その他の電子メールの送信につき、第三条若しくは第四条の規定を遵守していないと認める場合又は送信者情報を偽った電子メール若しくは架空電子メールアドレスをそのあて先とする電子メールの送信をしたと認める場合において、電子メールの送受信上の支障を防止するため必要があると認めるときは、当該送信者(これらの電子メールに係る送信委託者が当該電子メールの送信に係る第三条第一項第一号又は第二号の通知の受領、同条第二項の記録の保存その他の当該電子メールの送信に係る業務の一部を行った場合であって、当該電子メールの送信につき、当該送信委託者の責めに帰すべき事由があると認められるときは、当該送信者及び当該送信委託者)に対し、電子メールの送信の方法の改善に関し必要な措置をとるべきことを命ずることができる。
Article 8Petition to the Minister or the Prime Minister
第八条(総務大臣又は内閣総理大臣に対する申出)
A person who has received specified electronic mail may, when the person finds that specified electronic mail has been sent in violation of the provisions of Articles 3 through 5, petition the Minister or the Prime Minister to take appropriate measures.
特定電子メールの受信をした者は、第三条から第五条までの規定に違反して特定電子メールの送信がされたと認めるときは、総務大臣又は内閣総理大臣に対し、適当な措置をとるべきことを申し出ることができる。
When a minister set forth in either of the following items has received a petition pursuant to the provisions of the preceding paragraph (excluding when the petition is made to the Minister and the Prime Minister), that minister is to promptly notify the minister specified in that item to that effect:
次の各号に掲げる大臣は、前項の規定による申出を受けたとき(当該申出が総務大臣及び内閣総理大臣に対するものであるときを除く。)は、速やかに、その旨をそれぞれ当該各号に定める大臣に通知するものとする。
the Minister: the Prime Minister;

A person who is offering electronic mail services may, when the person finds that electronic mail has been sent to fictitious electronic mail addresses in violation of the provisions of Article 6, petition the Minister to take appropriate measures.
電子メール通信役務を提供する者は、第六条の規定に違反して架空電子メールアドレスをそのあて先とする電子メールの送信がされたと認めるときは、総務大臣に対し、適当な措置をとるべきことを申し出ることができる。
The Minister or the Prime Minister must, when they have received a petition pursuant to the provisions of paragraph (1), implement necessary investigation, and when they find it necessary based upon results of the investigation, take measures based upon this Act and other appropriate measures.
総務大臣又は内閣総理大臣は、第一項の規定による申出を受けたときは、必要な調査を行い、その結果に基づき必要があると認めるときは、この法律に基づく措置その他適当な措置をとらなければならない。
The Minister must, when they have received a petition pursuant to the provisions of paragraph (3), implement necessary investigation, and when they find it necessary based upon results of the investigation, take measures based upon this Act and other appropriate measures.
総務大臣は、第三項の規定による申出を受けたときは、必要な調査を行い、その結果に基づき必要があると認めるときは、この法律に基づく措置その他適当な措置をとらなければならない。
Article 9Processing of Complaints
第九条(苦情等の処理)
A sender of specified electronic mails must, in good faith, process complaints, inquiries, etc. on their transmission of specified electronic mails.
Article 10Information Provision and Technological Development by Telecommunications Carriers
第十条(電気通信事業者による情報の提供及び技術の開発等)
A telecommunications carrier (meaning a telecommunications carrier stipulated in Article 2 item (v) under the Telecommunications Business Act; the same applies hereinafter) offering electronic mail services must endeavor to carry out, for users of the services, the provision of information on services that contribute to prevention of disturbances upon transmission and reception of electronic mails caused by specified electronic mails, electronic mails using false Sender Information, or electronic mails to be sent to fictitious electronic mail addresses (hereinafter referred to as "specified electronic mail, etc.").
電子メール通信役務を提供する電気通信事業者(電気通信事業法第二条第五号に規定する電気通信事業者をいう。以下同じ。)は、その役務の利用者に対し、特定電子メール、送信者情報を偽った電子メール又は架空電子メールアドレスをそのあて先とする電子メール(以下「特定電子メール等」という。)による電子メールの送受信上の支障の防止に資するその役務に関する情報の提供を行うように努めなければならない。
A telecommunications carrier offering electronic mail services must endeavor to develop or introduce technologies for contributing to prevention of disturbances upon transmission and reception caused by specified electronic mail, etc.
