Supplementary Provisions
附 則
The effective date of this Act is specified by Cabinet Order within a period not exceeding six months from the date of promulgation.
この法律の施行期日は、公布の日から起算して六箇月をこえない範囲内で、政令で定める。
The acceptance of requests for examination, decisions on examination and other procedures carried out, before this Act comes into effect, by an insurance examiner or an unemployment insurance examiner pursuant to the provisions of the Industrial Accident Compensation Insurance Act before its amendment, the Act on Special Protection for Persons with Silicosis and Traumatic Spinal Cord Injury before its amendment or the Unemployment Insurance Act before its amendment, or of orders based on those Acts, for which this Act has corresponding provisions, are deemed, as specified by Cabinet Order, to be the acceptance of requests for examination, decisions on examination and other procedures carried out by an industrial accident compensation insurance examiner or an unemployment insurance examiner pursuant to the provisions of this Act.
この法律の施行前に、改正前の労働者災害補償保険法、改正前のけい肺及び外傷性せき髄障害に関する特別保護法若しくは改正前の失業保険法又はこれらの法律に基く命令の規定により、保険審査官又は失業保険審査官がした審査の請求の受理、審査の決定その他の手続でこの法律に相当する規定のあるものは、政令で定めるところにより、この法律の規定により労働者災害補償保険審査官又は失業保険審査官がした審査の請求の受理、審査の決定その他の手続とみなす。
The acceptance of requests for examination, decisions on examination and other procedures carried out, before this Act comes into effect, by the Industrial Accident Compensation Insurance Appeal Board or the Unemployment Insurance Appeal Board pursuant to the provisions of the Industrial Accident Compensation Insurance Act before its amendment, the Act on Special Protection for Persons with Silicosis and Traumatic Spinal Cord Injury before its amendment or the Unemployment Insurance Act before its amendment, or of orders based on those Acts, for which this Act has corresponding provisions, are deemed, as specified by Cabinet Order, to be the acceptance of requests for re-examination, determinations on re-examination and other procedures carried out by the Appeal Committee pursuant to the provisions of this Act.
この法律の施行前に、改正前の労働者災害補償保険法、改正前のけい肺及び外傷性せき髄障害に関する特別保護法若しくは改正前の失業保険法又はこれらの法律に基く命令の規定により、労働者災害補償保険審査会又は失業保険審査会がした審査の請求の受理、審査の決定その他の手続でこの法律に相当する規定のあるものは、政令で定めるところにより、この法律の規定により審査会がした再審査の請求の受理、再審査の裁決その他の手続とみなす。
Any lawsuit in which the Industrial Accident Compensation Insurance Appeal Board or the Unemployment Insurance Appeal Board is the defendant and which is actually pending before a court at the time this Act comes into effect is deemed to have been taken over by the Appeal Committee on the date on which this Act comes into effect.
労働者災害補償保険審査会又は失業保険審査会を被告とする訴訟で、この法律の施行の際、現に裁判所に係属しているものは、この法律の施行の日に、審査会が受け継いだものとみなす。
An action seeking the revocation or modification of an illegal disposition made by the Industrial Accident Compensation Insurance Appeal Board, in which the Appeal Committee is the defendant pursuant to the provisions of paragraph (11) or the preceding paragraph, is subject, notwithstanding the provisions of Article 4 of the Act on Special Provisions for Administrative Case Litigation (Act No. 81 of 1948), to the exclusive jurisdiction of the court for the place where the Industrial Accident Compensation Insurance Appeal Board that made the disposition was located.
Any lawsuit in which an Industrial Accident Compensation Appeal Board is the defendant and which is actually pending before a court at the time this Act comes into effect is deemed to have been taken over, on the date on which this Act comes into effect, by the industrial accident compensation insurance examiner of the Prefectural Labor Standards Bureau at which that Industrial Accident Compensation Appeal Board was established.
労働者災害補償審査会を被告とする訴訟で、この法律の施行の際、現に裁判所に係属しているものは、この法律の施行の日に、当該労働者災害補償審査会が置かれていた都道府県労働基準局の労働者災害補償保険審査官が受け継いだものとみなす。
The provisions then in force continue to govern the application of penal provisions to acts committed before this Act comes into effect in violation of the provisions of the Industrial Accident Compensation Insurance Act before its amendment or the Unemployment Insurance Act before its amendment.
この法律の施行前にした改正前の労働者災害補償保険法又は改正前の失業保険法の規定に違反する行為に対する罰則の適用については、なお、従前の例による。
