第七十条第一項第一号、第七十四条、第七十四条の二又は第七十四条の四の犯罪行為の用に供した船舶等又は車両で、犯人の所有又は占有に係るものは、没収する。ただし、その船舶等又は車両が犯人以外の者の所有に係り、かつ、その者が次の各号のいずれかに該当する場合は、この限りでない。
A vessel, an aircraft or a vehicle used for committing a criminal act prescribed in Article 70, paragraph (1), item (i), Article 74, Article 74-2 or Article 74-4 which is owned or possessed by an offender is confiscated; provided however, that this does not apply if the vessel, aircraft or vehicle is owned by a person other than the offender that falls under either of the following sub-items:
第七十条第一項第一号、第七十四条、第七十四条の二又は第七十四条の四の犯罪が行われることをあらかじめ知らないでその犯罪が行われた時から引き続きその船舶等又は車両を所有していると認められるとき。
if it is found that the person has no prior knowledge that the crime set forth in Article 70, paragraph (1), item (i), Article 74, Article 74-2 or Article 74-4 is to be committed, and continued to own the vessel, aircraft or vehicle from the time the crime was committed; or
if it is found that the person came to acquire the vessel, aircraft, or vehicle after the crime prescribed in the preceding item was committed, without the knowledge that it was used in the commission of a crime.
