第二章 特定電子メールの送信の適正化のための措置等
Article 3Restriction on Transmission of Specified Electronic Mail
第三条(特定電子メールの送信の制限)
A sender must not send specified electronic mail to any person other than the following persons:
a person who has notified the sender or the entrusting party (meaning a person who has entrusted the sending of electronic mail (limited to an organization for profit and an individual in cases where the individual is engaged in business); the same applies hereinafter) in advance that the person requests the sending of specified electronic mail or consents to its sending;
beyond what is set forth in the preceding item, a person who has notified the sender or the entrusting party of the person's own electronic mail address as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order;
beyond what is set forth in the preceding two items, a person who has a business relationship with a person engaged in the business for which advertisement or publicity is conducted by means of the specified electronic mail;
beyond what is set forth in the preceding three items, an organization or individual (limited, for an individual, to a person engaged in business) that has made public its own electronic mail address as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order.
前三号に掲げるもののほか、総務省令・内閣府令で定めるところにより自己の電子メールアドレスを公表している団体又は個人(個人にあっては、営業を営む者に限る。)
A person who has received the notice referred to in item (i) of the preceding paragraph must, as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order, retain records proving that there was a request for the sending of specified electronic mail or consent to its sending.
If a sender has received from a person set forth in any of the items of paragraph (1), as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order, a notice to the effect that the person requests that specified electronic mail not be sent (or, in the case where the person requests that specified electronic mail concerning certain matters not be sent, a notice to that effect) (including when the entrusting party has received that notice), the sender must not send specified electronic mail against the intention indicated in that notice; provided, however, that this does not apply in the case where advertisement or publicity is conducted incidentally in electronic mail sent, based on the intention of the person who receives the electronic mail, with a principal purpose of an act other than advertisement or publicity, or in any other similar case specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order.
第四条(表示義務)
When sending specified electronic mail, a sender must, as specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order, ensure that the following matters (excluding, in the case specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order referred to in the proviso to paragraph (3) of the preceding Article, the matter set forth in item (ii)) are correctly displayed on the screen of the communications terminal used by the person who receives it:
the name of the sender (or, in the case where there is an entrusting party with respect to the sending of the electronic mail, of whichever of the sender or the entrusting party is responsible for the sending);
an electronic mail address for receiving the notice referred to in the main clause of paragraph (3) of the preceding Article, or characters, numerical characters, marks, and other codes for identifying telecommunications facilities, which are specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order;
other matters specified by Order of the Ministry of Internal Affairs and Communications and Cabinet Office Order.

Article 5Prohibition of Transmission under False Sender Information
第五条(送信者情報を偽った送信の禁止)
A sender must not send specified electronic mails falsifying the following information on the sender (hereinafter referred to as "Sender Information") for sending or receiving electronic mails:
electronic mail address used for sending those electronic mails;
characters, numerical characters, marks, and other codes for identifying the telecommunications facilities used for sending those electronic mails.
Article 6Prohibition of Transmission Using Fictitious Electronic Mail Address
第六条(架空電子メールアドレスによる送信の禁止)
A sender must not send electronic mails to fictitious electronic mail addresses for the purpose of sending many electronic mails for their own or others' sales activities.
送信者は、自己又は他人の営業のために多数の電子メールの送信をする目的で、架空電子メールアドレスをそのあて先とする電子メールの送信をしてはならない。
第七条(措置命令)
Where the Minister for Internal Affairs and Communications (hereinafter referred to as "Minister") and the Prime Minister (or the Minister, where it concerns the transmission of electronic mails to fictitious electronic mail addresses) find that with respect to transmission of electronic mails, including simultaneous transmission of specified electronic mails to many persons, a sender does not comply with the provisions of Article 3 or Article 4, or where they find that a sender has sent electronic mails using false Sender Information or electronic mails to fictitious electronic mail addresses, and when they find that it is necessary for preventing disturbances upon transmission and reception of electronic mails, they may order that sender (or, in the case where an entrusting party for those electronic mails has carried out part of the operations relating to the sending of the electronic mails, such as receiving the notice referred to in Article 3, paragraph (1), item (i) or (ii) or retaining the records referred to in paragraph (2) of that Article for the sending of the electronic mails, and it is found that there are grounds attributable to that entrusting party with respect to the sending of the electronic mails, that sender and that entrusting party) to take necessary measures for improving the methods for electronic mail transmission.
総務大臣及び内閣総理大臣(架空電子メールアドレスをそのあて先とする電子メールの送信に係る場合にあっては、総務大臣)は、送信者が一時に多数の者に対してする特定電子メールの送信その他の電子メールの送信につき、第三条若しくは第四条の規定を遵守していないと認める場合又は送信者情報を偽った電子メール若しくは架空電子メールアドレスをそのあて先とする電子メールの送信をしたと認める場合において、電子メールの送受信上の支障を防止するため必要があると認めるときは、当該送信者(これらの電子メールに係る送信委託者が当該電子メールの送信に係る第三条第一項第一号又は第二号の通知の受領、同条第二項の記録の保存その他の当該電子メールの送信に係る業務の一部を行った場合であって、当該電子メールの送信につき、当該送信委託者の責めに帰すべき事由があると認められるときは、当該送信者及び当該送信委託者)に対し、電子メールの送信の方法の改善に関し必要な措置をとるべきことを命ずることができる。
Article 8Petition to the Minister or the Prime Minister
第八条(総務大臣又は内閣総理大臣に対する申出)
A person who has received specified electronic mail may, when the person finds that specified electronic mail has been sent in violation of the provisions of Articles 3 through 5, petition the Minister or the Prime Minister to take appropriate measures.
