Supplementary Provisions, Article 3
第三条
When a person who receives payment of two or more pension insurance benefits prescribed in Article 11, paragraph (1) of the Supplementary Provisions of the Act Partially Amending the Employees' Pension Insurance Act and the Mariners Insurance Act (Act No. 78 of 1969), pursuant to the provisions of that paragraph, comes to have the right to receive another pension insurance benefit (excluding a pension insurance benefit whose payment is suspended in its entirety), the two or more pension insurance benefits are paid to that person, and payment of the other pension insurance benefit is suspended, at that person's choice and notwithstanding the provisions of Article 38 of the Employees' Pension Insurance Act as amended by this Act.
厚生年金保険法及び船員保険法の一部を改正する法律（昭和四十四年法律第七十八号）附則第十一条第一項の規定により同項に規定する二以上の年金たる保険給付の支給を受ける者が他の年金たる保険給付（その全額につき支給を停止されている年金たる保険給付を除く。）の受給権を有するに至つたときは、その者の選択により、この法律による改正後の厚生年金保険法第三十八条の規定にかかわらず、その者に、当該二以上の年金たる保険給付を支給し、当該他の年金たる保険給付の支給を停止する。
