Supplementary Provisions, Article 1Effective Date
第一条（施行期日）
This Act comes into effect as of October 1, 2015; provided, however, that the provisions listed in the following items come into effect as of the dates specified respectively in those items.
この法律は、平成二十七年十月一日から施行する。ただし、次の各号に掲げる規定は、それぞれ当該各号に定める日から施行する。

第四条（用語の定義）
In the provisions of this Article through Article 80 of the Supplementary Provisions, the meanings of the terms set forth in the following items are as prescribed in those items:
この条から附則第八十条までの規定において、次の各号に掲げる用語の意義は、それぞれ当該各号に定めるところによる。
pre-amendment Employees' Pension Insurance Act: means the Employees' Pension Insurance Act before the revision by the provisions of Article 1;
改正前厚生年金保険法 第一条の規定による改正前の厚生年金保険法をいう。
Former Employees' Pension Insurance Act: means the Employees' Pension Insurance Act before the revision by the provisions of Article 3 of the Act Partially Amending the National Pension Act, etc. (Act No. 34 of 1985; hereinafter referred to as the "1985 National Pension Amendment Act" in the provisions through Article 75 of the Supplementary Provisions);
旧厚生年金保険法 国民年金法等の一部を改正する法律（昭和六十年法律第三十四号。以下附則第七十五条までにおいて「昭和六十年国民年金等改正法」という。）第三条の規定による改正前の厚生年金保険法をいう。
pre-amendment National Public Officers Mutual Aid Association Act: means the National Public Officers Mutual Aid Association Act before the revision by the provisions of Article 2;
改正前国共済法 第二条の規定による改正前の国家公務員共済組合法をいう。
pre-amendment National Public Officers Mutual Aid Enforcement Act: means the Act for Enforcement in Relation to Long-term Benefit under the National Public Officers Mutual Aid Association Act (Act No. 129 of 1958) before the revision by the provisions of Article 97 of the Supplementary Provisions;
改正前国共済施行法 附則第九十七条の規定による改正前の国家公務員共済組合法の長期給付に関する施行法（昭和三十三年法律第百二十九号）をいう。
former National Public Officers Mutual Aid Association Act: means the National Public Officers, etc. Mutual Aid Association Act before the revision by the provisions of Article 1 of the Act Partially Amending the National Public Officers, etc. Mutual Aid Association Act, etc. (Act No. 105 of 1985; hereinafter referred to as the "1985 National Public Officers Mutual Aid Amendment Act" in the provisions through Article 49 of the Supplementary Provisions);
旧国共済法 国家公務員等共済組合法等の一部を改正する法律（昭和六十年法律第百五号。以下附則第四十九条までにおいて「昭和六十年国共済改正法」という。）第一条の規定による改正前の国家公務員等共済組合法をいう。

改正前地共済施行法 附則第百一条の規定による改正前の地方公務員等共済組合法の長期給付等に関する施行法（昭和三十七年法律第百五十三号）をいう。

改正前私学共済法 第四条の規定による改正前の私立学校教職員共済法をいう。
former Private School Personnel Mutual Aid Association Act: means the Private School Personnel Mutual Aid Association Act before the revision by the provisions of Article 1 of the Act Partially Amending the Private School Personnel Mutual Aid Association Act, etc. (Act No. 106 of 1985; referred to as the "1985 Private School Mutual Aid Amendment Act" in Article 8, paragraph (1) of the Supplementary Provisions);
旧私学共済法 私立学校教職員共済組合法等の一部を改正する法律（昭和六十年法律第百六号。附則第八条第一項において「昭和六十年私学共済改正法」という。）第一条の規定による改正前の私立学校教職員共済組合法をいう。
period of former national public officers mutual aid membership: means the period during which a person who was a member of a National Public Servants Mutual Aid Association was a member before the day on which this Act comes into effect (hereinafter referred to as the "Effective Date") (including a period deemed to be a period during which the person was a member pursuant to the provisions of the pre-amendment National Public Officers Mutual Aid Association Act or other laws and regulations, and a period added to the period during which the person was a member pursuant to the provisions of other laws and regulations);
旧国家公務員共済組合員期間 国家公務員共済組合の組合員であった者のこの法律の施行の日（以下「施行日」という。）前における当該組合員であった期間（改正前国共済法又は他の法令の規定により当該組合員であった期間とみなされた期間及び他の法令の規定により当該組合員であった期間に合算された期間を含む。）をいう。
period of former local public officers mutual aid membership: means the period during which a person who was a member of a Local Public Servants Mutual Aid Association was a member before the Effective Date (including a period deemed to be a period during which the person was a member pursuant to the provisions of the pre-amendment Local Public Officers, etc. Mutual Aid Association Act or other laws and regulations, and a period added to the period during which the person was a member pursuant to the provisions of other laws and regulations);
period of former private school personnel mutual aid membership: means the period during which a person who was a member of the mutual aid system for private school personnel under the provisions of the Private School Personnel Mutual Aid Association Act was a member before the Effective Date (including a period deemed to be a period during which the person was a member pursuant to the provisions of the pre-amendment Private School Personnel Mutual Aid Association Act or other laws and regulations).
