The commuting allowance is to be paid to a qualified recipient who falls under any of the following items.
通所手当は、次の各号のいずれかに該当する受給資格者に対して、支給するものとする。
a person who habitually uses means of transportation or toll roads (hereinafter in this Article and Article 2, paragraph (2) of the Supplementary Provisions referred to as "means of transportation, etc.") and bears the fares or charges therefor (hereinafter in this Article and Article 2, paragraph (2) of the Supplementary Provisions referred to as "fares, etc.") in order to commute from the qualified recipient's domicile or residence to a facility that conducts public vocational training, etc. (referred to as a "training facility, etc." in Article 86, item (ii) and Article 2 of the Supplementary Provisions) (hereinafter in this Article referred to as "commuting") (excluding a person who falls under item (iii) and a person whose commuting distance, if the person were to commute on foot without using means of transportation, etc., would be less than 2 kilometers one way, other than a person for whom commuting is extremely difficult without using means of transportation, etc.);
a person who habitually uses automobiles or other means of conveyance (hereinafter referred to as "automobiles, etc.") for commuting (excluding a person who falls under the following item and a person whose commuting distance, if the person were to commute on foot without using automobiles, etc., would be less than 2 kilometers one way, other than a person for whom commuting is extremely difficult without using automobiles, etc.); and
a person who habitually uses means of transportation, etc. and bears the fares, etc. therefor, and also uses automobiles, etc., for commuting (excluding a person whose commuting distance, if the person were to commute on foot without using means of transportation, etc. and without using automobiles, etc., would be less than 2 kilometers one way, other than a person for whom commuting is extremely difficult without using means of transportation, etc. or automobiles, etc.).
The monthly amount of the commuting allowance is the amount listed in each of the following items according to the following categories of qualified recipient; provided, however, that where that amount exceeds 42,500 yen, it is 42,500 yen.
通所手当の月額は、次の各号に掲げる受給資格者の区分に応じて、当該各号に掲げる額とする。ただし、その額が四万二千五百円を超えるときは、四万二千五百円とする。
a person who falls under item (i) of the preceding paragraph: an amount equivalent to the fares, etc. required for the person's commuting for one month, calculated as provided in the following paragraph and paragraph (4) (hereinafter in this Article referred to as the "amount equivalent to fares, etc.");
a person who falls under item (ii) of the preceding paragraph: 3,690 yen for a person for whom the distance of using automobiles, etc. is less than 10 kilometers one way, and 5,850 yen for any other person (8,010 yen for a person who resides in a region specified by the Minister of Health, Labour and Welfare (hereinafter in this Article and Article 2, paragraph (2), item (i), (b) of the Supplementary Provisions referred to as a "designated region") and for whom the distance of using automobiles, etc. is 15 kilometers or more one way);
前項第二号に該当する者 自動車等を使用する距離が片道十キロメートル未満である者にあつては三千六百九十円、その他の者にあつては五千八百五十円（厚生労働大臣の定める地域（以下この条及び附則第二条第二項第一号ロにおいて「指定地域」という。）に居住する者であつて、自動車等を使用する距離が片道十五キロメートル以上である者にあつては八千十円）

among persons who fall under item (iii) of the preceding paragraph (excluding a person listed in the preceding item), a person for whom the amount equivalent to fares, etc. is equal to or more than the amount listed in item (ii): the amount listed in item (i); and
among persons who fall under item (iii) of the preceding paragraph (excluding a person listed in item (iii)), a person for whom the amount equivalent to fares, etc. is less than the amount listed in item (ii): the amount listed in item (ii).
The amount equivalent to fares, etc. is to be calculated based on the amount of fares, etc. by the ordinary commuting route and method that is found to be the most economical and rational in light of circumstances such as fares, time and distance.
The amount equivalent to fares, etc. is the total of the amounts under the following items.
運賃等相当額は、次の各号による額の総額とする。
where the means of transportation, etc. issues commuter passes (including those equivalent thereto; the same applies in the following item), the price of a commuter pass valid for one month for the section in which the means of transportation, etc. is used (where commuter passes of different prices are issued, the price of the lowest-priced commuter pass); and
where the means of transportation, etc. does not issue commuter passes, the amount of fares, etc. for 21 instances of commuting for the section in which the means of transportation, etc. is used, being the lowest of such amounts.
The monthly amount of the commuting allowance for a month that contains a day listed in any of the following items is, notwithstanding the provisions of paragraph (2), the amount obtained by deducting from the amount under that paragraph the amount obtained by multiplying it by the ratio that the number of those days bears to the actual number of days in that month.
a day that does not fall within the period of taking public vocational training, etc.;

a day other than a day that is subject to payment of the basic allowance (including a day on which the basic allowance is not to be paid pursuant to the provisions of Article 19, paragraph (1) of the Act); and

a day on which the qualified recipient did not take public vocational training, etc. even though it is found that there was no natural disaster or other unavoidable reason.
The monthly amount of the commuting allowance in the case of taking public vocational training, etc. for which commuting is not habitual is, notwithstanding the provisions of the preceding five paragraphs, the amount listed in each of the following items according to the following categories of qualified recipient; provided, however, that where that amount exceeds 42,500 yen, it is 42,500 yen.
a person who bears the fares, etc. by using means of transportation, etc. for commuting (excluding a person who falls under item (iii) and a person whose commuting distance, if the person were to commute on foot without using means of transportation, etc., would be less than 2 kilometers one way, other than a person for whom commuting is extremely difficult without using means of transportation, etc.): the amount obtained by multiplying the amount of fares, etc. required for one day's commuting for the section in which the means of transportation, etc. is used by the number of days on which the person actually commuted;
a person who uses automobiles, etc. for commuting (excluding a person who falls under the following item and a person whose commuting distance, if the person were to commute on foot without using automobiles, etc., would be less than 2 kilometers one way, other than a person for whom commuting is extremely difficult without using automobiles, etc.): the amount obtained by dividing 3,690 yen for a person for whom the distance of using automobiles, etc. is less than 10 kilometers one way, and 5,850 yen for any other person (8,010 yen for a person who resides in a designated region and for whom the distance of using automobiles, etc. is 15 kilometers or more one way), by the actual number of days in the month in which that commuting takes place, and multiplying the result by the number of days on which the person actually commuted;
a person who uses means of transportation, etc. and bears the fares, etc. therefor, and also uses automobiles, etc., for commuting (excluding a person whose commuting distance, if the person were to commute on foot without using means of transportation, etc. and without using automobiles, etc., would be less than 2 kilometers one way, other than a person for whom commuting is extremely difficult without using means of transportation, etc. or automobiles, etc.): the total amount of the amount listed in item (i) and the amount listed in the preceding item (for a person who uses means of transportation, etc. only within a distance that is ordinarily covered on foot, other than a person for whom commuting is extremely difficult without using means of transportation, etc., or a person for whom the distance of using automobiles, etc. is less than 2 kilometers one way, other than a person for whom commuting is extremely difficult without using automobiles, etc., where the amount listed in item (i) is equal to or more than the amount listed in the preceding item, the amount listed in item (i), and where the amount listed in that item is less than the amount listed in the preceding item, the amount listed in the preceding item).
