嫡出否認の訴えの特別代理人の選任の審判事件は、子の住所地を管轄する家庭裁判所の管轄に属する。
An adjudication case for the appointment of a special representative in an action to rebut presumption of a child born in wedlock is subject to the jurisdiction of the family court which has jurisdiction over the place of domicile of a child.
第百十八条の規定は、嫡出否認の訴えの特別代理人の選任の審判事件における父及び民法第七百七十四条第四項に規定する前夫について準用する。
The provisions of Article 118 apply mutatis mutandis to the father and the former husband prescribed in Article 774, paragraph (4) of the Civil Code in an adjudication case for the appointment of a special representative in an action to rebut presumption of a child born in wedlock.
嫡出否認の訴えの特別代理人の選任の申立てをした者は、その申立てを却下する審判に対し、即時抗告をすることができる。
A person who has filed a petition for the appointment of a special representative in an action to rebut presumption of a child born in wedlock may file an immediate appeal against a ruling to dismiss the person's petition.
子の氏の変更についての許可の審判事件（別表第一の六十の項の事項についての審判事件をいう。次項において同じ。）は、子（父又は母を同じくする数人の子についての子の氏の変更についての許可の申立てに係るものにあっては、そのうちの一人）の住所地を管轄する家庭裁判所の管轄に属する。
An adjudication case for permission to change the surname of a child (meaning an adjudication case regarding the matters set forth in Appended Table 1, row (60); the same applies in the following paragraph) is subject to the jurisdiction of the family court which has jurisdiction over the place of domicile of a child (in the case of a petition for permission for the change of the surname regarding two or more children who have the same father or mother, one of the children).
第百十八条の規定は、子の氏の変更についての許可の審判事件における子（十五歳以上のものに限る。）について準用する。

家庭裁判所は、養子縁組をするについての許可の審判をする場合には、次に掲げる者の陳述を聴かなければならない。ただし、養子となるべき者については、その者の心身の障害によりその者の陳述を聴くことができないときは、この限りでない。
When making a ruling of permission to adopt, the family court must hear statements from the following persons; provided, however, that this does not apply to a person who is to be adopted if it is impossible to hear the person's opinions due to the person's mental or physical disability:
養子となるべき者（十五歳以上のものに限る。）
a person who is to be adopted (limited to a person of 15 years of age or older); and
養子となるべき者に対し親権を行う者及び養子となるべき者の未成年後見人
a person who exercises parental authority over a person who is to be adopted and a guardian of a minor who is to be adopted.
養子縁組をするについての許可の申立てをした者は、その申立てを却下する審判に対し、即時抗告をすることができる。
A person who has filed a petition for permission to adopt may file an immediate appeal against a ruling to dismiss the person's petition.
養子縁組の承諾をするについての同意に代わる許可の審判事件は、養子となるべき者の住所地を管轄する家庭裁判所の管轄に属する。

第百十八条の規定は、養子縁組の承諾をするについての同意に代わる許可の審判事件における養子となるべき者の法定代理人、養子となるべき者の父母でその監護をすべき者であるもの及び養子となるべき者の父母で親権を停止されているものについて準用する。
The provisions of Article 118 apply mutatis mutandis to the legal representative of the person who is to be adopted, a parent of the person who is to be adopted who is to have custody of that person, and a parent of the person who is to be adopted whose parental authority has been suspended, in an adjudication case for permission in lieu of consent for giving consent to adoption.
家庭裁判所は、養子縁組の承諾をするについての同意に代わる許可の審判をする場合には、養子となるべき者の父母でその監護をすべき者であるもの及び養子となるべき者の父母で親権を停止されているものの陳述を聴かなければならない。
When making a ruling of permission in lieu of consent for giving consent to adoption, the family court must hear statements from a parent of the person who is to be adopted who is to have custody of that person and a parent of the person who is to be adopted whose parental authority has been suspended.

