第七十六条（厚生年金保険の保険給付の制限の特例）
The provisions of Article 75 of the new Employees' Pension Insurance Act apply mutatis mutandis to insurance benefits under the new Employees' Pension Insurance Act based on a period during which a person was a class 3 insured person in the case where insurance premiums were collected for a class 3 insured person as a class 1 insured person, or based on a period during which a class 3 insured person prescribed in Article 3, paragraph (1), item (v) of the former Employees' Pension Insurance Act was that class 3 insured person in the case where insurance premiums were collected for that class 3 insured person as a class 1 insured person prescribed in item (i) of that paragraph. In this case, the phrase "acquisition of the status of an insured" in the proviso to Article 75 of that Act is deemed to be replaced with "change of insured category prescribed in Article 46 of the Supplementary Provisions of the Act Partially Amending the National Pension Act, etc. (Act No. 34 of 1985)".
新厚生年金保険法第七十五条の規定は、第三種被保険者について第一種被保険者としての保険料の徴収が行われた場合における第三種被保険者であつた期間又は旧厚生年金保険法第三条第一項第五号に規定する第三種被保険者について同項第一号に規定する第一種被保険者としての保険料の徴収が行われた場合における当該第三種被保険者であつた期間に基づく新厚生年金保険法による保険給付について準用する。この場合において、同法第七十五条ただし書中「被保険者の資格の取得」とあるのは、「国民年金法等の一部を改正する法律（昭和六十年法律第三十四号）附則第四十六条に規定する被保険者の種別の変更」と読み替えるものとする。
