With regard to the addition to the insured period, for the period from January 1, 1944 through August 31, 1945, of a person who was an insured who was employed at a place of business of an undertaking prescribed in Article 4 of the Mining Act and was constantly engaged in underground work, the provisions then in force continue to govern.

In the case of applying the provisions of Article 75 to the period during which a person was an insured under the Former Act, the phrase "notification under the provisions of Article 27" in the proviso to paragraph (1) of that Article is deemed to be replaced with "report under the provisions of Article 9 of the Former Act".

With regard to the collection of insurance premiums for months on or before April 1954, the provisions then in force continue to govern.

With regard to the application of penal provisions to acts committed before this Act comes into effect, the provisions then in force continue to govern.

With regard to a person who is a member of a mutual aid Association designated pursuant to Article 32 of the former Order for Enforcement of the Employees' Pension Insurance Act (Imperial Ordinance No. 1250 of 1941) based on Article 74 of the Former Act, the provisions then in force continue to govern also with respect to the application of this Act.

①For a person whose insured period (limited to a category I EPI insured period; the same applies in paragraph (1) of the following Article and Article 28-4, paragraph (1) of the Supplementary Provisions) is one year or more, if within the period specified by Cabinet Order as a period as a member of the former Army Mutual Aid Association under the former Army Mutual Aid Association Order (Imperial Ordinance No. 947 of 1940) or of another mutual aid Association specified by Cabinet Order (hereinafter referred to as the "period as a member of a former mutual aid Association") there is a period from June 1942 to August 1945, that period is deemed, with respect to insurance benefits paid in relation to the person's old age or death, to be a period during which the person was an insured other than an insured mine worker and a mariner insured under this Act; provided, however, that this does not apply where the provisions of Article 43, paragraph (1), Article 9-2, paragraph (2), item (ii) of the Supplementary Provisions (including where that provision is followed under Article 9-3, paragraphs (1) and (3) of the Supplementary Provisions (including where those provisions are followed under paragraph (5) of that Article) and under Article 9-4, paragraph (1) of the Supplementary Provisions (including where that provision is followed under paragraph (2) of the following Article and Article 28-4, paragraph (2) of the Supplementary Provisions) and paragraph (4) of that Article (including where that provision is followed under Article 9-4, paragraph (6) of the Supplementary Provisions)), and Article 58, paragraph (1) (excluding item (iv)) and Article 60, paragraph (1) are applied.

②With regard to the application of the provisions of Article 44, paragraph (1) and Article 62, paragraph (1), for the time being, the phrase "number of months" in these provisions is deemed to be replaced with "number of months (including the period as a member of a former mutual aid Association prescribed in Article 28-2, paragraph (1) of the Supplementary Provisions (limited to that relating to the period from June 1942 to August 1945))".

①If a person who does not fall under Article 42, item (ii) comes to fall under all of the following items, a special old-age pension is paid to that person:

②The amount of a special old-age pension is the amount calculated by following the provisions of Article 9, and Article 9-4, paragraphs (1) and (3), of the Supplementary Provisions.

③A special old-age pension is deemed, for the purposes of the application of the provisions of this Act (excluding the provisions of Articles 8 through 10 of the Supplementary Provisions), to be an employees' old-age pension under the provisions of Article 8 of the Supplementary Provisions (limited to one the amount of which is calculated pursuant to the provisions of Article 9, and Article 9-4, paragraphs (1) and (3), of the Supplementary Provisions).

④The right to benefits from a special old-age pension ceases to exist when the beneficiary dies or acquires the right to benefits from an employees' old-age pension.

①If a person whose insured period is one year or more, for whom the period obtained by adding together the premium-paid period and the premium-exemption period is less than 25 years, and for whom the period obtained by adding together the insured period and the period as a member of a former mutual aid Association is 20 years or more, dies, and the surviving family of that person do not acquire the right to receive benefits from an employees' pension for surviving family, a special pension for surviving family is paid to the surviving family.

②The amount of a special pension for surviving family is the amount equivalent to 50/100 of the amount calculated by following the provisions of Article 9-4, paragraph (1) of the Supplementary Provisions.

③A special pension for surviving family is deemed, for the purposes of the application of this Act (excluding Article 58, Article 60, paragraph (1) and Article 64-2) and Article 20 of the National Pension Act, to be an employees' pension for surviving family paid by reason of falling under Article 58, paragraph (1), item (iv).

①For the time being, a person who does not have Japanese nationality and whose insured period is six months or more (limited to a person who is not an insured under the National Pension), being a person who does not fall under Article 42, item (ii) or another such person specified by Cabinet Order as equivalent thereto, may request payment of a lump-sum withdrawal payment; provided, however, that this does not apply if the person falls under any of the following items:

②Where the request under the preceding paragraph has been made, the lump-sum withdrawal payment is paid to the person who made that request.

