Supplementary Provisions, Article 17Payment of Withdrawal Allowances by Special Provisions
To a person who lost status as a class 2 insured person within 13 years counted from the day of the promulgation of this Act, except where, at the time of losing that status, the person acquires the right to receive a withdrawal allowance under Article 9, paragraph (2) of the Supplementary Provisions of the Act Partially Amending Related Acts to Establish an Aggregated Pension System (Act No. 182 of 1961; hereinafter referred to in this Article as the "Related Laws Arrangement Act"), a withdrawal allowance is paid in accordance with the provisions of the Employees' Pension Insurance Act prior to the amendment by the Related Laws Arrangement Act; provided, however, that this does not apply if, in a case where the withdrawal allowance is to be paid, the person who is to receive it has, at that time, the right to receive an aggregated old-age pension, or acquires the right to receive an aggregated old-age pension.
The same as in the preceding paragraph applies to a person who acquired status as a class 2 insured person during the period from November 1, 1961 to the day before the day of the promulgation of this Act (excluding a person born on or before April 1, 1911), who is not an insured at the time of the promulgation of this Act and whose insured period is two years or more.
The right to receive benefits from a withdrawal allowance under the provisions of the preceding two paragraphs ceases to exist when its beneficiary acquires the right to receive benefits from an aggregated old-age pension after the day of acquisition of that right.
If a beneficiary of a withdrawal allowance under the provisions of paragraph (1) or paragraph (2) dies, the provisions of Article 37 of the Employees' Pension Insurance Act apply mutatis mutandis, notwithstanding the provisions of the Employees' Pension Insurance Act prior to the amendment by the Related Laws Arrangement Act, which are to be followed pursuant to those provisions.
