第十一条の四
Payment of an employees' old-age pension for persons with disabilities or long-term insureds or an employees' old-age pension for mine workers and mariners is suspended, for the portion equivalent to the amount prescribed in Article 9-2, paragraph (2), item (i) of the Supplementary Provisions pertaining to that employees' old-age pension, in a month in which the beneficiary is able to receive an old-age basic pension under the National Pension Act (excluding the month in which the person acquired the right to receive that old-age basic pension and the month that includes a day on which the person is an insured, etc.).
障害者・長期加入者の老齢厚生年金又は坑内員・船員の老齢厚生年金は、その受給権者が国民年金法による老齢基礎年金の支給を受けることができる月（その者が当該老齢基礎年金の受給権を取得した月及びその者が被保険者等である日が属する月を除く。）においては、当該老齢厚生年金に係る附則第九条の二第二項第一号に規定する額に相当する部分の支給を停止する。
In the month that includes a day on which a beneficiary of an employees' old-age pension for mine workers and mariners who is able to receive an old-age basic pension under the National Pension Act is the day on which the person is an insured, etc. (excluding the month in which the person acquired the right to receive that old-age basic pension), notwithstanding the provisions of the preceding Article, payment of that employees' old-age pension for that month is to be suspended for the portion equivalent to the total of the amount of the portion for which payment would be suspended if the provisions of the preceding Article were applied to and the calculation made for the amount prescribed in Article 9-2, paragraph (2), item (ii) of the Supplementary Provisions pertaining to that employees' old-age pension (if the additional amount of pension prescribed in Article 44, paragraph (1) as applied mutatis mutandis pursuant to Article 9-4, paragraph (3) or (5) of the Supplementary Provisions (including the case where the example of Article 9-4, paragraph (6) of the Supplementary Provisions is followed) is added to that employees' old-age pension, including that additional amount of pension; hereinafter in this paragraph referred to as the "amount of the remuneration-based portion, etc.") and the amount prescribed in Article 9-2, paragraph (2), item (i) of the Supplementary Provisions pertaining to that employees' old-age pension (or, if payment is suspended for the whole of the amount of the remuneration-based portion, etc. when the calculation is made by applying the provisions of the preceding Article to the amount of the remuneration-based portion, etc., the whole of that employees' old-age pension).
坑内員・船員の老齢厚生年金の受給権者であつて国民年金法による老齢基礎年金の支給を受けることができるものが被保険者等である日が属する月（その者が当該老齢基礎年金の受給権を取得した月を除く。）においては、前条の規定にかかわらず、その月の分の当該老齢厚生年金について、当該老齢厚生年金に係る附則第九条の二第二項第二号に規定する額（当該老齢厚生年金について、附則第九条の四第三項又は第五項（同条第六項においてその例による場合を含む。）において準用する第四十四条第一項に規定する加給年金額が加算されているときは、当該加給年金額を含む。以下この項において「報酬比例部分等の額」という。）につき前条の規定を適用して計算した場合におけるその支給が停止される部分の額と当該老齢厚生年金に係る附則第九条の二第二項第一号に規定する額との合計額に相当する部分（報酬比例部分等の額につき前条の規定を適用して計算した場合において、報酬比例部分等の額の全額につき支給が停止されるときは、当該老齢厚生年金の全部）の支給を停止するものとする。
The handling of fractions of less than one yen that arise in calculating the amount prescribed in Article 9-2, paragraph (2), item (i) of the Supplementary Provisions referred to in paragraph (1), and the amount prescribed in Article 9-2, paragraph (2), item (ii) of the Supplementary Provisions and the amount prescribed in item (i) of that paragraph referred to in the preceding paragraph, is specified by Cabinet Order.
第一項に規定する附則第九条の二第二項第一号に規定する額並びに前項に規定する同条第二項第二号に規定する額及び同項第一号に規定する額を計算する場合において生じる一円未満の端数の処理については、政令で定める。
