第二条（第一条の規定の施行に伴う経過措置）
If the grounds for paying a lump-sum compensation payment for surviving family or a lump-sum payment for surviving family in the case referred to in Article 16-6, item (ii) of the Industrial Accident Compensation Insurance Act (hereinafter referred to as the "Industrial Accident Insurance Act") (including as applied mutatis mutandis pursuant to Article 22-4, paragraph (3) of the Industrial Accident Insurance Act with the replacement of terms; the same applies hereinafter in this paragraph) (hereinafter referred to as a "lump sum compensation payment for surviving family, etc." in this paragraph) arose during the period from August 1, 1980 to the day before the date on which this Act comes into effect (hereinafter referred to as the "effective date"), the amount of the insurance proceeds set forth in each of the following items is, notwithstanding the provisions of the new Industrial Accident Insurance Act, the amount specified in each of those items:
昭和五十五年八月一日からこの法律の施行の日（以下「施行日」という。）の前日までの間に労働者災害補償保険法（以下「労災保険法」という。）第十六条の六第二号（労災保険法第二十二条の四第三項において読み替えて準用する場合を含む。以下この項において同じ。）の場合の遺族補償一時金又は遺族一時金（以下この項において「遺族補償一時金等」という。）を支給すべき事由が生じた場合における次の各号に掲げる保険給付の額は、新労災保険法の規定にかかわらず、当該各号に定める額とする。
the amount of that lump sum compensation payment for surviving family, etc.: the amount under the provisions of the Industrial Accident Compensation Insurance Act prior to the amendment by the provisions of Article 1 (hereinafter referred to as the "former Industrial Accident Insurance Act") (or, if that amount is less than the amount under the provisions of the new Industrial Accident Insurance Act, the amount under the provisions of the new Industrial Accident Insurance Act);
the amount of the compensation pension for surviving family, etc. for the months from August 1980 to the month to which the day on which the grounds for paying that lump sum compensation payment for surviving family, etc. arose belongs, to be paid to a person who has the right to receive the compensation pension for surviving family or pension for surviving family that had been paid in connection with the death for which that lump sum compensation payment for surviving family, etc. is paid (hereinafter referred to as the "compensation pension for surviving family, etc." in this item): the amount under the provisions of the former Industrial Accident Insurance Act (or, if the amount obtained by deducting the amount of the compensation pension for surviving family, etc. for those months under the provisions of the former Industrial Accident Insurance Act from the amount of the compensation pension for surviving family, etc. for those months under the provisions of the new Industrial Accident Insurance Act (or, if a lump-sum payment in the case referred to in Article 16-6, item (ii) of the new Industrial Accident Insurance Act would be paid were the provisions of the new Industrial Accident Insurance Act applied to the grounds for paying that lump sum compensation payment for surviving family, etc., the amount obtained by adding the amount of the lump-sum payment that would be paid) exceeds the amount of that lump sum compensation payment for surviving family, etc., the amount obtained by adding that excess amount).
当該遺族補償一時金等の支給に係る死亡に関して支給されていた遺族補償年金又は遺族年金（以下この号において「遺族補償年金等」という。）を受ける権利を有する者に対して支給すべき昭和五十五年八月から当該遺族補償一時金等を支給すべき事由の生じた日の属する月までの分の遺族補償年金等の額 旧労災保険法の規定による額（これらの月分の新労災保険法の規定による遺族補償年金等の額からこれらの月分の旧労災保険法の規定による遺族補償年金等の額を減じた額（当該遺族補償一時金等を支給すべき事由につき新労災保険法の規定を適用することとした場合に新労災保険法第十六条の六第二号の場合の一時金を支給することとなるときは、当該支給することとなる一時金の額を加えた額）が当該遺族補償一時金等の額を超えるときは、当該超える額を加算した額）
The provisions then in force continue to govern the amount of compensation pensions for surviving family and pensions for surviving family for the period before November 1, 1980, except in the case prescribed in item (ii) of the preceding paragraph.
昭和五十五年十一月一日前の期間に係る遺族補償年金及び遺族年金の額は、前項第二号に規定する場合のほか、なお従前の例による。
The provisions then in force continue to govern the treatment of fractions in the amount of insurance proceeds paid as a pension under the provisions of the Industrial Accident Insurance Act for the period before the date specified in paragraph (1), item (ii) of the preceding Article, and claims for the return of monies prescribed in Article 12-2 of the new Industrial Accident Insurance Act that arose before that date.
