The provisions of Article 9-2, paragraph (5) of the Supplementary Provisions of the Employees' Pension Insurance Act as amended by the provisions of Article 3 apply in the case where a beneficiary of the employees' old-age pension prescribed in paragraph (1) of that Article (hereinafter in this Article referred to as the "beneficiary of the employees' old-age pension") or a person who was a beneficiary of the employees' old-age pension falls under any of the items of Article 9-2, paragraph (5) of the Supplementary Provisions of the Employees' Pension Insurance Act as amended by the provisions of Article 3 on or after the item (iv) Effective Date; provided, however, that with regard to a person who was a beneficiary of the employees' old-age pension on the item (iv) Effective Date, who is not an insured, and who is able to receive the employees' disability pension, etc. prescribed in item (i) of that paragraph, the provisions of that paragraph apply by deeming that the person fell under any of the items of that paragraph on the item (iv) Effective Date. In this case, the phrase "the day prescribed in the relevant item" in that paragraph is deemed to be replaced with "the day on which the provisions set forth in Article 1, item (iv) of the Supplementary Provisions of the Act Partially Amending the National Pension Act, etc. to Strengthen, etc. the Financial Basis and Minimum Guarantee Function of the Public Pension System (Act No. 62 of 2012) come into effect".