Article 11Refusal of Provision of Telecommunications Services
第十一条(電気通信役務の提供の拒否)
A telecommunications carrier may, in cases where electronic mails using false Sender Information have been sent and therefore it is considered that there is a risk of causing disturbances in smooth offering of its electronic mail services or of causing disturbances upon transmission and reception of electronic mails for its users, in cases where many electronic mails addressed to fictitious electronic mail addresses have been simultaneously sent and therefore it is considered that there is a risk of causing disturbances in smooth offering of its electronic mail services, or where it is considered that there is reasonable grounds to refuse the provision of electronic mail services for prevention of disturbances upon transmission and reception of electronic mails, refuse to provide a person who sends electronic mails that have a risk of causing the disturbances with electronic mail services to the extent of preventing the disturbances.
電気通信事業者は、送信者情報を偽った電子メールの送信がされた場合において自己の電子メール通信役務の円滑な提供に支障を生じ、又はその利用者における電子メールの送受信上の支障を生ずるおそれがあると認められるとき、一時に多数の架空電子メールアドレスをそのあて先とする電子メールの送信がされた場合において自己の電子メール通信役務の円滑な提供に支障を生ずるおそれがあると認められるとき、その他電子メールの送受信上の支障を防止するため電子メール通信役務の提供を拒むことについて正当な理由があると認められる場合には、当該支障を防止するために必要な範囲内において、当該支障を生じさせるおそれのある電子メールの送信をする者に対し、電子メール通信役務の提供を拒むことができる。
Article 12Instruction and Advice to Associations of Telecommunications Carriers
第十二条(電気通信事業者の団体に対する指導及び助言)
The Minister is to endeavor to give necessary instructions and advices to a general incorporated association that conducts operations including provision of information and services contributing to prevention of disturbances upon transmission and reception of electronic mails caused by specified electronic mail, etc. for its member telecommunications carriers.
Article 13Disclosure of Status of Research and Development
第十三条(研究開発等の状況の公表)
The Minister, at least once a year, discloses the status of research and development on technologies that contribute to prevention of disturbances upon transmission and reception of electronic mails caused by specified electronic mails, etc. and the introduction status of the technologies by telecommunications carriers that offer electronic mail services.
Chapter III Registered Agency for Regulating Transmission
第三章 登録送信適正化機関
Article 14Registration of Registered Agency for Regulating Transmission
第十四条(登録送信適正化機関の登録)
The Minister and the Prime Minister may have a person who has obtained registration from them (hereinafter referred to as the "registered agency for regulating transmission") conduct the following services (hereinafter referred to as the "services for regulating transmission of specified electronic mail, etc."):
総務大臣及び内閣総理大臣は、その登録を受けた者(以下「登録送信適正化機関」という。)に、次に掲げる業務(以下「特定電子メール等送信適正化業務」という。)を行わせることができる。
to give instructions or advices to a person who intends to file a petition with the Minister or the Prime Minister pursuant to the provisions of Article 8 paragraph (1) or a petition with the Minister pursuant to the provisions of paragraph (3) of that Article;
to conduct investigations on facts pertaining to the petition in Article 8 paragraph (4) or paragraph (5), when requested by the Minister or the Prime Minister;
to collect and provide information or materials concerning specified electronic mail, etc.
特定電子メール等に関する情報又は資料を収集し、及び提供すること。
The registration in the preceding paragraph is to be made upon request from a person who intends to conduct the services for regulating transmission of specified electronic mail, etc.
前項の登録は、特定電子メール等送信適正化業務を行おうとする者の申請により行う。
Article 15Disqualification Clause
第十五条(欠格条項)
A person who falls under any of the following items may not be registered under paragraph (1) of the preceding article
次の各号のいずれかに該当する者は、前条第一項の登録を受けることができない。
a person who has been sentenced to a fine or severer punishment for violation of this Act or an order based upon this Act, and a period of two years has not elapsed from the day the sentence was completed or the day on which the person ceased to be subject to execution of the sentence.
