Article 38-4Criteria Specified by Order of the Ministry of Health, Labour and Welfare under Article 24-2, Paragraph (1), Item (i) of the Act
The criteria specified by Order of the Ministry of Health, Labour and Welfare under Article 24-2, paragraph (1), item (i) of the Act are that the qualified recipient falls under any of the following items:
法第二十四条の二第一項第一号の厚生労働省令で定める基準は、受給資格者が次の各号のいずれかに該当することとする。
that the person has an intractable disease;
難治性疾患を有するものであること。
that the person is a person with a developmental disability prescribed in Article 2, paragraph (2) of the Act on Support for Persons with Developmental Disabilities (Act No. 167 of 2004) (hereinafter referred to as a "person with a developmental disability");
発達障害者支援法（平成十六年法律第百六十七号）第二条第二項に規定する発達障害者（以下「発達障害者」という。）であること。
in addition to what is listed in the preceding two items, that the person is a person with a disability prescribed in Article 2, item (i) of the Disability Employment Promotion Act.
前二号に掲げるもののほか、障害者雇用促進法第二条第一号に規定する障害者であること。
