A person who, by reason of any of the following acts or grounds or any other act or ground similar thereto, causes another person to be in a state in which it is difficult to form, express or fulfill an intention not to consent, or takes advantage of the other person being in such a state, and commits an indecent act, is punished by imprisonment for six months or more and 10 years or less, regardless of whether or not there is a marital relationship:
次に掲げる行為又は事由その他これらに類する行為又は事由により、同意しない意思を形成し、表明し若しくは全うすることが困難な状態にさせ又はその状態にあることに乗じて、わいせつな行為をした者は、婚姻関係の有無にかかわらず、六月以上十年以下の拘禁刑に処する。
using assault or intimidation, or having been subjected to assault or intimidation;
暴行若しくは脅迫を用いること又はそれらを受けたこと。
causing a mental or physical disability, or there being such a disability;
心身の障害を生じさせること又はそれがあること。
causing the person to ingest alcohol or drugs, or the person being under the influence of alcohol or drugs;
アルコール若しくは薬物を摂取させること又はそれらの影響があること。
causing the person to be asleep or in any other state in which consciousness is not clear, or the person being in such a state;
睡眠その他の意識が明瞭でない状態にさせること又はその状態にあること。
there being no time to form, express or fulfill an intention not to consent;
同意しない意思を形成し、表明し又は全うするいとまがないこと。
causing the person to be terrified or startled by having the person face a situation different from what was expected, or the person being terrified or startled upon facing such a situation;
予想と異なる事態に直面させて恐怖させ、若しくは驚愕させること又はその事態に直面して恐怖し、若しくは驚愕していること。
causing a psychological reaction arising from abuse, or there being such a reaction;
虐待に起因する心理的反応を生じさせること又はそれがあること。
causing the person to worry about a disadvantage to be suffered due to influence based on a position in an economic or social relationship, or the person worrying about such a disadvantage.
経済的又は社会的関係上の地位に基づく影響力によって受ける不利益を憂慮させること又はそれを憂慮していること。
The same as in the preceding paragraph applies to a person who causes another person to mistakenly believe that the act is not indecent or to mistake the identity of the person committing the act, or takes advantage of the other person being under such a mistaken belief or mistaking such identity, and commits an indecent act.
行為がわいせつなものではないとの誤信をさせ、若しくは行為をする者について人違いをさせ、又はそれらの誤信若しくは人違いをしていることに乗じて、わいせつな行為をした者も、前項と同様とする。
The same as in paragraph (1) applies to a person who commits an indecent act upon a person under sixteen years of age (in the case where the person under sixteen years of age is thirteen years of age or older, limited to a person born on a day five years or more before the day on which the person under sixteen years of age was born).
十六歳未満の者に対し、わいせつな行為をした者（当該十六歳未満の者が十三歳以上である場合については、その者が生まれた日より五年以上前の日に生まれた者に限る。）も、第一項と同様とする。