この法律又はこの法律に基づく命令に違反し、罰金以上の刑に処せられ、その執行を終わり、又は執行を受けることがなくなった日から二年を経過しない者
a person whose registration was rescinded pursuant to the provisions of Article 25, and a period of two years has not elapsed from the day of the rescission.
第二十五条の規定により登録を取り消され、その取消しの日から二年を経過しない者
where the applicant is a corporation, any of whose officers who execute its business falls under any of the preceding two items.
法人であって、その業務を行う役員のうちに前二号のいずれかに該当する者があるもの
Article 16Criterion for Registration
第十六条(登録基準)
The Minister and the Prime Minister must grant registration to any person who has applied for registration pursuant to the provisions of Article 14 paragraph (2), if the applicant for registration complies with all of the following requirements. In this case, the procedures necessary for registration is to be specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order.
総務大臣及び内閣総理大臣は、第十四条第二項の規定により登録を申請した者が次に掲げる要件の全てに適合しているときは、その登録をしなければならない。この場合において、登録に関して必要な手続は、総務省令・内閣府令で定める。
a person who has graduated from a university, or technical college, provided for in the School Education Act (Act No. 26 of 1947) as having mastered subjects concerning telecommunications (including a person who has completed the first-stage program of a professional and vocational university provided for in that Act as having mastered those subjects) and has one year or longer of experience in the business of electronic mail services, or a person who has knowledge and experiences equivalent thereto or higher, and is engaged in the services for regulating transmission of specified electronic mail, etc.;
学校教育法(昭和二十二年法律第二十六号)による大学若しくは高等専門学校において電気通信に関する科目を修めて卒業した者(当該科目を修めて同法による専門職大学の前期課程を修了した者を含む。)でその後一年以上電子メール通信役務に関する実務に従事した経験を有するもの又はこれと同等以上の知識経験を有する者が特定電子メール等送信適正化業務に従事するものであること。
the following measures are taken in order to properly implement the services for regulating transmission of specified electronic mail, etc.:
次に掲げる特定電子メール等送信適正化業務を適正に行うための措置がとられていること。
a full-time administrator is appointed at a unit to implement the services for regulating transmission of specified electronic mail, etc.;
特定電子メール等送信適正化業務を行う部門に専任の管理者を置くこと。
documents are prepared for ensuring management and proper implementation of the services for regulating transmission of specified electronic mail, etc.;
特定電子メール等送信適正化業務の管理及び適正な実施の確保に関する文書が作成されていること。
in accordance with the descriptions in the documents under (b), a dedicated unit is set up for ensuring management and proper implementation of the services for regulating transmission of specified electronic mail, etc.
ロに掲げる文書に記載されたところに従い特定電子メール等送信適正化業務の管理及び適正な実施の確保を行う専任の部門を置くこと。
The registration is to be made by entering the following matters in the registration book of registered agencies for regulating transmission:
登録は、登録送信適正化機関登録簿に次に掲げる事項を記載してするものとする。
date of registration and registration number
登録年月日及び登録番号
name and address of a registered agency for regulating transmission and, in the cases where the person is a juridical person, name of the representative
登録送信適正化機関の氏名又は名称及び住所並びに法人にあっては、その代表者の氏名
name and address of the office where a registered agency for regulating transmission conducts the services for regulating transmission of specified electronic mail, etc.
登録送信適正化機関が特定電子メール等送信適正化業務を行う事務所の名称及び所在地
Article 17Renewal of Registration
第十七条(登録の更新)
If the registration under Article 14 paragraph (1) is not renewed every three years, the registration ceases to be effective by passage of the period.
第十四条第一項の登録は、三年ごとにその更新を受けなければ、その期間の経過によって、その効力を失う。
The provisions of Article 14 paragraphs (2) and the preceding two Articles apply mutatis mutandis to the renewal of registration under the preceding paragraph.
第十八条(特定電子メール等送信適正化業務の実施に係る義務)
A registered agency for regulating transmission must conduct the services for regulating transmission of specified electronic mail, etc. fairly and by methods complying with requirements listed in each item of Article 16 paragraph (1) and the standards specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order.