次の各号に掲げる審判に対しては、当該各号に定める者は、即時抗告をすることができる。

養子縁組の承諾をするについての同意に代わる許可の審判 養子となるべき者の父母でその監護をすべき者であるもの及び養子となるべき者の父母で親権を停止されているもの
a ruling of permission in lieu of consent for giving consent to adoption:a parent of the person who is to be adopted who is to have custody of that person and a parent of the person who is to be adopted whose parental authority has been suspended;
養子縁組の承諾をするについての同意に代わる許可の申立てを却下する審判 申立人
a ruling to dismiss a petition for permission in lieu of consent for giving consent to adoption:the petitioner.
死後離縁をするについての許可の審判事件は、申立人の住所地を管轄する家庭裁判所の管轄に属する。
An adjudication case for permission for the dissolution of an adoptive relationship after the death of a party to an adoption is subject to the jurisdiction of the family court which has jurisdiction over the place of domicile of the petitioner.
第百十八条の規定は、死後離縁をするについての許可の審判事件における養親及び養子（十五歳以上のものに限る。）について準用する。

家庭裁判所は、養子の死後に死後離縁をするについての許可の申立てがあった場合には、申立てが不適法であるとき又は申立てに理由がないことが明らかなときを除き、養子を代襲して養親の相続人となるべき者に対し、その旨を通知するものとする。ただし、事件の記録上その者の氏名及び住所又は居所が判明している場合に限る。
When a petition for permission for the dissolution of an adoptive relationship after the death of a party to an adoption is filed after an adopted child has died, the family court is to give notice to that effect to a person who is to be the heir of the adoptive parent as an heir per stirpes of the adopted child, except when the petition is unlawful or the petition is clearly groundless; provided, however, that this is required only when the name and domicile or residence of that person is known from the case record.
次の各号に掲げる審判に対しては、当該各号に定める者は、即時抗告をすることができる。
An immediate appeal may be filed against the rulings set forth in the following items by the persons specified respectively in these items:
死後離縁をするについての許可の審判 利害関係人（申立人を除く。）
a ruling for permission for the dissolution of an adoptive relationship after the death of a party to an adoption:an interested party (excluding the petitioner); and
死後離縁をするについての許可の申立てを却下する審判 申立人
a ruling to dismiss a petition for permission for the dissolution of an adoptive relationship after the death of a party to an adoption:the petitioner.
離縁等の場合における祭具等の所有権の承継者の指定の審判事件（別表第二の六の項の事項についての審判事件をいう。）は、その所有者の住所地を管轄する家庭裁判所の管轄に属する。
An adjudication case for the designation of a successor to the ownership of equipment for rituals, etc. upon the dissolution of an adoptive relationship, etc. (meaning an adjudication case regarding the matters set forth in Appended Table 2, row (6)) is subject to the jurisdiction of the family court which has jurisdiction over the place of domicile of the owner.
家庭裁判所は、離縁等の場合における祭具等の所有権の承継者の指定の審判において、当事者に対し、系譜、祭具及び墳墓の引渡しを命ずることができる。
In a ruling of the designation of a successor to the ownership of equipment for rituals, etc. upon the dissolution of an adoptive relationship, etc., the family court may order a party to deliver genealogy information, equipment for rituals, and graves.
離縁の当事者その他の利害関係人は、離縁等の場合における祭具等の所有権の承継者の指定の審判及びその申立てを却下する審判に対し、即時抗告をすることができる。
A party to the dissolution of an adoptive relationship and any other interested party may file an immediate appeal against a ruling of the designation of a successor to the ownership of equipment for rituals, etc. upon the dissolution of an adoptive relationship, etc. and a ruling to dismiss a petition for the ruling.
特別養子縁組の成立の審判事件は、養親となるべき者の住所地を管轄する家庭裁判所の管轄に属する。
An adjudication case for the establishment of a special adoption is subject to the jurisdiction of the family court which has jurisdiction over the place of domicile of a person who is to adopt another person.