特定電子メールの受信をした者は、第三条から第五条までの規定に違反して特定電子メールの送信がされたと認めるときは、総務大臣又は内閣総理大臣に対し、適当な措置をとるべきことを申し出ることができる。
When a minister set forth in either of the following items has received a petition pursuant to the provisions of the preceding paragraph (excluding when the petition is made to the Minister and the Prime Minister), that minister is to promptly notify the minister specified in that item to that effect:
次の各号に掲げる大臣は、前項の規定による申出を受けたとき(当該申出が総務大臣及び内閣総理大臣に対するものであるときを除く。)は、速やかに、その旨をそれぞれ当該各号に定める大臣に通知するものとする。

A person who is offering electronic mail services may, when the person finds that electronic mail has been sent to fictitious electronic mail addresses in violation of the provisions of Article 6, petition the Minister to take appropriate measures.
電子メール通信役務を提供する者は、第六条の規定に違反して架空電子メールアドレスをそのあて先とする電子メールの送信がされたと認めるときは、総務大臣に対し、適当な措置をとるべきことを申し出ることができる。
The Minister or the Prime Minister must, when they have received a petition pursuant to the provisions of paragraph (1), implement necessary investigation, and when they find it necessary based upon results of the investigation, take measures based upon this Act and other appropriate measures.
総務大臣又は内閣総理大臣は、第一項の規定による申出を受けたときは、必要な調査を行い、その結果に基づき必要があると認めるときは、この法律に基づく措置その他適当な措置をとらなければならない。
The Minister must, when they have received a petition pursuant to the provisions of paragraph (3), implement necessary investigation, and when they find it necessary based upon results of the investigation, take measures based upon this Act and other appropriate measures.
総務大臣は、第三項の規定による申出を受けたときは、必要な調査を行い、その結果に基づき必要があると認めるときは、この法律に基づく措置その他適当な措置をとらなければならない。
Article 9Processing of Complaints
第九条(苦情等の処理)
A sender of specified electronic mails must, in good faith, process complaints, inquiries, etc. on their transmission of specified electronic mails.
Article 10Information Provision and Technological Development by Telecommunications Carriers
第十条(電気通信事業者による情報の提供及び技術の開発等)
A telecommunications carrier (meaning a telecommunications carrier stipulated in Article 2 item (v) under the Telecommunications Business Act; the same applies hereinafter) offering electronic mail services must endeavor to carry out, for users of the services, the provision of information on services that contribute to prevention of disturbances upon transmission and reception of electronic mails caused by specified electronic mails, electronic mails using false Sender Information, or electronic mails to be sent to fictitious electronic mail addresses (hereinafter referred to as "specified electronic mail, etc.").
電子メール通信役務を提供する電気通信事業者(電気通信事業法第二条第五号に規定する電気通信事業者をいう。以下同じ。)は、その役務の利用者に対し、特定電子メール、送信者情報を偽った電子メール又は架空電子メールアドレスをそのあて先とする電子メール(以下「特定電子メール等」という。)による電子メールの送受信上の支障の防止に資するその役務に関する情報の提供を行うように努めなければならない。
A telecommunications carrier offering electronic mail services must endeavor to develop or introduce technologies for contributing to prevention of disturbances upon transmission and reception caused by specified electronic mail, etc.
Article 11Refusal of Provision of Telecommunications Services
第十一条(電気通信役務の提供の拒否)
A telecommunications carrier may, in cases where electronic mails using false Sender Information have been sent and therefore it is considered that there is a risk of causing disturbances in smooth offering of its electronic mail services or of causing disturbances upon transmission and reception of electronic mails for its users, in cases where many electronic mails addressed to fictitious electronic mail addresses have been simultaneously sent and therefore it is considered that there is a risk of causing disturbances in smooth offering of its electronic mail services, or where it is considered that there is reasonable grounds to refuse the provision of electronic mail services for prevention of disturbances upon transmission and reception of electronic mails, refuse to provide a person who sends electronic mails that have a risk of causing the disturbances with electronic mail services to the extent of preventing the disturbances.
電気通信事業者は、送信者情報を偽った電子メールの送信がされた場合において自己の電子メール通信役務の円滑な提供に支障を生じ、又はその利用者における電子メールの送受信上の支障を生ずるおそれがあると認められるとき、一時に多数の架空電子メールアドレスをそのあて先とする電子メールの送信がされた場合において自己の電子メール通信役務の円滑な提供に支障を生ずるおそれがあると認められるとき、その他電子メールの送受信上の支障を防止するため電子メール通信役務の提供を拒むことについて正当な理由があると認められる場合には、当該支障を防止するために必要な範囲内において、当該支障を生じさせるおそれのある電子メールの送信をする者に対し、電子メール通信役務の提供を拒むことができる。
Article 12Instruction and Advice to Associations of Telecommunications Carriers
第十二条(電気通信事業者の団体に対する指導及び助言)
The Minister is to endeavor to give necessary instructions and advices to a general incorporated association that conducts operations including provision of information and services contributing to prevention of disturbances upon transmission and reception of electronic mails caused by specified electronic mail, etc. for its member telecommunications carriers.
Article 13Disclosure of Status of Research and Development
第十三条(研究開発等の状況の公表)
The Minister, at least once a year, discloses the status of research and development on technologies that contribute to prevention of disturbances upon transmission and reception of electronic mails caused by specified electronic mails, etc. and the introduction status of the technologies by telecommunications carriers that offer electronic mail services.