With regard to the application of the provisions of Article 65 of the new Industrial Accident Insurance Act to the lump-sum payments referred to in Article 42, paragraph (1) of the Supplementary Provisions of the Act Partially Amending the Industrial Accident Compensation Insurance Act (Act No. 130 of 1965) prior to the amendment by the provisions of Article 10 of the Supplementary Provisions (hereinafter referred to as the "former 1965 Industrial Accident Insurance Amendment Act"), for which the grounds for payment arose from August 1, 1980 to the day before the effective date, the phrase "advance lump-sum payment of compensation pension for surviving family" in that Article is deemed to be replaced with "lump-sum payment referred to in Article 42, paragraph (1) of the Supplementary Provisions of the Act Partially Amending the Industrial Accident Compensation Insurance Act (Act No. 130 of 1965) prior to the amendment by the provisions of Article 10 of the Supplementary Provisions of the Act Partially Amending the Industrial Accident Compensation Insurance Act, etc. (Act No. 104 of 1980)", and the phrase "advance lump-sum payment of pension for surviving family" with "lump-sum payment referred to in Article 4, paragraph (1) of the Supplementary Provisions of the Act Partially Amending the Industrial Accident Compensation Insurance Act (Act No. 85 of 1973) prior to the amendment by the provisions of Article 11 of the Supplementary Provisions of the Act Partially Amending the Industrial Accident Compensation Insurance Act, etc.".
昭和五十五年八月一日から施行日の前日までに支給すべき事由の生じた附則第十条の規定による改正前の労働者災害補償保険法の一部を改正する法律（昭和四十年法律第百三十号。以下「旧昭和四十年改正法」という。）附則第四十二条第一項の一時金に関する新労災保険法第六十五条の規定の適用については、同条中「遺族補償年金前払一時金」とあるのは「労働者災害補償保険法等の一部を改正する法律（昭和五十五年法律第百四号）附則第十条の規定による改正前の労働者災害補償保険法の一部を改正する法律（昭和四十年法律第百三十号）附則第四十二条第一項の一時金」と、「遺族年金前払一時金」とあるのは「労働者災害補償保険法等の一部を改正する法律附則第十一条の規定による改正前の労働者災害補償保険法の一部を改正する法律（昭和四十八年法律第八十五号）附則第四条第一項の一時金」とする。
Payments of disability compensation pensions, compensation pensions for surviving family, illness or injury compensation pensions, disability pensions, pensions for surviving family or illness or injury pensions made under the provisions of the former Industrial Accident Insurance Act for the months from August 1980 to the month to which the day before the effective date belongs are deemed to be advance payments of the corresponding insurance proceeds to be paid under the provisions of the new Industrial Accident Insurance Act.
Payments of disability compensation lump-sum payments, disability lump-sum payments, lump-sum compensation payments for surviving family, lump-sum payments for surviving family or the lump-sum payments referred to in Article 42, paragraph (1) of the Supplementary Provisions of the former 1965 Industrial Accident Insurance Amendment Act (including where that provision is to govern pursuant to Article 4, paragraph (1) of the Supplementary Provisions of the Act Partially Amending the Industrial Accident Compensation Insurance Act (Act No. 85 of 1973) prior to the amendment by the provisions of Article 11 of the Supplementary Provisions (hereinafter referred to as the "former 1973 Industrial Accident Insurance Amendment Act"); the same applies hereinafter in this paragraph), for which the grounds for payment arose on or after August 1, 1980 and which were paid under the provisions of the former Industrial Accident Insurance Act or of Article 42, paragraph (1) of the Supplementary Provisions of the former 1965 Industrial Accident Insurance Amendment Act, are deemed to be advance payments of the corresponding insurance proceeds under the provisions of the new Industrial Accident Insurance Act.
The provisions of Articles 58 and 61 of the new Industrial Accident Insurance Act apply where a person who has the right to receive a disability compensation pension or disability pension under the provisions of the Industrial Accident Insurance Act dies on or after November 1, 1981.
