Supplementary Provisions, Article 10Special Provisions on Amount of Insurance Benefits under the Former Act
第十条（旧法による保険給付の額の特例）
Among persons who, on May 1, 1965, actually have the right to receive insurance benefits that follow the example of the previous disability pension paid pursuant to the provisions of Article 16, paragraph (1) of the Supplementary Provisions of the Employees' Pension Insurance Act, for the disability pension of a person who is in a state of disablement of grade 1 specified in Appended Table 1 of that Act, the amount (excluding the amount of benefits equivalent to the previous additional allowance) is 84,000 yen, and for the disability pension of any other person, the amount (excluding the amount of benefits equivalent to the previous additional allowance) is 67,200 yen.
昭和四十年五月一日において現に厚生年金保険法附則第十六条第一項の規定によつて支給する従前の障害年金の例による保険給付を受ける権利を有する者のうち、同法別表第一に定める一級の廃疾の状態にある者の当該障害年金については、その額（従前の加給金に相当する給付の額を除く。）を八万四千円とし、その他の者の当該障害年金については、その額（従前の加給金に相当する給付の額を除く。）を六万七千二百円とする。
The Director-General of the Social Insurance Agency may examine the degree of disablement of a person who has the right to receive the disability pension prescribed in the preceding paragraph and, if the Director-General finds that the degree of disablement of a person whose pension amount (excluding the amount of benefits equivalent to the previous additional allowance; the same applies hereinafter in this paragraph and the following paragraph) is 84,000 yen does not fall under grade 1 specified in Appended Table 1 of the Employees' Pension Insurance Act, or finds that the degree of disablement of a person whose pension amount is 67,200 yen falls under grade 1 specified in Appended Table 1 of that Act, revise the amount of that person's pension to 67,200 yen or 84,000 yen, respectively.
A person whose pension amount is 67,200 yen may request the Director-General of the Social Insurance Agency to revise the amount of that disability pension on the grounds that the degree of disablement has come to fall under grade 1 specified in Appended Table 1 of the Employees' Pension Insurance Act.
年金の額が六万七千二百円である者は、社会保険庁長官に対し、廃疾の程度が厚生年金保険法別表第一に定める一級に該当するに至つたことによる当該障害年金の額の改定を請求することができる。
The provisions of Article 52, paragraphs (3) and (4) of the Employees' Pension Insurance Act apply mutatis mutandis to the request under the preceding paragraph or the revision of the pension amount pursuant to the provisions of paragraph (1).