Supplementary Provisions, Article 5Transitional Measures Concerning Acquisition of Status as an Insured Covered by Employees' Pension Insurance
第五条（厚生年金保険の被保険者資格の取得の経過措置）
Among persons who were born on or after October 2, 1945 and who, on the day preceding the Effective Date, were a member of a National Public Servants Mutual Aid Association, a member of a Local Public Servants Mutual Aid Association, or a member of the mutual aid system for private school personnel under the provisions of the Private School Personnel Mutual Aid Association Act, and who, on the Effective Date, fall under the persons set forth in Article 12, item (i) of the pre-amendment Employees' Pension Insurance Act, a person who is employed at a place of business that is an applicable place of business prescribed in Article 6, paragraph (1) or (3) of the Employees' Pension Insurance Act (excluding a person who acquires status as an insured covered by employees' pension insurance on the Effective Date pursuant to the provisions of Article 13 of that Act) acquires status as an insured covered by employees' pension insurance on the Effective Date.
昭和二十年十月二日以後に生まれた者であり、かつ、施行日の前日において国家公務員共済組合の組合員、地方公務員共済組合の組合員又は私立学校教職員共済法の規定による私立学校教職員共済制度の加入者であった者であって、施行日において改正前厚生年金保険法第十二条第一号に掲げる者に該当するもののうち厚生年金保険法第六条第一項又は第三項に規定する適用事業所であるものに使用されるもの（施行日に同法第十三条の規定により厚生年金保険の被保険者の資格を取得する者を除く。）は、施行日に、厚生年金保険の被保険者の資格を取得する。
Supplementary Provisions, Article 6Special Provisions on Calculation of Insured Period under Employees' Pension Insurance
第六条（厚生年金保険の被保険者期間の計算の特例）
With regard to a person who acquired status as an insured covered by employees' pension insurance pursuant to the provisions of the preceding Article and lost that status as an insured in October 2015, in the case of applying the provisions of the main clause of Article 19, paragraph (2) of the Employees' Pension Insurance Act, the person is deemed not to have acquired status as an insured.
