Chapter I General Provisions (Articles 1 and 2)
第一章 総則
第一条（目的）
The purpose of this Act, in light of the recognized need to prevent hindrances to transmission and reception of electronic mails due to simultaneous transmission, etc. of specified electronic mails to many persons, is, by specifying measures, etc. for regulating transmission of specified electronic mails, to prepare a preferable environment for the use of electronic mails, and thereby to contribute to the sound development of an advanced information and communications society.
第二条（定義）
In this Act, the meaning of the terms listed in the following items is as prescribed respectively in those items.
この法律において、次の各号に掲げる用語の意義は、当該各号に定めるところによる。
the term "electronic mail" means telecommunications (referring to telecommunications as specified under Article 2 item (i) of the Telecommunications Business Act (Act No. 86 of 1984)) to transmit information, including texts, to specified persons by having screens of communications terminals (including input/output devices; the same applies hereinafter) used by the specified persons that display the information, and which uses communications methods specified by Order of the Ministry of Internal Affairs and Communications;
電子メール 特定の者に対し通信文その他の情報をその使用する通信端末機器（入出力装置を含む。以下同じ。）の映像面に表示されるようにすることにより伝達するための電気通信（電気通信事業法（昭和五十九年法律第八十六号）第二条第一号に規定する電気通信をいう。）であって、総務省令で定める通信方式を用いるものをいう。
the term "specified electronic mail" means electronic mail, which a person who engages in the sending of electronic mail (limited to sending from telecommunications facilities located in Japan (meaning telecommunications facilities as specified under Article 2 item (ii) of the Telecommunications Business Act; the same applies hereinafter) or sending to telecommunications facilities located in Japan; the same applies hereinafter) (limited to an organization for profit and an individual in cases where the individual is engaged in business; hereinafter referred to as a "sender") sends as a means of advertisement for their own sales activities or those for others;
特定電子メール 電子メールの送信（国内にある電気通信設備（電気通信事業法第二条第二号に規定する電気通信設備をいう。以下同じ。）からの送信又は国内にある電気通信設備への送信に限る。以下同じ。）をする者（営利を目的とする団体及び営業を営む場合における個人に限る。以下「送信者」という。）が自己又は他人の営業につき広告又は宣伝を行うための手段として送信をする電子メールをいう。
the term "electronic mail address" means characters, numerical characters, marks, and other codes for identifying a user of electronic mail;
電子メールアドレス 電子メールの利用者を識別するための文字、番号、記号その他の符号をいう。
the term "fictitious electronic mail address" means an electronic mail address falling under all of the following:
架空電子メールアドレス 次のいずれにも該当する電子メールアドレスをいう。
an electronic mail address as produced by using a program (referring to a set of directives to a computer, which are combined for obtaining a single result) with a function to automatically generate many electronic mail addresses
多数の電子メールアドレスを自動的に作成する機能を有するプログラム（電子計算機に対する指令であって、一の結果を得ることができるように組み合わされたものをいう。）を用いて作成したものであること。
an electronic mail address actually not being used by anyone as an electronic mail address
現に電子メールアドレスとして利用する者がないものであること。
the term "electronic mail service" means telecommunications service pertaining to electronic mail as provided for in Article 2, item (iii) of the Telecommunications Business Act.
電子メール通信役務 電子メールに係る電気通信事業法第二条第三号に規定する電気通信役務をいう。
