情報通信技術の進展等に対応するための刑事訴訟法等の一部を改正する法律（令和七年法律第三十九号）による改正後の条文です。変わる言葉に印をつけています。

裁判所の土地管轄は、犯罪地又は被告人の住所、居所若しくは現在地による。
The territorial jurisdiction of courts is determined by the place where the crime was committed, the place where the domicile or the residence of the defendant is located, or the place where the defendant is at present.
国外に在る日本船舶内で犯した罪については、前項に規定する地の外、その船舶の船籍の所在地又は犯罪後その船舶の寄泊した地による。
With respect to crimes committed on board a Japanese vessel while outside Japanese territory, the territorial jurisdiction will be determined, in addition to the places prescribed in the preceding paragraph, by the place of the port of registry of such vessel or the place of the port of call after said crime was committed.
国外に在る日本航空機内で犯した罪については、第一項に規定する地の外、犯罪後その航空機の着陸（着水を含む。）した地による。
With respect to crimes committed in a Japanese aircraft while outside Japanese territory, the territorial jurisdiction will be determined, in addition to the places prescribed in paragraph (1), by the place where such aircraft lands (including landing on water) after the crime was committed.
事物管轄を異にする数個の事件が関連するときは、上級の裁判所は、併せてこれを管轄することができる。
If two or more related cases fall under the subject-matter jurisdiction of different courts, a higher court may jointly exercise jurisdiction over all of said cases.
高等裁判所の特別権限に属する事件と他の事件とが関連するときは、高等裁判所は、併せてこれを管轄することができる。
If a case falls under special jurisdiction of a high court and other cases are related to said case, the high court may jointly exercise jurisdiction over all of said cases.
事物管轄を異にする数個の関連事件が上級の裁判所に係属する場合において、併せて審判することを必要としないものがあるときは、上級の裁判所は、決定で管轄権を有する下級の裁判所にこれを移送することができる。
If two or more related cases falling under the subject-matter jurisdiction of different courts are pending before a higher court and there is any case which need not be jointly tried, the higher court may make a ruling to transfer such case to a lower court which has jurisdiction over it.
数個の関連事件が各別に上級の裁判所及び下級の裁判所に係属するときは、事物管轄にかかわらず、上級の裁判所は、決定で下級の裁判所の管轄に属する事件を併せて審判することができる。
If two or more related cases are separately pending before a higher court and a lower court, the higher court may, irrespective of the subject-matter jurisdiction, make a ruling to jointly try the case falling under the jurisdiction of the lower court.
高等裁判所の特別権限に属する事件が高等裁判所に係属し、これと関連する事件が下級の裁判所に係属するときは、高等裁判所は、決定で下級の裁判所の管轄に属する事件を併せて審判することができる。
If a case falling under the special jurisdiction of a high court is pending before it and a related case is pending before a lower court, the high court may make a ruling to jointly try the case falling under the jurisdiction of the lower court.
土地管轄を異にする数個の事件が関連するときは、一個の事件につき管轄権を有する裁判所は、併せて他の事件を管轄することができる。但し、他の法律の規定により特定の裁判所の管轄に属する事件は、これを管轄することができない。
If two or more cases falling under the territorial jurisdiction of different courts are related to each other, any court which has jurisdiction over one of these cases may exercise jurisdiction over the other cases jointly; provided, however, that such court may not exercise jurisdiction over a case which falls under the jurisdiction of a particular court pursuant to the provisions of other acts.
土地管轄を異にする数個の関連事件が同一裁判所に係属する場合において、併せて審判することを必要としないものがあるときは、その裁判所は、決定で管轄権を有する他の裁判所にこれを移送することができる。
If two or more related cases falling under the territorial jurisdiction of different courts are pending before one court and there is any case which need not be jointly tried, the court may make a ruling to transfer such case to another court which has jurisdiction over it.
数個の関連事件が各別に事物管轄を同じくする数個の裁判所に係属するときは、各裁判所は、検察官又は被告人の請求により、決定でこれを一の裁判所に併合することができる。
If two or more related cases are separately pending before different courts which have the same subject-matter jurisdiction, each court may, upon the request of a public prosecutor or the defendant, make a ruling that they are jointly tried in one court.
前項の場合において各裁判所の決定が一致しないときは、各裁判所に共通する直近上級の裁判所は、検察官又は被告人の請求により、決定で事件を一の裁判所に併合することができる。
If the rulings of several courts as given in the preceding paragraph have not come to an accord, the next higher court common to all of these courts may, upon the request of a public prosecutor or the defendant, make a ruling that the cases are to be jointly tried in one court.
数個の事件は、左の場合に関連するものとする。
Two or more cases are deemed to be related when:
一人が数罪を犯したとき。
one person has committed several crimes;
数人が共に同一又は別個の罪を犯したとき。
several persons have committed the same crime or several separate crimes together;
数人が通謀して各別に罪を犯したとき。
several persons have conspired with each other, and each of them has committed crimes separately.