前条の規定により厚生年金保険の被保険者の資格を取得した者であって、平成二十七年十月に当該被保険者の資格を喪失したものについて、厚生年金保険法第十九条第二項本文の規定を適用する場合においては、当該被保険者の資格を取得しなかったものとみなす。
Supplementary Provisions, Article 7Transitional Measures Concerning Insured Periods, etc. under Employees' Pension Insurance
第七条（厚生年金保険の被保険者期間等に関する経過措置）
A period of former national public officers mutual aid membership, a period of former local public officers mutual aid membership, or a period of former private school personnel mutual aid membership is deemed to be, respectively, a category II EPI insured period prescribed in Article 2-5, paragraph (1), item (ii) of the Employees' Pension Insurance Act as revised by the provisions of Article 1 (hereinafter referred to as the "Amended Employees' Pension Insurance Act") (hereinafter referred to as the "category II EPI insured period"), a category III EPI insured period prescribed in item (iii) of that paragraph (hereinafter referred to as the "category III EPI insured period"), or a category IV EPI insured period prescribed in item (iv) of that paragraph (hereinafter referred to as the "category IV EPI insured period"); provided, however, that this does not apply to the following periods:
旧国家公務員共済組合員期間、旧地方公務員共済組合員期間又は旧私立学校教職員共済加入者期間は、それぞれ第一条の規定による改正後の厚生年金保険法（以下「改正後厚生年金保険法」という。）第二条の五第一項第二号に規定する第二号厚生年金被保険者期間（以下「第二号厚生年金被保険者期間」という。）、同項第三号に規定する第三号厚生年金被保険者期間（以下「第三号厚生年金被保険者期間」という。）又は同項第四号に規定する第四号厚生年金被保険者期間（以下「第四号厚生年金被保険者期間」という。）とみなす。ただし、次に掲げる期間は、この限りでない。

in the case where a person has received a lump-sum withdrawal payment under the provisions of Article 28-13 of the Supplementary Provisions of the pre-amendment Local Public Officers, etc. Mutual Aid Association Act, the period that formed the basis for calculating that lump-sum withdrawal payment;
改正前地共済法附則第二十八条の十三の規定による脱退一時金の支給を受けた場合におけるその脱退一時金の計算の基礎となった期間
in the case where a person has received a lump-sum withdrawal payment under the provisions of Article 13-10 of the Supplementary Provisions of the pre-amendment National Public Officers Mutual Aid Association Act as applied mutatis mutandis pursuant to Article 25 of the pre-amendment Private School Personnel Mutual Aid Association Act, the period that formed the basis for calculating that lump-sum withdrawal payment;
改正前私学共済法第二十五条において準用する改正前国共済法附則第十三条の十の規定による脱退一時金の支給を受けた場合におけるその脱退一時金の計算の基礎となった期間
in the case where a person has received a lump-sum withdrawal payment under the provisions of Article 80, paragraph (1) of the former National Public Officers Mutual Aid Association Act (including a payment deemed to be that lump-sum withdrawal payment pursuant to the provisions of other laws and regulations), the period that formed the basis for calculating that lump-sum withdrawal payment;
旧国共済法第八十条第一項の規定による脱退一時金（他の法令の規定により当該脱退一時金とみなされたものを含む。）の支給を受けた場合におけるその脱退一時金の計算の基礎となった期間
in the case where a person has received a lump-sum withdrawal payment under the provisions of Article 83, paragraph (1) of the former Local Public Officers, etc. Mutual Aid Association Act (including a payment deemed to be that lump-sum withdrawal payment pursuant to the provisions of other laws and regulations), the period that formed the basis for calculating that lump-sum withdrawal payment;
旧地共済法第八十三条第一項の規定による脱退一時金（他の法令の規定により当該脱退一時金とみなされたものを含む。）の支給を受けた場合におけるその脱退一時金の計算の基礎となった期間
in the case where a person has received a lump-sum withdrawal payment under the provisions of Article 80, paragraph (1) of the former National Public Officers Mutual Aid Association Act as applied mutatis mutandis pursuant to Article 25 of the former Private School Personnel Mutual Aid Association Act (including a payment deemed to be that lump-sum withdrawal payment pursuant to the provisions of other laws and regulations), the period that formed the basis for calculating that lump-sum withdrawal payment;
旧私学共済法第二十五条において準用する旧国共済法第八十条第一項の規定による脱退一時金（他の法令の規定により当該脱退一時金とみなされたものを含む。）の支給を受けた場合におけるその脱退一時金の計算の基礎となった期間
in the case where a person has received a lump-sum withdrawal payment under the provisions of Article 61 of the Supplementary Provisions of the 1985 National Public Officers Mutual Aid Amendment Act, the period that formed the basis for calculating that lump-sum withdrawal payment;
昭和六十年国共済改正法附則第六十一条の規定による脱退一時金の支給を受けた場合におけるその脱退一時金の計算の基礎となった期間
in the case where a person has received a lump-sum withdrawal payment under the provisions of Article 42, paragraph (1) of the Supplementary Provisions of the 1985 Local Public Officers Mutual Aid Amendment Act, the period that formed the basis for calculating that lump-sum withdrawal payment;
昭和六十年地共済改正法附則第四十二条第一項の規定による脱退一時金の支給を受けた場合におけるその脱退一時金の計算の基礎となった期間
in the case where a person has received a lump-sum withdrawal payment under the provisions of Article 61 of the Supplementary Provisions of the 1985 National Public Officers Mutual Aid Amendment Act, the example of which is followed pursuant to the provisions of Article 48-2 of the pre-amendment Private School Personnel Mutual Aid Association Act, the period that formed the basis for calculating that lump-sum withdrawal payment;
改正前私学共済法第四十八条の二の規定によりその例によることとされる昭和六十年国共済改正法附則第六十一条の規定による脱退一時金の支給を受けた場合におけるその脱退一時金の計算の基礎となった期間
those specified by Cabinet Order as periods equivalent to the periods set forth in the preceding items.
