第三十二条
With regard to a person who held the right to receive benefits of a special old-age pension under the provisions of Article 28-3, paragraph (1) of the Supplementary Provisions of the Employees' Pension Insurance Act Before the Amendment (hereinafter referred to as the "special old-age pension before the amendment" in this Article) before April 1, 1995, the provisions of Article 28-3, paragraph (1) of the Supplementary Provisions of the Employees' Pension Insurance Act do not apply.
平成七年四月一日前において改正前の厚生年金保険法附則第二十八条の三第一項の規定による特例老齢年金（以下この条において「改正前の特例老齢年金」という。）の受給権を有していた者については、厚生年金保険法附則第二十八条の三第一項の規定は適用しない。
With regard to the special old-age pension before the amendment, except where the provisions of the following paragraph and paragraph (4) are applied, the provisions then in force continue to govern.
改正前の特例老齢年金については、次項及び第四項の規定を適用する場合を除き、なお従前の例による。
With regard to the special old-age pension before the amendment, the provisions concerning the calculation of its amount remain in force.
改正前の特例老齢年金については、その額の計算に関する規定は、なおその効力を有する。
With regard to the special old-age pension before the amendment, the provisions of Article 11, Article 13, paragraph (3) and Article 13-2 of the Supplementary Provisions of the Employees' Pension Insurance Act Before the Amendment do not apply, and, deeming it to be an employees' old-age pension under the provisions of Article 8 of the Supplementary Provisions of the Employees' Pension Insurance Act (limited to one whose amount is calculated pursuant to the provisions of Article 18 of the Supplementary Provisions), the provisions of Article 13, paragraphs (2) through (4) and Article 13-2 of the Supplementary Provisions of that Act, and Articles 21 and 23 and Article 28, paragraphs (1) and (2) of the Supplementary Provisions apply. In this case, Cabinet Order provides for the necessary technical replacement of terms in connection with the application of those provisions.
改正前の特例老齢年金については、改正前の厚生年金保険法附則第十一条、第十三条第三項及び第十三条の二の規定を適用せず、厚生年金保険法附則第八条の規定による老齢厚生年金（附則第十八条の規定によりその額が計算されているものに限る。）とみなして、同法附則第十三条第二項から第四項まで及び第十三条の二並びに附則第二十一条、第二十三条並びに第二十八条第一項及び第二項の規定を適用する。この場合において、これらの規定の適用に関し必要な技術的読替えは、政令で定める。