登録送信適正化機関は、公正に、かつ、第十六条第一項各号に掲げる要件及び総務省令・内閣府令で定める基準に適合する方法により特定電子メール等送信適正化業務を行わなければならない。
Article 19Notification of Changes
第十九条(変更の届出)
A registered agency for regulating transmission must, when intending to change matters listed in item (ii) or item (iii) of Article 16 paragraph (2), notify the Minister and the Prime Minister to that effect two weeks prior to the date on which changes are to be made.
登録送信適正化機関は、第十六条第二項第二号又は第三号に掲げる事項を変更しようとするときは、変更しようとする日の二週間前までに、その旨を総務大臣及び内閣総理大臣に届け出なければならない。
A registered agency for regulating transmission must establish its operational rules and procedures (referred to as operational rules in the following paragraph) concerning the services for regulating transmission of specified electronic mail, etc., and must notify the Minister and the Prime Minister of the rules and procedures prior to the commencement of the services for regulating transmission of specified electronic mail, etc. The same applies when the rules and procedures are to be revised.
登録送信適正化機関は、特定電子メール等送信適正化業務に関する規程(次項において「業務規程」という。)を定め、特定電子メール等送信適正化業務の開始前に、総務大臣及び内閣総理大臣に届け出なければならない。これを変更しようとするときも、同様とする。
The operational rules must specify the methods of carrying out the services for regulating transmission of specified electronic mail, etc. and other matters specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order.
業務規程には、特定電子メール等送信適正化業務の実施の方法その他の総務省令・内閣府令で定める事項を定めておかなければならない。
Article 21Suspension and Discontinuation of Services
第二十一条(業務の休廃止)
A registered agency for regulating transmission must, when intending to suspend its entire services or part of services, or discontinue the services for regulating transmission of specified electronic mail, etc., notify the Minister and the Prime Minister to that effect in advance, as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order.
登録送信適正化機関は、特定電子メール等送信適正化業務の全部又は一部を休止し、又は廃止しようとするときは、総務省令・内閣府令で定めるところにより、あらかじめ、その旨を総務大臣及び内閣総理大臣に届け出なければならない。
Article 22Preparation of Financial Statements and their Inspection
第二十二条(財務諸表等の備付け及び閲覧等)
A registered agency for regulating transmission must, within three months after the end of every business year, prepare an inventory of assets, a balance sheet and a profit and loss statement or income and expenditure account statement, and a business report (including an electronic or magnetic record (any record which is produced by electronic, magnetic, or any other means unrecognizable by natural perceptive function, and is used for data-processing by a computer; hereinafter the same applies in this Article) in cases where electronic or magnetic records are produced instead of those paper documents. In the following paragraph and Article 38, referred to as "financial statements, etc.") and retain thereof for a five-year period at its office.
A person or other interested person who received specified electronic mail, may, whenever within the business hours of a registered agency for regulating transmission, make the following requests. However, when making the request in item (ii) or item (iv), fees set forth by the registered agency for regulating transmission must be paid.
where financial statements, etc. are written documents, a request for inspection of the document or a copy thereof;
財務諸表等が書面をもって作成されているときは、当該書面の閲覧又は謄写の請求
a request for certified transcript or abstract of the documents under the preceding item;
前号の書面の謄本又は抄本の請求
where financial statements, etc. are produced as electronic or magnetic records, a request for inspection of or to copy the matters recorded on the electronic or magnetic records which are displayed in a manner stipulated in the applicable Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order;
a request to provide the matters recorded on the electronic or magnetic records under the preceding item in an electronic or magnetic manner stipulated by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order or a request for issuance of written documents containing those matters.
Article 23Order for Compliance
第二十三条(適合命令)
When the Minister and the Prime Minister find that a registered agency for regulating transmission has failed to comply with any of the items in Article 16 paragraph (1), the Minister and the Prime Minister may order the registered agency for regulating transmission to take necessary measures for compliance with those provisions.
