Supplementary Provisions

This Act comes into effect as of April 1, 2015; provided, however, that the provisions set forth in the following items come into effect as of the dates specified respectively in those items.

The provisions then in force continue to govern deportation with regard to a person who, before the day on which this Act comes into effect (hereinafter referred to as the "Effective Date"), committed an act provided for in Article 24, item (iv), sub-item (a) of the Immigration Control and Refugee Recognition Act prior to the amendment by the provisions of Article 1 (hereinafter referred to as the "Former Immigration Control Act").

①A person who is residing with the status of residence of "Investor/Business Manager" in Appended Table I (2) of the Former Immigration Control Act at the time this Act comes into effect is deemed to be a person residing with the status of residence of "Business Manager" in Appended Table I (2) of the Immigration Control and Refugee Recognition Act as amended by the provisions of Article 1 (hereinafter referred to as the "New Immigration Control Act"). In this case, the period of stay accompanying that status of residence is the period until the day corresponding to the day on which the period of stay accompanying the status of residence of "Investor/Business Manager" expires.

②A person who is residing with the status of residence of "Engineer" or "Specialist in Humanities/International Services" in Appended Table I (2) of the Former Immigration Control Act at the time this Act comes into effect is deemed to be a person residing with the status of residence of "Engineer/Specialist in Humanities/International Services" in Appended Table I (2) of the New Immigration Control Act. In this case, the period of stay accompanying that status of residence is the period until the day corresponding to the day on which the period of stay accompanying the status of residence of "Engineer" or "Specialist in Humanities/International Services" expires.

③A person who is residing with a status of residence in the left-hand column of Appended Table I (5) of the Former Immigration Control Act (hereinafter referred to as the "former status of residence" in this paragraph) at the time this Act comes into effect is deemed to be a person residing with a status of residence in the left-hand column of Appended Table I (5) of the New Immigration Control Act (hereinafter referred to as the "new status of residence" in this paragraph). In this case, the activities in which the person may engage under the new status of residence are the activities in which the person was able to engage under the former status of residence, and the period of stay accompanying the new status of residence is the period until the day corresponding to the day on which the period of stay accompanying the former status of residence expires.

④If a person who is residing with the status of residence of "Investor/Business Manager," "Engineer" or "Specialist in Humanities/International Services" in Appended Table I (2) of the Former Immigration Control Act or a status of residence in the left-hand column of Appended Table I (5) of the Former Immigration Control Act at the time this Act comes into effect has been granted the permission set forth in Article 19, paragraph (2) of the Former Immigration Control Act, that permission is deemed to be the permission set forth in Article 19, paragraph (2) of the New Immigration Control Act granted with regard to the status of residence under the New Immigration Control Act that is deemed pursuant to the provisions of the preceding three paragraphs. In this case, conditions imposed based on the provisions of Article 19, paragraph (2) of the Former Immigration Control Act are deemed to be conditions imposed based on the provisions of Article 19, paragraph (2) of the New Immigration Control Act.

⑤A person who is residing at the time this Act comes into effect with the status of residence in the left-hand column of Appended Table I (5) of the Former Immigration Control Act as a person engaging in any of the activities set forth in the following items among the activities set forth in the right-hand column of the same Table (limited to the part pertaining to (d)), and who continues to reside in Japan thereafter, may, notwithstanding the provisions of Article 20-2, paragraph (1) of the New Immigration Control Act (limited to the part pertaining to item (i)), be granted a change to the status of residence of "Highly Skilled Professional" (limited to that pertaining to item (ii) of the right-hand column under "Highly Skilled Professional" in Appended Table I (2) of the New Immigration Control Act). In this case, the phrase "activities set forth in the preceding item" in item (ii) of the right-hand column under "Highly Skilled Professional" in Appended Table I (2) of the New Immigration Control Act is deemed to be replaced with "activities set forth in the items of Article 3, paragraph (5) of the Supplementary Provisions of the Act Partially Amending the Immigration Control and Refugee Recognition Act (Act No. 74 of 2014)".

Upon receiving an advance application from a foreign national who seeks to land in Japan on or after the Effective Date and who seeks to engage in the activities set forth in any of the following items, the Minister of Justice may, pursuant to the provisions of Ministry of Justice Order, issue to the foreign national, before the Effective Date, a certificate of eligibility pertaining to the status of residence specified in the relevant item:

The provisions then in force continue to govern the application of penal provisions to acts committed before the Effective Date.

Beyond what is provided for in these Supplementary Provisions, transitional measures necessary incidental to the enforcement of this Act are specified by Cabinet Order.
