①A person who engages in business by using the name of a company prior to the formation of relevant company is punished by a civil fine of an amount equivalent to the registration and license tax for the incorporation of the company.

②The provisions of the preceding paragraph also apply to a person who carries out a transaction in violation of the provisions of Article 818, paragraph (1) or Article 821, paragraph (1).