The Minister and the Prime Minister may, when they find that a registered agency for regulating transmission is violating the provisions of Article 18, order the registered agency for regulating transmission to implement the services for regulating transmission of specified electronic mail, etc. pursuant to the provisions of the same Article or to take necessary measures for improving the methods of regulating transmission of specified electronic mail, etc.
総務大臣及び内閣総理大臣は、登録送信適正化機関が第十八条の規定に違反していると認めるときは、その登録送信適正化機関に対し、同条の規定による特定電子メール等送信適正化業務を行うべきこと又は特定電子メール等送信適正化業務の方法の改善に関し必要な措置をとるべきことを命ずることができる。
Article 25Rescission of Registration
第二十五条(登録の取消し等)
The Minister and the Prime Minister may rescind the registration or order the suspension in whole or in part of the services for regulating transmission of specified electronic mail, etc. for a specified period, if a registered agency for regulating transmission falls under any of the following items:
総務大臣及び内閣総理大臣は、登録送信適正化機関が次の各号のいずれかに該当するときは、その登録を取り消し、又は期間を定めて特定電子メール等送信適正化業務の全部若しくは一部の停止を命ずることができる。
when an agency becomes applicable to Article 15 item (i) or item (iii);
when an agency violates the provisions of Article 19 through Article 21, Article 22 paragraph (1) or the following Article;
第十九条から第二十一条まで、第二十二条第一項又は次条の規定に違反したとき。
when an agency rejects the request pursuant to the provisions of each item of Article 22 paragraph (2) without reasonable grounds;
正当な理由がないのに第二十二条第二項各号の規定による請求を拒んだとき。
when an agency violates the order pursuant to the provisions of the preceding two Articles;
前二条の規定による命令に違反したとき。
when an agency obtains the registration under Article 14 paragraph (1) by wrongful means.
不正の手段により第十四条第一項の登録を受けたとき。
Article 26Maintenance of Record Book
第二十六条(帳簿の記載)
A registered agency for regulating transmission must, as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order, prepare and maintain a record book, on which matters specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order related to the services for regulating transmission of specified electronic mail, etc. are entered.
登録送信適正化機関は、総務省令・内閣府令で定めるところにより、帳簿を備え、特定電子メール等送信適正化業務に関し総務省令・内閣府令で定める事項を記載し、これを保存しなければならない。
第二十七条(公示)
The Minister and the Prime Minister must, in the following cases, issue a public notice to that effect in the Official Gazette:
総務大臣及び内閣総理大臣は、次に掲げる場合には、その旨を官報に公示しなければならない。
when registering an agency under Article 14 paragraph (1);
第十四条第一項の登録をしたとき。
when receiving a notification pursuant to the provisions of Article 19;
第十九条の規定による届出があったとき。
when receiving a notification pursuant to the provisions of Article 21;
第二十一条の規定による届出があったとき。
when pursuant to the provisions of Article 25, rescinding a registration of Article 14 paragraph (1), or ordering the suspension of the services for regulating transmission of specified electronic mail, etc.
第二十五条の規定により第十四条第一項の登録を取り消し、又は特定電子メール等送信適正化業務の停止を命じたとき。

Article 28Report and On-site Inspection
第二十八条(報告及び立入検査)
Within the limit necessary for the enforcement of this Act, the Minister or the Prime Minister may order a sender or an entrusting party of specified electronic mail, etc. to report on the state of transmission thereof, or delegate ministerial employee to enter the office of the sender or the entrusting party to inspect record books, documents and other objects.
Within the limit necessary for ensuring proper operations of the services for regulating transmission of specified electronic mail, etc., the Minister and the Prime Minister may order a registered agency for regulating transmission to report on the state of the services for regulating transmission of specified electronic mail, etc. or of its assets, or delegate ministerial employee to enter the office of the registered agency for regulating transmission to inspect the state of the services for regulating transmission of specified electronic mail, etc., or record books, documents and other objects.