③The amount of a lump-sum withdrawal payment is, in accordance with the period during which the person was an insured, the amount obtained by multiplying the average standardized amount of remuneration for that period (meaning the amount obtained by dividing the total of the standard monthly remuneration and the standard bonus amounts in each month that constitutes the basis for calculating the insured period by the number of months in that insured period) by the payment rate.

④The payment rate in the preceding paragraph is the rate obtained by multiplying the rate arrived at when the insurance premium rate in October of the year preceding the year that includes the final month (meaning the month before the month that includes the day on which the person last lost status as an insured; the same applies hereinafter in this paragraph) (or, if the final month is from January through August, the insurance premium rate in October of the year before the preceding year) is multiplied by one-half, by the number specified by Cabinet Order in accordance with the period during which the person was an insured, and if that rate has a fraction of less than the first decimal place, it is rounded off.

⑤When a person has received payment of a lump-sum withdrawal payment, the person is deemed not to have been an insured during the period during which the person was an insured that forms the basis for calculating its amount.

⑥A person who objects to a disposition by the Minister of Health, Labour and Welfare concerning a lump-sum withdrawal payment may file a request for administrative review with the Social Insurance Examination Committee.

⑦A person who objects to a disposition concerning a lump-sum withdrawal payment taken by a person listed in the items of Article 90, paragraph (2) may file a request for administrative review with the person specified in the relevant item.

⑧The provisions of Article 90, paragraphs (4) and (5), Article 91-2, and Article 91-3 apply mutatis mutandis to a request for administrative review under the preceding two paragraphs. In such a case, Cabinet Order provides for the necessary technical replacement of terms in connection with those provisions.

⑨The provisions of Article 2-5, Article 33, Article 35, Article 37, paragraphs (1), (4) and (5), Article 40-2, Article 41, paragraph (1), Article 75, Article 96, Article 98, paragraph (4) and Article 100 apply mutatis mutandis to a lump-sum withdrawal payment. In such a case, Cabinet Order provides for the necessary technical replacement of terms in connection with those provisions.

With regard to a lump-sum withdrawal payment for a person who has spent time as an insured in two or more categories, the provisions of paragraph (1) of the preceding Article are applied by adding together the insured periods relating to the periods during which the person was an insured under the two or more insured categories and treating the payment as relating to a person who has only an insured period relating to time in one category; provided, however, that the amount of that lump-sum withdrawal payment is the amount calculated for each insured period relating to each category of EPI insured period by following the example of the provisions of paragraphs (3) and (4) of that Article. In such a case, the replacement of terms necessary for the application of the provisions of that Article and other necessary particulars are specified by Cabinet Order.

①In order to ensure the smooth implementation of employees' pension insurance services, the government is to have the Welfare and Medical Service Agency, Independent Administrative Agency carry out the services of managing and collecting the claims prescribed in Article 12, paragraph (1) of the Act on the Dissolution of the Pension Welfare Service Public Corporation and Succession to Its Services, etc. (Act No. 20 of 2000) prior to its repeal pursuant to the provisions of Article 14 of the Supplementary Provisions of the Act on the Government Pension Investment Fund, Independent Administrative Agency, until collection of those claims is completed.

②In order to ensure the smooth implementation of employees' pension insurance services, the government is to have the Welfare and Medical Service Agency, Independent Administrative Agency carry out, until March 31, 2027, the services of managing and collecting the claims relating to the small-sum loans prescribed in Article 12, paragraph (1), item (xii) of the Act on the Welfare and Medical Service Agency, Independent Administrative Agency (Act No. 166 of 2002) prior to the amendment by Article 28 of the Act Partially Amending the National Pension Act, etc. to Strengthen the Functions of the Pension System (Act No. 40 of 2020).

①With regard to the authority of the Minister of Health, Labour and Welfare under Article 27 of the Supplementary Provisions of the Act Partially Amending the National Pension Act, etc. (Act No. 95 of 1994) and other provisions that prescribe transitional measures accompanying amendments to this Act and are specified by Order of the Ministry of Health, Labour and Welfare, the administrative functions associated with that authority are to be carried out by JPS by following the example of the provisions of Articles 100-4 through 100-12 of the Employees' Pension Insurance Act as amended by Article 19 of the Supplementary Provisions of the Japan Pension Organization Act (Act No. 109 of 2007) (referred to as the "New Employees' Pension Insurance Act" in the following paragraph).

②In the case of the preceding paragraph, the necessary technical replacement of terms in the application of the provisions of Articles 100-4 through 100-12 of the New Employees' Pension Insurance Act and other particulars necessary for the application of those provisions are specified by Order of the Ministry of Health, Labour and Welfare.
