第七章 犯罪の不成立及び刑の減免
第三十五条（正当行為）
An act performed in accordance with laws and regulations or in the pursuit of lawful business is not punishable.
法令又は正当な業務による行為は、罰しない。
第三十六条（正当防衛）
An act a person was compelled to take to protect the rights of oneself or any other person against imminent and unlawful infringement is not punishable.
急迫不正の侵害に対して、自己又は他人の権利を防衛するため、やむを得ずにした行為は、罰しない。
An act exceeding the limits of self-defense may lead to the punishment being reduced or may exculpate the offender in light of the circumstances.
防衛の程度を超えた行為は、情状により、その刑を減軽し、又は免除することができる。
第三十七条（緊急避難）
An act a person was compelled to take to avert a present danger to the life, body, liberty or property of oneself or any other person is not punishable only when the harm produced by such act does not exceed the harm to be averted; provided, however, that an act causing excessive harm may lead to the punishment being reduced or may exculpate the offender in light of the circumstances.
自己又は他人の生命、身体、自由又は財産に対する現在の危難を避けるため、やむを得ずにした行為は、これによって生じた害が避けようとした害の程度を超えなかった場合に限り、罰しない。ただし、その程度を超えた行為は、情状により、その刑を減軽し、又は免除することができる。
The preceding paragraph does not apply to a person under special professional obligation.
前項の規定は、業務上特別の義務がある者には、適用しない。
第三十八条（故意）
An act performed without the intent to commit a crime is not punishable; provided, however, that the same does not apply unless otherwise specially provided for by law.
罪を犯す意思がない行為は、罰しない。ただし、法律に特別の規定がある場合は、この限りでない。
When a person who commits a crime was not aware of the fact that the crime constituted a greater crime, the person may not be punished for the greater crime.
重い罪に当たるべき行為をしたのに、行為の時にその重い罪に当たることとなる事実を知らなかった者は、その重い罪によって処断することはできない。
A person lacking knowledge of law does not mean a lack of intention to commit a crime; provided, however, the punishment may be reduced in light of the circumstances.
法律を知らなかったとしても、そのことによって、罪を犯す意思がなかったとすることはできない。ただし、情状により、その刑を減軽することができる。
Article 39Insanity and Diminished Capacity
第三十九条（心神喪失及び心神耗弱）
Actions due to insanity is not subject to punishment.
心神喪失者の行為は、罰しない。
An act of diminished capacity leads to the punishment being reduced.
心神耗弱者の行為は、その刑を減軽する。

第四十一条（責任年齢）
An act of a person less than 14 years of age is not punishable.
十四歳に満たない者の行為は、罰しない。
第四十二条（自首等）
The punishment of a person who committed a crime and self- denounces themselves before being discovered as a suspect by an investigative authority may be reduced.
罪を犯した者が捜査機関に発覚する前に自首したときは、その刑を減軽することができる。
The preceding paragraph also applies with respect to a crime which cannot be prosecuted without a criminal complaint, and to a person who surrendered themselves to a person who has a right to make the criminal complaint.
告訴がなければ公訴を提起することができない罪について、告訴をすることができる者に対して自己の犯罪事実を告げ、その措置にゆだねたときも、前項と同様とする。
