第五条（厚生年金保険の被保険者期間等に関する経過措置）
A period of former applicable corporation mutual aid membership is deemed to be a category I EPI insured period prescribed in Article 2-5, paragraph (1), item (i) of the Employees' Pension Insurance Act (hereinafter referred to as a "category I EPI insured period"); provided, however, that this does not apply to the following periods:
旧適用法人共済組合員期間は、厚生年金保険法第二条の五第一項第一号に規定する第一号厚生年金被保険者期間（以下「第一号厚生年金被保険者期間」という。）とみなす。ただし、次に掲げる期間は、この限りでない。
in the case where the person received payment of a lump-sum withdrawal payment under the provisions of Article 13-10 of the Supplementary Provisions of the pre-amendment National Public Officers Mutual Aid Act, the period that formed the basis for calculating that lump-sum withdrawal payment;
改正前国共済法附則第十三条の十の規定による脱退一時金の支給を受けた場合におけるその脱退一時金の計算の基礎となった期間
in the case where the person received payment of a lump-sum withdrawal payment under the provisions of Article 80, paragraph (1) of the former National Public Officers Mutual Aid Act (including one deemed to be that lump-sum withdrawal payment pursuant to the provisions of other laws and regulations), the period that formed the basis for calculating that lump-sum withdrawal payment;
旧国共済法第八十条第一項の規定による脱退一時金（他の法令の規定により当該脱退一時金とみなされたものを含む。）の支給を受けた場合におけるその脱退一時金の計算の基礎となった期間
in the case where the person received payment of a lump-sum withdrawal payment under the provisions of Article 61-3, paragraph (1) of the Public Corporation Employees, etc. Mutual Aid Association Act (Act No. 134 of 1956) prior to its repeal under the provisions of Article 2 of the Supplementary Provisions of the Act Partially Amending the National Public Officers Mutual Aid Association Act, etc. for the Integration, etc. of the Mutual Aid Association Systems for National Public Officers and Public Corporation Employees (Act No. 82 of 1983), the period that formed the basis for calculating that lump-sum withdrawal payment; or
国家公務員及び公共企業体職員に係る共済組合制度の統合等を図るための国家公務員共済組合法等の一部を改正する法律（昭和五十八年法律第八十二号）附則第二条の規定による廃止前の公共企業体職員等共済組合法（昭和三十一年法律第百三十四号）第六十一条の三第一項の規定による脱退一時金の支給を受けた場合におけるその脱退一時金の計算の基礎となった期間
in the case where the person received payment of a lump-sum withdrawal payment under the provisions of Article 61 of the Supplementary Provisions of the 1985 National Public Officers Mutual Aid Amendment Act, the period that formed the basis for calculating that lump-sum withdrawal payment.
昭和六十年国共済改正法附則第六十一条の規定による脱退一時金の支給を受けた場合におけるその脱退一時金の計算の基礎となった期間
With regard to the period of former applicable corporation mutual aid membership that is deemed to be a category I EPI insured period pursuant to the provisions of the preceding paragraph, when calculating the insured period under employees' pension insurance for the period during which the person was a former mariner member prescribed in Article 32, paragraph (1) of the Supplementary Provisions of the 1985 National Public Officers Mutual Aid Amendment Act before the day on which the 1985 National Public Officers Mutual Aid Amendment Act came into effect, the period obtained by multiplying that period by 4/3 is treated as the insured period under employees' pension insurance.
前項の規定により第一号厚生年金被保険者期間とみなされた旧適用法人共済組合員期間のうち、昭和六十年国共済改正法の施行の日前の昭和六十年国共済改正法附則第三十二条第一項に規定する旧船員組合員であった期間につき厚生年金保険の被保険者期間を計算する場合には、その期間に三分の四を乗じて得た期間をもって厚生年金保険の被保険者期間とする。
With regard to the period of former applicable corporation mutual aid membership that is deemed to be a category I EPI insured period pursuant to the provisions of paragraph (1), when calculating the insured period under employees' pension insurance for the period during which the person was a new mariner member prescribed in Article 32, paragraph (2) of the Supplementary Provisions of the 1985 National Public Officers Mutual Aid Amendment Act, from the day on which the 1985 National Public Officers Mutual Aid Amendment Act came into effect through March 31, 1991, the period obtained by multiplying that period by 6/5 is treated as the insured period under employees' pension insurance.
第一項の規定により第一号厚生年金被保険者期間とみなされた旧適用法人共済組合員期間のうち、昭和六十年国共済改正法の施行の日以後平成三年三月三十一日までの間の昭和六十年国共済改正法附則第三十二条第二項に規定する新船員組合員であった期間につき厚生年金保険の被保険者期間を計算する場合には、その期間に五分の六を乗じて得た期間をもって厚生年金保険の被保険者期間とする。
