第六十条（従前の障害年金の例による保険給付の特例等）
Among persons who, on June 1, 1980, actually have the right to receive insurance benefits that follow the example of the previous disability pension paid pursuant to the provisions of Article 16, paragraph (1) of the Supplementary Provisions of the Employees' Pension Insurance Act, for a person who, on that day, is in a state of disability of a degree of severity specified in Appended Table 1 of that Act, a disability pension under Article 47, paragraph (1) of that Act is paid, deeming that person to fall under that paragraph.
昭和五十五年六月一日において現に厚生年金保険法附則第十六条第一項の規定によつて支給する従前の障害年金の例による保険給付を受ける権利を有する者のうち、同日において同法別表第一に定める程度の障害の状態にある者については、同法第四十七条第一項に該当するものとみなして、同項の障害年金を支給する。
Among persons who, on June 1, 1980, actually have the right to receive insurance benefits that follow the example of the previous disability pension paid pursuant to the provisions of Article 16, paragraph (1) of the Supplementary Provisions of the Employees' Pension Insurance Act, for a person who, on that day, is not in a state of disability of a degree of severity specified in Appended Table 1 of that Act, when, after that day, the person has come to fall under a state of disability of a degree of severity specified in that Appended Table (limited to the period up to the day on which three years elapse, counting from the day, on or before that day, on which the person ceased to fall under a state of disability of a degree of severity specified in Appended Table 1 of the former Employees' Pension Insurance Act), a disability pension under Article 47, paragraph (1) of the Employees' Pension Insurance Act is paid, deeming the person to fall under that paragraph.
昭和五十五年六月一日において現に厚生年金保険法附則第十六条第一項の規定によつて支給する従前の障害年金の例による保険給付を受ける権利を有する者のうち、同日において同法別表第一に定める程度の障害の状態にない者については、同日後、同表に定める程度の障害の状態に該当するに至つたとき（同日以前の旧厚生年金保険法別表第一に定める程度の障害の状態に該当しなくなつた日から起算して三年を経過する日までの間に限る。）は、厚生年金保険法第四十七条第一項に該当するものとみなして、同項の障害年金を支給する。
When a person who has the right to receive insurance benefits that follow the example of the previous disability pension paid pursuant to the provisions of Article 16, paragraph (1) of the Supplementary Provisions of the Employees' Pension Insurance Act has acquired, pursuant to the provisions of the preceding two paragraphs, the right to receive a disability pension under Article 47, paragraph (1) of that Act, the right to receive the insurance benefits that follow the example of that previous disability pension is extinguished.
厚生年金保険法附則第十六条第一項の規定によつて支給する従前の障害年金の例による保険給付を受ける権利を有する者が、前二項の規定により同法第四十七条第一項の障害年金の受給権を取得したときは、当該従前の障害年金の例による保険給付を受ける権利は消滅する。
