第四十四条
Where the surviving Pension Fund Association is conducting the business set forth in Article 40, paragraph (2), item (i) of the Supplementary Provisions, members, etc. of a dissolved Fund (limited to persons who, on the day that the surviving employees' pension Fund was dissolved, held the right to receive pension benefits for which disability is the ground for payment, paid under Article 130, paragraph (3) of the pre-amendment Employees' Pension Insurance Act, which remains in force pursuant to the provisions of Article 5, paragraph (1) of the Supplementary Provisions; the same applies hereinafter in this Article) may apply to the liquidator of that surviving employees' pension Fund for the transfer to the surviving Pension Fund Association of the residual assets to be distributed to members, etc. of a dissolved Fund pursuant to the provisions of Article 34, paragraph (4) of the Supplementary Provisions (hereinafter in this Article referred to as "residual assets").
存続連合会が附則第四十条第二項第一号に掲げる業務を行っている場合にあっては、解散基金加入員等（当該存続厚生年金基金が解散した日において附則第五条第一項の規定によりなおその効力を有するものとされた改正前厚生年金保険法第百三十条第三項の規定により支給する障害を支給理由とする年金たる給付の受給権を有していた者に限る。以下この条において同じ。）は、当該存続厚生年金基金の清算人に附則第三十四条第四項の規定により解散基金加入員等に分配すべき残余財産（以下この条において「残余財産」という。）の存続連合会への移換を申し出ることができる。
Upon receiving an application under the preceding paragraph, the surviving employees' pension Fund concerned is to transfer the residual assets pertaining to that application to the surviving Pension Fund Association.
When the surviving Pension Fund Association has received the transfer of residual assets pursuant to the preceding paragraph, it is to pay a surviving Pension Fund Association disability benefit or surviving Pension Fund Association survivor benefit to the member, etc. of a dissolved Fund concerned or that person's surviving family, using the transferred Funds as the source of Funds, as provided by Cabinet Order.
The provisions of paragraphs (4) and (5) of the preceding Article apply mutatis mutandis to the cases under the preceding three paragraphs. In this case, in paragraph (4) of that Article, the phrase "paragraph (2)" is deemed to be replaced with "paragraph (2) of the following Article"; in paragraph (5) of that Article, the phrase "paragraph (3)" is deemed to be replaced with "paragraph (3) of the following Article", and the phrase "surviving Pension Fund Association old-age benefit" with "surviving Pension Fund Association disability benefit".
The provisions of Article 42, paragraph (6) of the Supplementary Provisions apply mutatis mutandis to the notice under the provisions of paragraph (5) of the preceding Article, as applied mutatis mutandis with the terms replaced in the preceding paragraph.
附則第四十二条第六項の規定は、前項において読み替えて準用する前条第五項の規定による通知について準用する。