養子となるべき者は、特別養子適格の確認（養子となるべき者について民法第八百十七条の六に定める要件があること及び同法第八百十七条の七に規定する父母による養子となる者の監護が著しく困難又は不適当であることその他特別の事情がある場合に該当することについての確認をいう。以下この条及び次条において同じ。）の審判（申立人の同条第一項の規定による申立てによりされたものに限る。）を受けた者又は児童相談所長の申立てによる特別養子適格の確認の審判（特別養子縁組の成立の申立ての日の六箇月前の日以後に確定したものに限る。）を受けた者でなければならない。
A person who is to be adopted must be a person subject to a ruling of confirmation of eligibility for a special adoption (meaning confirmation that the person who is to be adopted has the requirements set forth in Article 817-6 of the Civil Code, and the parents specified in Article 817-7 of the same Code may be considerably difficult or inappropriate to take care of a person who is to be adopted, or that there is any other special circumstances; hereinafter the same applies in this Article and the following Article) (limited to those filed by the petitioner pursuant to the provisions of paragraph (1) of the Article) or a person subject to a ruling for confirmation of eligibility for a special adoption upon petition by the director of a child guidance center (limited to those determined after the date, which is six months before the date of the petition for the establishment of a special adoption).
養子となるべき者の親権者（申立人の配偶者である民法第八百十七条の三第二項ただし書に規定する他の一方を除く。以下この項において同じ。）及びその親権者に対し親権を行う者は、特別養子縁組の成立の審判事件において養子となるべき者を代理して手続行為をすることができない。
The person who has parental authority over the person who is to be adopted (excluding the other prescribed in the provisions of the proviso to Article 817-3, paragraph (2) of the Civil Code, who is the spouse of the petitioner; hereinafter the same applies in this paragraph) and those who exercise parental authority over the person who has parental authority over the person who is to be adopted may not participate in proceedings on behalf of the person who is to be adopted in an adjudication case for the establishment of a special adoption.
養子となるべき者の父母（申立人の配偶者である民法第八百十七条の三第二項ただし書に規定する他の一方を除く。第十項において同じ。）は、第四十二条第一項及び第三項の規定にかかわらず、特別養子縁組の成立の審判事件の手続に参加することができない。
The parents of the person who is to be adopted (excluding the other one prescribed in the proviso to Article 817-3, paragraph (2) of the Civil Code, who is the spouse of the petitioner. The same applies in paragraph (10)), notwithstanding the provisions of Article 42, paragraphs (1) and (3), may not participate in the proceedings of an adjudication case for the establishment of a special adoption.
第百十八条の規定は、特別養子縁組の成立の審判事件（当該審判事件を本案とする保全処分についての審判事件を含む。）における養親となるべき者並びに養子となるべき者及び申立人の配偶者である民法第八百十七条の三第二項ただし書に規定する他の一方について準用する。
The provisions of Article 118 apply mutatis mutandis to a person who is to adopt another and a person who is to be adopted, and the other person prescribed in the proviso of Article 817-3, paragraph (2) of the Civil Code, who is a spouse of the petitioner in an adjudication case for the establishment of a special adoption (including an adjudication case for a provisional order sought by designating the adjudication case as a case on the merits).
家庭裁判所は、特別養子縁組の成立の審判をする場合には、次に掲げる者の陳述を聴かなければならない。
When making a ruling of the establishment of a special adoption, the family court must hear statements from the following persons.
養子となるべき者（十五歳以上のものに限る。）
the person who is to be adopted (limited to those aged 15 or older);
養子となるべき者に対し親権を行う者（養子となるべき者の父母及び養子となるべき者の親権者に対し親権を行う者を除く。）及び養子となるべき者の未成年後見人
the person who exercises parental authority over the person who is to be adopted (excluding parents of the person who is to be adopted and person who exercises parental authority over the parents of a person who is to be adopted), and a guardian of the minor who is to be adopted.