総務大臣及び内閣総理大臣は、特定電子メール等送信適正化業務の適正な運営を確保するために必要な限度において、登録送信適正化機関に対し、特定電子メール等送信適正化業務若しくは資産の状況に関し必要な報告をさせ、又はその職員に、登録送信適正化機関の事務所に立ち入り、特定電子メール等送信適正化業務の状況若しくは帳簿、書類その他の物件を検査させることができる。
Any ministerial employee who conducts on-site inspection in accordance with the provisions of the preceding two paragraphs must carry an identification card and show it to persons concerned.
前二項の規定により立入検査をする職員は、その身分を示す証明書を携帯し、関係人に提示しなければならない。
The authority of on-site inspection under the provisions of paragraph (1) or paragraph (2) must not be construed as being legitimate for the purpose of criminal investigations.
When a minister set forth in either of the following items has exercised the authority under the provisions of paragraph (1) alone, that minister is to promptly notify the minister specified in that item of the results:
次の各号に掲げる大臣は、第一項の規定による権限を単独で行使したときは、速やかに、その結果をそれぞれ当該各号に定める大臣に通知するものとする。

Article 29Request for Provision of Information on Senders
第二十九条(送信者に関する情報の提供の求め)
Within the limit necessary for the enforcement of this Act, the Minister may request, from a telecommunications carrier or any other person that has granted a right to use an electronic mail address or characters, numerical characters, marks, and other codes for identifying telecommunications facilities (limited to those displayed on the screen of the communications terminal used by the person who receives specified electronic mail, etc. or those used for sending or receiving specified electronic mail, etc., which relate to the sender), the provision of information necessary for identifying the person to whom that right has been granted, such as that person's name and address.
Article 30Provision of Information to Foreign Enforcement Authorities
第三十条(外国執行当局への情報提供)
The Minister may carry out, for a foreign authority that enforces foreign laws and regulations equivalent to this Act (hereinafter referred to as a "foreign enforcement authority" in this Article), the provision of information that the Minister finds will contribute to the performance of its duties (limited to duties equivalent to the duties specified in this Act; the same applies in the following paragraph).
総務大臣は、この法律に相当する外国の法令を執行する外国の当局(以下この条において「外国執行当局」という。)に対し、その職務(この法律に規定する職務に相当するものに限る。次項において同じ。)の遂行に資すると認める情報の提供を行うことができる。
With regard to the provision of information under the provisions of the preceding paragraph, appropriate measures must be taken to ensure that the information is not used for any purpose other than the performance of the duties of the foreign enforcement authority, and that it is not used, without the consent under the provisions of the following paragraph, for the investigation of a foreign criminal case (limited to an investigation conducted after the facts of the crime subject to it have been identified) or for a trial (referred to as an "investigation, etc." in that paragraph).
When a request has been made by a foreign enforcement authority, the Minister may, except in the case where any of the following items applies, consent to the use of information provided pursuant to the provisions of paragraph (1) for the investigation, etc. of the foreign criminal case pertaining to the request:
the crime subject to the investigation, etc. of the criminal case pertaining to the request is a political crime or the request is found to have been made for the purpose of conducting the investigation, etc. of a political crime;
当該要請に係る刑事事件の捜査等の対象とされている犯罪が政治犯罪であるとき、又は当該要請が政治犯罪について捜査等を行う目的で行われたものと認められるとき。
the act pertaining to the crime subject to the investigation, etc. of the criminal case pertaining to the request would not constitute a crime under Japanese laws or regulations if it were committed in Japan; or
当該要請に係る刑事事件の捜査等の対象とされている犯罪に係る行為が日本国内において行われたとした場合において、その行為が日本国の法令によれば罪に当たるものでないとき。
the foreign country that has made the request has not ensured that it will accept a similar request from Japan.
日本国が行う同種の要請に応ずる旨の要請国の保証がないとき。
When the Minister gives the consent referred to in the preceding paragraph, the Minister must obtain in advance the confirmation of the Minister of Justice that the case does not fall under item (i) or (ii) of that paragraph, and the confirmation of the Minister for Foreign Affairs that the case does not fall under item (iii) of that paragraph, respectively.
Article 31Delegation of Authority, etc.
第三十一条(権限の委任等)
The Prime Minister delegates the authority under the provisions of this Act (excluding that specified by Cabinet Order) to the Commissioner of the Consumer Affairs Agency.