犯人蔵匿の罪、証憑湮滅の罪、偽証の罪、虚偽の鑑定通訳の罪及び贓物に関する罪とその本犯の罪とは、共に犯したものとみなす。
The crimes of harboring criminals, tampering with evidence, perjury, giving false expert evidence or interpretation and crimes concerning property obtained through a property crime will be deemed to have been committed together with a crime committed by the principal offender.
同一事件が事物管轄を異にする数個の裁判所に係属するときは、上級の裁判所が、これを審判する。
When the same case is pending before several courts differing in subject-matter jurisdiction, said case will be tried by a higher court.
上級の裁判所は、検察官又は被告人の請求により、決定で管轄権を有する下級の裁判所にその事件を審判させることができる。
The higher court may, upon the request of a public prosecutor or the defendant, make a ruling that a lower court which has jurisdiction over the case tries said case.
同一事件が事物管轄を同じくする数個の裁判所に係属するときは、最初に公訴を受けた裁判所が、これを審判する。
When the same case is pending before several courts which have the same subject-matter jurisdiction, said case will be tried by the court in which prosecution was first instituted.
各裁判所に共通する直近上級の裁判所は、検察官又は被告人の請求により、決定で後に公訴を受けた裁判所にその事件を審判させることができる。
The next higher court common to all of these courts may, upon the request of a public prosecutor or the defendant, make a ruling that the case is tried by a court in which prosecution was later instituted.
裁判所は、事実発見のため必要があるときは、管轄区域外で職務を行うことができる。
When it is necessary for the purpose of discovering facts, a court may execute its duties outside the district under its jurisdiction.
前項の規定は、受命裁判官にこれを準用する。
The provisions of the preceding paragraph apply mutatis mutandis to commissioned judges.
訴訟手続は、管轄違の理由によつては、その効力を失わない。
Court proceedings do not lose their effect due to lacking jurisdiction.
裁判所は、管轄権を有しないときでも、急速を要する場合には、事実発見のため必要な処分をすることができる。
In cases requiring urgency, a court may, even when it has no jurisdiction, take the measures necessary for the discovery of facts.
前項の規定は、受命裁判官にこれを準用する。
The provisions of the preceding paragraph apply mutatis mutandis to commissioned judges.
検察官は、左の場合には、関係のある第一審裁判所に共通する直近上級の裁判所に管轄指定の請求をしなければならない。
A public prosecutor must request the next higher court common to all of the relevant courts of first instance to designate the court which is to have jurisdiction when:
裁判所の管轄区域が明らかでないため管轄裁判所が定まらないとき。
the competent court of jurisdiction cannot be determined since the jurisdictional district is not clear;
管轄違を言い渡した裁判が確定した事件について他に管轄裁判所がないとき。
there is no other court with jurisdiction over a case with respect to which a decision that a certain court lacks jurisdiction has become final.
法律による管轄裁判所がないとき、又はこれを知ることができないときは、検事総長は、最高裁判所に管轄指定の請求をしなければならない。
When no court has jurisdiction under law, or when it is impossible to ascertain such court, the Prosecutor-General must request the Supreme Court to designate the court which is to have jurisdiction.
検察官は、左の場合には、直近上級の裁判所に管轄移転の請求をしなければならない。
A public prosecutor must request the next higher court of the court concerned to effect a change of jurisdiction when:
管轄裁判所が法律上の理由又は特別の事情により裁判権を行うことができないとき。
the competent court is unable to exercise its jurisdiction owing to legal reasons or special circumstances;
地方の民心、訴訟の状況その他の事情により裁判の公平を維持することができない虞があるとき。
there is a concern that the impartiality of the trial cannot be maintained owing to the general sentiment of the local people in the district, the state of the proceedings, or due to any other circumstances.
前項各号の場合には、被告人も管轄移転の請求をすることができる。
In the cases prescribed in each of the items of the preceding paragraph, the defendant may also request a change of jurisdiction.
犯罪の性質、地方の民心その他の事情により管轄裁判所が審判をするときは公安を害する虞があると認める場合には、検事総長は、最高裁判所に管轄移転の請求をしなければならない。
If, owing to the nature of the crime, the general sentiment of the local people in the district, or due to any other circumstances, there is a concern that public safety will be disrupted if the case were to be tried by the court which has jurisdiction over it, the Prosecutor-General must request the Supreme Court to effect a change of jurisdiction.
裁判所は、適当と認めるときは、検察官若しくは被告人の請求により又は職権で、決定を以て、その管轄に属する事件を事物管轄を同じくする他の管轄裁判所に移送することができる。
When a court deems it appropriate, the court may rule to, either upon the request of a public prosecutor or the defendant, or ex officio, transfer a case under its jurisdiction to another competent court which has the same subject-matter jurisdiction.
移送の決定は、被告事件につき証拠調を開始した後は、これをすることができない。
The ruling of a transfer may not be made once examination of the evidence for the case has commenced.
移送の決定又は移送の請求を却下する決定に対しては、その決定により著しく利益を害される場合に限り、その事由を疎明して、即時抗告をすることができる。
Only when a ruling in favor of a transfer or a ruling dismissing a request for a transfer seriously impairs the interests of a party may an immediate appeal against such ruling be filed by a prima facie showing of such grounds.
