Article 38Intent

第三十八条(故意)

An act performed without the intent to commit a crime is not punishable; provided, however, that the same does not apply unless otherwise specially provided for by law.

罪を犯す意思がない行為は、罰しない。ただし、法律に特別の規定がある場合は、この限りでない。

When a person who commits a crime was not aware of the fact that the crime constituted a greater crime, the person may not be punished for the greater crime.

重い罪に当たるべき行為をしたのに、行為の時にその重い罪に当たることとなる事実を知らなかった者は、その重い罪によって処断することはできない。

A person lacking knowledge of law does not mean a lack of intention to commit a crime; provided, however, the punishment may be reduced in light of the circumstances.

法律を知らなかったとしても、そのことによって、罪を犯す意思がなかったとすることはできない。ただし、情状により、その刑を減軽することができる。