内閣総理大臣は、この法律の規定による権限(政令で定めるものを除く。)を消費者庁長官に委任する。
As specified in Cabinet Order, part of the administrative work under the authority of the Minister stipulated in this Act and under the authority delegated to the Commissioner of the Consumer Affairs Agency pursuant to the provisions of the preceding paragraph may be conducted by prefectural governors.
この法律に規定する総務大臣の権限及び前項の規定により消費者庁長官に委任された権限に属する事務の一部は、政令で定めるところにより、都道府県知事が行うこととすることができる。
Article 32Transitional Measures
第三十二条(経過措置)
When orders are established, amended or abolished in accordance with the provisions of this Act, necessary transitional measures (including those concerning penal provisions) may be stipulated in those orders to such extent as determined to be reasonably necessary in establishing, amending or abolishing those orders.
この法律の規定に基づき命令を制定し、又は改廃するときは、その命令で、その制定又は改廃に伴い合理的に必要と判断される範囲内において、所要の経過措置(罰則に関する経過措置を含む。)を定めることができる。
Chapter V Penal Provisions
第五章 罰則
第三十三条
Any person who has violated the order to suspend business operations in accordance with the provisions of Article 25 is punished by imprisonment for a term not exceeding one year or by a fine not exceeding 1,000,000 yen, or both.
第二十五条の規定による業務の停止の命令に違反した者は、一年以下の拘禁刑若しくは百万円以下の罰金に処し、又はこれを併科する。
第三十四条
A person that falls under any of the following items is punished by imprisonment for a term not exceeding one year or by a fine not exceeding 1,000,000 yen:
次の各号のいずれかに該当する者は、一年以下の拘禁刑又は百万円以下の罰金に処する。
a person who has violated an order in accordance with the provisions of Article 7 (excluding an order concerning the retention of records in accordance with the provisions of Article 3, paragraph (2)).
第三十五条
A person that falls under any of the following items is punished by a fine not exceeding 1,000,000 yen:
次の各号のいずれかに該当する者は、百万円以下の罰金に処する。
a person who has violated an order in accordance with the provisions of Article 7 (limited to an order concerning the retention of records in accordance with the provisions of Article 3, paragraph (2));
a person who has failed to submit a report, or submitted a false report, in accordance with the provisions of Article 28, paragraph (1), or has refused, hindered or evaded the inspection pursuant to that paragraph.
第三十六条
A person that falls under any of the following items is punished by a fine not exceeding 300,000 yen:
次の各号のいずれかに該当する者は、三十万円以下の罰金に処する。
a person who has failed to submit a notification or submitted a false notification in accordance with the provisions of Article 21;
第二十一条の規定による届出をせず、又は虚偽の届出をした者
a person who has failed to enter matters or made false entries, or failed to maintain an account book, in violation of the provisions of Article 26;
a person who has failed to submit a report, or submitted a false report, in accordance with the provisions of Article 28, paragraph (2), or has refused, hindered or evaded the inspection pursuant to that paragraph.
第三十七条
When any representative of a corporation, or an agent, staff member or other employee of a corporation or an individual, has committed an act of violation of the provisions set forth in the following items with regard to the business of the corporation or the individual, not only the offender is punished but also the juridical person is punished by the fine prescribed in the relevant item, and the individual by the fine prescribed in the respective Articles:
法人の代表者又は法人若しくは人の代理人、使用人その他の従業者が、その法人又は人の業務に関し、次の各号に掲げる規定の違反行為をしたときは、行為者を罰するほか、その法人に対して当該各号に定める罰金刑を、その人に対して各本条の罰金刑を科する。
Article 34: a fine not exceeding 30,000,000 yen;
第三十四条 三千万円以下の罰金刑
Article 33, Article 35 or the preceding Article: the fine prescribed in the respective Articles.
第三十八条
Any person who has failed to retain financial statements, etc., has failed to enter the matters that should be entered in financial statements, etc., or has made false entries in financial statements, etc., in violation of the provisions of Article 22 paragraph (1), or has refused without reasonable grounds a request under paragraph (2) of the same Article, is punished by a civil fine not exceeding 200,000 yen.