前各号に掲げる期間に準ずる期間として政令で定めるもの
In the case of calculating the insured period of employees' pension insurance for the period during which a person was a former mariner member prescribed in Article 32, paragraph (1) of the Supplementary Provisions of the 1985 National Public Officers Mutual Aid Amendment Act before April 1, 1986, out of the former National Public Servants Mutual Aid Association member period deemed to be a category II EPI insured period under the provisions of the preceding paragraph, or for the period during which a person was a former mariner member prescribed in Article 35, paragraph (1) of the Supplementary Provisions of the 1985 Local Public Officers Mutual Aid Amendment Act before that day, out of the former Local Public Servants Mutual Aid Association member period deemed to be a category III EPI insured period under the provisions of the preceding paragraph, the period obtained by multiplying the relevant period by four-thirds is to be treated as the category II EPI insured period or category III EPI insured period respectively.
前項の規定により第二号厚生年金被保険者期間とみなされた旧国家公務員共済組合員期間のうち、昭和六十一年四月一日前の昭和六十年国共済改正法附則第三十二条第一項に規定する旧船員組合員であった期間又は前項の規定により第三号厚生年金被保険者期間とみなされた旧地方公務員共済組合員期間のうち、同日前の昭和六十年地共済改正法附則第三十五条第一項に規定する旧船員組合員であった期間につき厚生年金保険の被保険者期間を計算する場合には、それぞれ当該期間に三分の四を乗じて得た期間をもって第二号厚生年金被保険者期間又は第三号厚生年金被保険者期間とする。
In the case of calculating the insured period of employees' pension insurance for the period during which a person was a new mariner member prescribed in Article 32, paragraph (2) of the Supplementary Provisions of the 1985 National Public Officers Mutual Aid Amendment Act, during the period from April 1, 1986 through March 31, 1991, out of the former National Public Servants Mutual Aid Association member period deemed to be a category II EPI insured period under the provisions of paragraph (1), or for the period during which a person was a new mariner member prescribed in Article 35, paragraph (2) of the Supplementary Provisions of the 1985 Local Public Officers Mutual Aid Amendment Act, during the period from April 1, 1986 through March 31, 1991, out of the former Local Public Servants Mutual Aid Association member period deemed to be a category III EPI insured period under the provisions of paragraph (1), the period obtained by multiplying the relevant period by six-fifths is to be treated as the category II EPI insured period or category III EPI insured period respectively.
第一項の規定により第二号厚生年金被保険者期間とみなされた旧国家公務員共済組合員期間のうち、昭和六十一年四月一日以後平成三年三月三十一日までの間の昭和六十年国共済改正法附則第三十二条第二項に規定する新船員組合員であった期間又は第一項の規定により第三号厚生年金被保険者期間とみなされた旧地方公務員共済組合員期間のうち、昭和六十一年四月一日以後平成三年三月三十一日までの間の昭和六十年地共済改正法附則第三十五条第二項に規定する新船員組合員であった期間につき厚生年金保険の被保険者期間を計算する場合には、それぞれ当該期間に五分の六を乗じて得た期間をもって第二号厚生年金被保険者期間又は第三号厚生年金被保険者期間とする。
