Supplementary Provisions, Article 1Effective Date
第一条（施行期日）
This Act comes into effect on August 1, 1965; provided, however, that the provisions of Article 2 and Article 13 of the Supplementary Provisions come into effect on November 1, 1965, and the provisions of Article 3, Articles 14 through 43 of the Supplementary Provisions and Article 45 of the Supplementary Provisions come into effect on February 1, 1966.
この法律は、昭和四十年八月一日から施行する。ただし、第二条及び附則第十三条の規定は昭和四十年十一月一日から、第三条並びに附則第十四条から附則第四十三条まで及び附則第四十五条の規定は昭和四十一年二月一日から施行する。

第二十六条（厚生年金保険法の一部改正に伴う経過措置）
With regard to the payment of a disability pension whose payment is currently suspended as of February 1, 1966 pursuant to the provisions of Article 54 of the Employees' Pension Insurance Act prior to its amendment by the provisions of the preceding Article (hereinafter in this Article referred to as the "Former Act") on the ground that the beneficiary of the disability pension has acquired the right to receive payment of class 2 disability compensation payments under the provisions of Article 12, paragraph (1), item (iii) of the former Industrial Accident Compensation Insurance Act, the provisions then in force continue to govern, notwithstanding the amendment of the provisions of Article 54 of the Former Act. The same applies to the payment of a pension for surviving family whose payment is currently suspended as of February 1, 1966 pursuant to the provisions of Article 64 of the Former Act on the ground that payment of survivor compensation payments under the provisions of Article 12, paragraph (1), item (iv) of the former Industrial Accident Compensation Insurance Act is to be made.
障害年金の受給権者が旧労働者災害補償保険法第十二条第一項第三号の規定による第二種障害補償費の支給を受ける権利を取得したことにより昭和四十一年二月一日において現に前条の規定による改正前の厚生年金保険法（以下この条において「旧法」という。）第五十四条の規定によりその支給が停止されている障害年金の支給については、同条の規定の改正にかかわらず、なお従前の例による。旧労働者災害補償保険法第十二条第一項第四号の規定による遺族補償費の支給が行なわれるべきものであることにより昭和四十一年二月一日において現に旧法第六十四条の規定によりその支給が停止されている遺族年金の支給についても、同様とする。
While the payment of a disability pension or pension for surviving family is suspended pursuant to the provisions of the preceding paragraph, the provisions of Article 65, paragraph (2) of the National Pension Act (including as applied mutatis mutandis pursuant to Article 79-2, paragraph (6) of that Act) do not apply to that disability pension or pension for surviving family.
前項の規定により障害年金又は遺族年金の支給が停止されている間は、当該障害年金又は遺族年金については、国民年金法第六十五条第二項（同法第七十九条の二第六項において準用する場合を含む。）の規定を適用しない。
A disability pension whose payment is currently suspended as of February 1, 1966 pursuant to the provisions of Article 54 of the Former Act on the ground that the beneficiary of the disability pension has acquired the right to receive payment of class 1 disability compensation payments under the provisions of Article 12, paragraph (1), item (iii) of the former Industrial Accident Compensation Insurance Act is to be paid starting with the portion for February of that year, notwithstanding the provisions of Article 36, paragraph (2) of the Employees' Pension Insurance Act.
障害年金の受給権者が旧労働者災害補償保険法第十二条第一項第三号の規定による第一種障害補償費の支給を受ける権利を取得したことにより昭和四十一年二月一日において現に旧法第五十四条の規定によりその支給が停止されている障害年金は、厚生年金保険法第三十六条第二項の規定にかかわらず、同年同月分から支給するものとする。