特別養子適格の確認の審判（児童相談所長の申立てによる特別養子適格の確認の審判を含む。以下この項において同じ。）は、特別養子縁組の成立の審判事件の係属する裁判所を拘束する。この場合において、特別養子適格の確認の審判は、特別養子縁組の成立の審判事件との関係においては、特別養子縁組の成立の審判をする時においてしたものとみなす。
A ruling of the confirmation of eligibility for a special adoption (including ruling of the confirmation of eligibility for a special adoption upon petition by the director of child guidance center; hereinafter the same applies in this paragraph) binds the court before which an adjudication case for the establishment of a special adoption is pending. In this case, a ruling of the confirmation of eligibility for a special adoption, in relation to the adjudication case for the establishment of a special adoption, is deemed to have been made at the time of ruling for the establishment of a special adoption.
特別養子縁組の成立の審判は、第七十四条第一項に規定する者のほか、第六項第二号に掲げる者に告知しなければならない。
Notice of a ruling of the establishment of a special adoption must be given to the persons set forth in paragraph (6), item (ii), beyond the persons prescribed in Article 74, paragraph (1).
特別養子縁組の成立の審判は、養子となるべき者の年齢及び発達の程度その他一切の事情を考慮してその者の利益を害すると認める場合には、その者に告知することを要しない。ただし、養子となるべき者が十五歳に達している場合は、この限りでない。
Notice of a ruling of the establishment of a special adoption is not required to be given to the person who is to be adopted when the family court finds that the notice would harm the interests of the person in consideration of the person's age, degree of development, and in all other circumstances; provided, however, that this does not apply if the person who is to be adopted has reached the age of fifteen.
特別養子縁組の成立の審判は、養子となるべき者の父母に告知することを要しない。ただし、住所又は居所が知れている父母に対しては、審判をした日及び審判の主文を通知しなければならない。
Notice of a ruling of the establishment of a special adoption is not required to be given to the parents of the person who is to be adopted; provided, however, that the date of ruling and the main text of the ruling must be notified to the parents whose address or residence is known.
家庭裁判所は、第二項の規定にかかわらず、特別養子縁組の成立の審判を、特別養子適格の確認の審判と同時にすることができる。この場合においては、特別養子縁組の成立の審判は、特別養子適格の確認の審判が確定するまでは、確定しないものとする。
Notwithstanding the provisions of paragraph (2), the family court may make a ruling of the establishment of a special adoption at the same time as a ruling of confirmation of the eligibility for a special adoption. In this case, the ruling of the establishment of a special adoption has not been finalized until the ruling of confirmation of the eligibility for a special adoption is finalized.
家庭裁判所は、前項前段の場合において、特別養子適格の確認の審判を取り消す裁判が確定したときは、職権で、特別養子縁組の成立の審判を取り消さなければならない。
In the case set forth in the provisions of the first sentence of the preceding paragraph, if the judicial decision revoking the ruling on confirmation of eligibility for a special adoption is finalized, the family court must revoke the ruling of the establishment of a special adoption by its own authority.
特別養子縁組の成立の審判は、養子となるべき者が十八歳に達した日以後は、確定しないものとする。この場合においては、家庭裁判所は、職権で、その審判を取り消さなければならない。
A ruling of the establishment of a special adoption does not become final and binding after the date when the person who is to be adopted reaches the age of eighteen. In this case, the family court must revoke the ruling by its own authority.
次の各号に掲げる審判に対しては、当該各号に定める者は、即時抗告をすることができる。
An immediate appeal may be filed against the rulings set forth in the following items by the persons specified respectively in these items:
特別養子縁組の成立の審判 養子となるべき者及び第六項第二号に掲げる者
a ruling of the establishment of a special adoption:the person who is to be adopted and the person set forth in paragraph (6), item (ii).
特別養子縁組の成立の申立てを却下する審判 申立人
a ruling to dismiss a petition for the establishment of a special adoption:the petitioner.
養子となるべき者（十五歳未満のものに限る。）による特別養子縁組の成立の審判に対する即時抗告の期間は、養子となるべき者以外の者が審判の告知を受けた日（二以上あるときは、当該日のうち最も遅い日）から進行する。
The period of an immediate appeal filed against a ruling of the establishment of a special adoption by a person who is to be adopted (limited to those under the age of 15) runs from the date on which a person other than the person who is to be adopted receives a notice of the ruling (if there are two or more such days, the latest day).
