A person who, by reason of any of the acts or grounds set forth in the items of paragraph (1) of the preceding Article or any other act or ground similar thereto, causes another person to be in a state in which it is difficult to form, express or fulfill an intention not to consent, or takes advantage of the other person being in such a state, and engages in vaginal intercourse, anal intercourse or oral intercourse, or an indecent act of inserting a part of the body (excluding the penis) or an object into the vagina or anus (hereinafter referred to as "sexual intercourse, etc." in this Article and paragraph (2) of Article 179), is punished by imprisonment for a definite term of five years or more, regardless of whether or not there is a marital relationship.
The same as in the preceding paragraph applies to a person who causes another person to mistakenly believe that the act is not indecent or to mistake the identity of the person committing the act, or takes advantage of the other person being under such a mistaken belief or mistaking such identity, and engages in sexual intercourse, etc.
The same as in paragraph (1) applies to a person who engages in sexual intercourse, etc. with a person under sixteen years of age (in the case where the person under sixteen years of age is thirteen years of age or older, limited to a person born on a day five years or more before the day on which the person under sixteen years of age was born).
