Supplementary Provisions, Article 44Transitional Measures Concerning Payment of Employees' Pensions for Surviving Family
第四十四条（遺族厚生年金の支給に関する経過措置）
The provisions then in force continue to govern the calculation of the amount of, and the suspension of payment of, an employees' pension for surviving family for which the grounds for payment arose before April 1, 2007 (limited to one whose beneficiary was born on or before April 1, 1942).
平成十九年四月一日前において支給事由の生じた遺族厚生年金（その受給権者が昭和十七年四月一日以前に生まれたものに限る。）の額の計算及び支給の停止については、なお従前の例による。
In the case where a person who, before April 1, 2007, has the right to receive pension insurance benefits paid pursuant to Article 78, paragraph (1) of the Supplementary Provisions of the 1985 Amendment Act (limited to those for which old age is the grounds for payment) or other benefits specified by Cabinet Order as equivalent thereto acquires, on or after April 1, 2007, the right to receive benefits from an employees' pension for surviving family, the provisions then in force continue to govern the calculation of the amount of, and the suspension of payment of, that employees' pension for surviving family.
平成十九年四月一日前において昭和六十年改正法附則第七十八条第一項の規定により支給される年金たる保険給付（老齢を支給事由とするものに限る。）その他これに相当するものとして政令で定めるものの受給権を有する者が平成十九年四月一日以後に遺族厚生年金の受給権を取得した場合にあっては、当該遺族厚生年金の額の計算及び支給の停止については、なお従前の例による。
With regard to the application of Article 62, paragraph (1) of the Employees' Pension Insurance Act as amended by Article 12 to a person who acquired the right to receive benefits from an employees' pension for surviving family before April 1, 2007, the phrase "at least 40 but below 65 years of age" in that paragraph is replaced with "at least 35 but below 65 years of age", the phrase "the age of 40" with "the age of 35", and the phrase "is under 65 years of age" with "is at least 40 but under 65 years of age".
平成十九年四月一日前に遺族厚生年金の受給権を取得した者に対する第十二条の規定による改正後の厚生年金保険法第六十二条第一項の規定の適用については、同項中「四十歳」とあるのは「三十五歳」と、「六十五歳未満であるとき」とあるのは「四十歳以上六十五歳未満であるとき」とする。
The provisions of Article 63, paragraph (1), item (v) of the Employees' Pension Insurance Act as amended by Article 12 apply to employees' pensions for surviving family for which the grounds for payment arose on or after April 1, 2007.
第十二条の規定による改正後の厚生年金保険法第六十三条第一項第五号の規定は、平成十九年四月一日以後に支給事由の生じた遺族厚生年金について適用する。
