Supplementary Provisions, Article 43Measures concerning Members, etc. of a Dissolved Fund
第四十三条（解散基金加入員等に係る措置）
A member of a dissolved Fund may apply to the liquidator of the dissolved surviving employees' pension Fund for the transfer to the surviving Pension Fund Association of the residual assets to be distributed to members of a dissolved Fund pursuant to the provisions of Article 34, paragraph (4) of the Supplementary Provisions (hereinafter in this Article referred to as "residual assets").
解散基金加入員は、解散した存続厚生年金基金の清算人に附則第三十四条第四項の規定により解散基金加入員に分配すべき残余財産（以下この条において「残余財産」という。）の存続連合会への移換を申し出ることができる。
Upon receiving an application under the preceding paragraph, the surviving employees' pension Fund concerned is to transfer the residual assets pertaining to that application to the surviving Pension Fund Association.
When the surviving Pension Fund Association has received the transfer of residual assets pursuant to the preceding paragraph, it is to pay a surviving Pension Fund Association old-age benefit or surviving Pension Fund Association survivor benefit to the member of a dissolved Fund concerned or that person's surviving family, using the transferred Funds as the source of Funds, as provided by Cabinet Order.
When the surviving Pension Fund Association has received the transfer of residual assets pursuant to the provisions of paragraph (2), for the purpose of applying the provisions of Article 34, paragraph (4) of the Supplementary Provisions, those residual assets are deemed to have been distributed to the member of a dissolved Fund concerned.
存続連合会が第二項の規定により残余財産の移換を受けたときは、附則第三十四条第四項の規定の適用については、当該残余財産は、当該解散基金加入員に分配されたものとみなす。
When the surviving Pension Fund Association has come to pay a surviving Pension Fund Association old-age benefit or surviving Pension Fund Association survivor benefit pursuant to the provisions of paragraph (3), it must notify the member of a dissolved Fund concerned or that person's surviving family to that effect.
The provisions of paragraph (6) of the preceding Article apply mutatis mutandis to the notice under the provisions of the preceding paragraph.
