Supplementary Provisions, Article 10Transitional Measures Concerning the Right of Residence of a Spouse
第十条（配偶者の居住の権利に関する経過措置）
The provisions of Articles 1028 through 1041 of the Civil Code as amended by the provisions of Article 2 (referred to as the "item (iv) New Civil Code" in the following paragraph) apply, except as prescribed in the following paragraph, to succession that commences on or after the effective date of the provisions set forth in Article 1, item (iv) of the Supplementary Provisions (referred to as the "item (iv) Effective Date" in this Article), and the provisions then in force continue to govern succession that commenced before the item (iv) Effective Date.
第二条の規定による改正後の民法（次項において「第四号新民法」という。）第千二十八条から第千四十一条までの規定は、次項に定めるものを除き、附則第一条第四号に掲げる規定の施行の日（以下この条において「第四号施行日」という。）以後に開始した相続について適用し、第四号施行日前に開始した相続については、なお従前の例による。
The provisions of Articles 1028 through 1036 of the item (iv) New Civil Code do not apply to a testamentary gift made before the item (iv) Effective Date.
第四号新民法第千二十八条から第千三十六条までの規定は、第四号施行日前にされた遺贈については、適用しない。
