金融商品取引法及び資金決済に関する法律の一部を改正する法律（令和八年法律第六十四号）による改正後の条文です。変わる言葉に印をつけています。

暗号資産管理関係業務を行う者は、あらかじめ、内閣府令で定めるところにより、次に掲げる事項を内閣総理大臣に届け出なければならない。
A person that conducts cryptoasset management-related services must notify the Prime Minister of the following particulars in advance, pursuant to the provisions of Cabinet Office Order:
商号、名称又は氏名
its trade name, name, or personal name;
財産的基礎に係る事項として内閣府令で定めるもの
particulars specified by Cabinet Office Order as particulars relating to its financial basis;
法人であるときは、役員の氏名又は名称
if it is a corporation, the personal names or names of its officers;
主たる営業所又は事務所（外国法人又は外国に住所を有する個人にあつては、主たる営業所又は事務所及び国内における主たる営業所又は事務所）の名称及び所在地
the name and location of its principal business office or office (in the case of a foreign corporation or an individual who has an address in a foreign country, its principal business office or office and its principal business office or office in Japan);
暗号資産管理関係業務を行う営業所又は事務所の名称及び所在地
the name and location of the business office or office at which it conducts cryptoasset management-related services;
他に事業を行つているときは、その事業の種類
if the person engages in other business, the type of that business; and
その他内閣府令で定める事項
other particulars specified by Cabinet Office Order.
前項の規定による届出には、次に掲げる書類を添付しなければならない。
The following documents must accompany the notification under the preceding paragraph:
第五項各号のいずれにも該当しないことを誓約する書面
a written pledge that the person does not fall under any of the items of paragraph (5);
暗号資産管理関係業務の業務の内容及び方法として内閣府令で定めるものを記載した書類
a document stating the particulars specified by Cabinet Office Order as the content and methods of the business of cryptoasset management-related services;
法人である場合においては、定款及び法人の登記事項証明書（これらに準ずるものを含む。）
if the person is a corporation, its articles of incorporation and a certificate of registered information of the corporation (including documents equivalent to them);
その他内閣府令で定める書類
other documents specified by Cabinet Office Order.
前項第三号に掲げる書類を添付する場合において、定款が電磁的記録で作成されているときは、書類に代えて電磁的記録（内閣府令で定めるものに限る。）を添付することができる。
When the document set forth in item (iii) of the preceding paragraph is attached, if the articles of incorporation are made in the form of an electronic or magnetic record, an electronic or magnetic record (limited to one specified by Cabinet Office Order) may be attached in lieu of the document.
内閣総理大臣は、暗号資産管理関係業務提供者に係る第一項各号に掲げる事項のうち内閣府令で定める事項を公衆の縦覧に供しなければならない。
The Prime Minister must make those of the particulars set forth in the items of paragraph (1) that pertain to a cryptoasset management-related service provider and are specified by Cabinet Office Order available to the public.
次の各号のいずれかに該当する者は、暗号資産管理関係業務を行つてはならない。
A person falling under any of the following items must not conduct cryptoasset management-related services:
第二十九条の四第一項第一号イからハまでのいずれかに該当する者
a person falling under any of Article 29-4, paragraph (1), item (i), (a) through (c);
国内に営業所又は事務所を有しない者
a person that does not have a business office or office in Japan;
法人である場合においては、次のいずれかに該当する者
in the case of a corporation, a person falling under any of the following:
役員のうちに次のいずれかに該当する者のある者
a person that has, among its officers, a person falling under any of the following:
心身の故障により暗号資産管理関係業務に係る業務を適正に行うことができない者として内閣府令で定める者
a person specified by Cabinet Office Order as being unable to properly perform business related to cryptoasset management-related services due to a mental or physical disorder;
第二十九条の四第一項第二号ロからリまでのいずれかに該当する者
a person falling under any of Article 29-4, paragraph (1), item (ii), (b) through (i);
第二十九条の四第一項第八号イからハまでのいずれかに該当する者
a person falling under any of Article 29-4, paragraph (1), item (viii), (a) through (c);
外国法人であつて国内における代表者又は国内における代理人を定めていない者
a foreign corporation that has not designated a domestic representative or a domestic agent;
役員又は政令で定める使用人のうちに暴力団員による不当な行為の防止等に関する法律第二条第六号に規定する暴力団員又は同号に規定する暴力団員でなくなつた日から五年を経過しない者（次号ニにおいて「暴力団員等」という。）のある者
a person that has, among its officers or employees specified by Cabinet Order, a member of an organized crime group prescribed in Article 2, item (vi) of the Act on Prevention of Unjust Acts by Organized Crime Group Members or a person for whom five years have not elapsed since the day on which the person ceased to be a member of an organized crime group prescribed in that item (referred to as a "member of an organized crime group, etc." in item (iv), (d));
個人である場合においては、次のいずれかに該当する者
in the case of an individual, a person falling under any of the following:
第二十九条の四第一項第二号ロからチまで若しくはリ（同項第一号ハに規定する法律の規定に係る部分を除く。）又は前号イ（１）のいずれかに該当する者
a person falling under any of Article 29-4, paragraph (1), item (ii), (b) through (h) or (i) (excluding the part pertaining to the provisions of laws prescribed in item (i), (c) of that paragraph) or (a) 1. of the preceding item;
第二十九条の四第一項第八号ハ（１）から（３）までのいずれかに該当する者
a person falling under any of Article 29-4, paragraph (1), item (viii), (c) 1. through 3.;
外国に住所を有する個人であつて国内における代理人を定めていない者
an individual who has an address in a foreign country and has not designated a domestic agent;
暴力団員等又は政令で定める使用人のうちに暴力団員等のある者
a member of an organized crime group, etc., or a person that has a member of an organized crime group, etc. among its employees specified by Cabinet Order.
