Supplementary Provisions, Article 3Transitional Measures Concerning a Certificate of Residence Pertaining to a Foreign Resident
第三条（外国人住民に係る住民票に関する経過措置）
The mayor of a municipality (including the head of a special ward; the same applies hereinafter) must, promptly after the base date, prepare, for each individual, with respect to a person who falls under all of the requirements listed in the following items as of the date specified by Cabinet Order within the period from the date specified in Article 1, item (ii) of the Supplementary Provisions to the day preceding the item (i) effective date (hereinafter in this Article referred to as the "base date"), a provisional certificate of residence stating the matters listed in Article 7, items (i) through (iv), (vii), (viii), (x) through (xi)-2, and (xiv) of the new Act, nationality, etc. (meaning nationality, etc. prescribed in Article 30-45 of the new Act; the same applies hereinafter), and the matters listed in the right-hand column of the table in Article 30-45 of the new Act corresponding to the category of the person listed in the left-hand column of that table.
市町村長（特別区の区長を含む。以下同じ。）は、附則第一条第二号に定める日から第一号施行日の前日までの範囲内において政令で定める日（以下この条において「基準日」という。）現在において次の各号に掲げる要件のいずれにも該当する者につき、基準日後速やかに、個人を単位として、新法第七条第一号から第四号まで、第七号、第八号、第十号から第十一号の二まで及び第十四号に掲げる事項、国籍等（新法第三十条の四十五に規定する国籍等をいう。以下同じ。）並びに新法第三十条の四十五の表の上欄に掲げる者の区分に応じそれぞれ同表の下欄に掲げる事項を記載した仮住民票を作成しなければならない。
Being registered in the alien registration record (meaning the alien registration record prescribed in Article 4, paragraph (1) of the Alien Registration Act (Act No. 125 of 1952); the same applies hereinafter in this Article) of the relevant municipality (including a special ward; the same applies hereinafter).
当該市町村（特別区を含む。以下同じ。）の外国人登録原票（外国人登録法（昭和二十七年法律第百二十五号）第四条第一項に規定する外国人登録原票をいう。以下この条において同じ。）に登録されていること。
Being expected, as of the item (i) effective date, to be a person who falls under a foreign resident of the relevant municipality.
The mayor of the municipality may, during the period from after the base date until the day preceding the item (i) effective date, prepare the provisional certificate of residence prescribed in the preceding paragraph (hereinafter referred to as "provisional certificate of residence") for a person who has come to fall under all of the requirements listed in the items of the preceding paragraph.
The entries in the provisional certificate of residence are to be made based on the alien registration record, the records concerning the qualification as an insured person of National Health Insurance, the qualification as an insured person of the medical care system for the advanced elderly, the qualification as an insured person of long-term care insurance, the qualification as an insured person of the National Pension, and the eligibility of a person receiving the payment of the Child Allowance, prescribed in Article 7, items (x) through (xi)-2 of the new Act, and the information provided by the Minister of Justice under the provisions of the following paragraph.
仮住民票の記載は、外国人登録原票、新法第七条第十号から第十一号の二までに規定する国民健康保険の被保険者の資格、後期高齢者医療の被保険者の資格、介護保険の被保険者の資格、国民年金の被保険者の資格及び児童手当の支給を受けている者の受給資格に関する記録並びに次項の規定により法務大臣から提供を受けた情報に基づき行うものとする。
The Minister of Justice is to, when there has been a request from the mayor of a municipality in connection with the preparation of a provisional certificate of residence, provide information concerning the matters listed in Article 7, items (i) through (iii) of the new Act, nationality, etc., or the matters listed in the right-hand column of the table in Article 30-45 of the new Act.
法務大臣は、市町村長から仮住民票の作成に関し求めがあったときは、新法第七条第一号から第三号までに掲げる事項、国籍等又は新法第三十条の四十五の表の下欄に掲げる事項に関する情報を提供するものとする。
When the mayor of a municipality has prepared a provisional certificate of residence under the provisions of paragraph (1) or paragraph (2), the mayor must immediately notify the person who was the subject of that preparation of the matters entered in the provisional certificate of residence pertaining to that person.
Beyond what is provided for in the preceding paragraphs, the entry, deletion or amendment of an entry in a provisional certificate of residence and other matters necessary in connection with a provisional certificate of residence are specified by Cabinet Order.