新労災保険法第五十八条及び第六十一条の規定は、昭和五十六年十一月一日以後に労災保険法の規定による障害補償年金又は障害年金を受ける権利を有する者が死亡した場合について適用する。
The provisions of Articles 59 and 62 of the new Industrial Accident Insurance Act apply where a worker has been injured or contracted an illness in the course of their duties or due to commuting and, when the injury or illness is healed on or after November 1, 1981, has a physical disability.
新労災保険法第五十九条及び第六十二条の規定は、労働者が業務上の事由又は通勤により負傷し、又は疾病にかかり、昭和五十六年十一月一日以後に治つたとき身体に障害が存する場合について適用する。
The provisions of Article 65 of the new Industrial Accident Insurance Act apply to disability compensation lump-sum payments, lump-sum compensation payments for surviving family and advance lump-sum payments of compensation pension for surviving family (including lump-sum payments paid pursuant to the provisions of Article 42, paragraph (1) of the Supplementary Provisions of the former 1965 Industrial Accident Insurance Amendment Act), and disability lump-sum payments, lump-sum payments for surviving family and advance lump-sum payments of pension for surviving family (including lump-sum payments paid pursuant to the provisions of Article 4, paragraph (1) of the Supplementary Provisions of the former 1973 Industrial Accident Insurance Amendment Act), under the provisions of the new Industrial Accident Insurance Act for which the grounds for payment arose on or after November 1, 1974.
新労災保険法第六十五条の規定は、昭和四十九年十一月一日以後に支給すべき事由が生じた新労災保険法の規定による障害補償一時金、遺族補償一時金及び遺族補償年金前払一時金（旧昭和四十年改正法附則第四十二条第一項の規定により支給された一時金を含む。）並びに障害一時金、遺族一時金及び遺族年金前払一時金（旧昭和四十八年改正法附則第四条第一項の規定により支給された一時金を含む。）について適用する。
The provisions of Article 66 of the new Industrial Accident Insurance Act apply to lump-sum compensation payments for surviving family and lump-sum payments for surviving family under the provisions of the Industrial Accident Insurance Act for which the grounds for payment arose on or after the effective date. In this case, with regard to the application of the provisions of Article 66 of the new Industrial Accident Insurance Act during the period from the effective date to October 31, 1981, the phrase "the amount of the advance lump-sum payment of compensation pension for surviving family (or, if that amount has been revised pursuant to the provisions of Article 64, paragraph (1) or Article 65, paragraph (1), the amount that would be obtained if that revision had not been made)" in paragraph (1) of that Article is deemed to be replaced with "the amount of the advance lump-sum payment of compensation pension for surviving family", and the phrase "the amount of the advance lump-sum payment of pension for surviving family (or, if that amount has been revised pursuant to the provisions of Article 64, paragraph (1) as applied mutatis mutandis pursuant to paragraph (2) of that Article or Article 65, paragraph (1) as applied mutatis mutandis pursuant to paragraph (2) of that Article with the replacement of terms, the amount that would be obtained if that revision had not been made)" in paragraph (2) of that Article with "the amount of the advance lump-sum payment of pension for surviving family".
新労災保険法第六十六条の規定は、施行日以後において支給すべき事由が生じた労災保険法の規定による遺族補償一時金及び遺族一時金について適用する。この場合において、施行日から昭和五十六年十月三十一日までの間における新労災保険法第六十六条の規定の適用については、同条第一項中「遺族補償年金前払一時金の額（その額が第六十四条第一項又は第六十五条第一項の規定により改定されたものである場合には、当該改定がされなかつたものとした場合に得られる額）」とあるのは「遺族補償年金前払一時金の額」と、同条第二項中「遺族年金前払一時金の額（その額が第六十四条第二項において準用する同条第一項又は第六十五条第二項において読み替えて準用する同条第一項の規定により改定されたものである場合には、当該改定がされなかつたものとした場合に得られる額）」とあるのは「遺族年金前払一時金の額」とする。
The provisions of Article 67 of the new Industrial Accident Insurance Act apply to damage caused by accidents that occurred on or after November 1, 1981.
新労災保険法第六十七条の規定は、昭和五十六年十一月一日以後に発生した事故に起因する損害について適用する。