暗号資産管理関係業務提供者は、第一項各号に掲げる事項に変更があつたときは、その日から二週間以内に、その旨を内閣総理大臣に届け出なければならない。
If any particular set forth in the items of paragraph (1) changes, a cryptoasset management-related service provider must notify the Prime Minister of this within two weeks from that day.
暗号資産管理関係業務提供者は、第二項第二号に掲げる書類に記載した業務の内容又は方法について変更があつたときは、内閣府令で定めるところにより、遅滞なく、その旨を内閣総理大臣に届け出なければならない。
If the business outline or business methods that a cryptoasset management-related service provider has stated in a document set forth in paragraph (2), item (ii) change, the cryptoasset management-related service provider must notify the Prime Minister of this without delay, pursuant to the provisions of Cabinet Office Order.
暗号資産管理関係業務提供者並びにその役員及び使用人は、暗号資産管理関係業務の提供を受ける金融商品取引業者のため誠実かつ公正にその業務を遂行しなければならない。
A cryptoasset management-related service provider and its officers and employees must perform its business sincerely and fairly for the financial instruments business operator that receives provision of cryptoasset management-related services.
暗号資産管理関係業務提供者は、暗号資産管理関係業務の提供を受ける金融商品取引業者に対し、善良な管理者の注意をもつてその業務を遂行しなければならない。
A cryptoasset management-related service provider must perform its business for a financial instruments business operator that receives provision of cryptoasset management-related services with the due care of a prudent manager.
暗号資産管理関係業務提供者は、その行う暗号資産管理関係業務を適確に遂行するため、内閣府令で定めるところにより、業務管理体制を整備しなければならない。
A cryptoasset management-related service provider must, pursuant to the provisions of Cabinet Office Order, establish an operational control system in order to properly perform the cryptoasset management-related services that it conducts.
前項に定めるもののほか、暗号資産管理関係業務提供者は、内閣府令で定めるところにより、その行う暗号資産管理関係業務に係る情報の漏えい、滅失又は毀損の防止その他の当該情報の安全管理のために必要な措置を講じなければならない。
In addition to what is provided for in the preceding paragraph, a cryptoasset management-related service provider must, pursuant to the provisions of Cabinet Office Order, take the measures necessary for preventing the leak, loss, or damage of information pertaining to the cryptoasset management-related services that it conducts, and for other secure management of that information.
暗号資産管理関係業務提供者は、自己の名義をもつて、他人に暗号資産管理関係業務を行わせてはならない。
A cryptoasset management-related service provider must not allow another person to conduct cryptoasset management-related services using its name.
暗号資産管理関係業務提供者は、内閣府令で定めるところにより、暗号資産管理関係業務に関する記録を作成し、これを保存しなければならない。
A cryptoasset management-related service provider must, pursuant to the provisions of Cabinet Office Order, prepare records pertaining to cryptoasset management-related services and archive them.
暗号資産管理関係業務提供者は、事業年度ごとに、内閣府令で定めるところにより、事業報告書を作成し、毎事業年度経過後三月以内に、これを内閣総理大臣に提出しなければならない。
Each business year, pursuant to the provisions of Cabinet Office Order, a cryptoasset management-related service provider must prepare a business report and submit it to the Prime Minister within three months after the end of the business year.
