Supplementary Provisions, Article 2Principle of Transitional Measures Accompanying the Partial Amendment of the Civil Code
第二条(民法の一部改正に伴う経過措置の原則)
The provisions of the Civil Code as amended by this Act (referred to as the "New Act" in the following Article) also apply to matters that arose before the date on which the relevant amending provisions come into effect, except in the case provided for in paragraph (3) of the following Article; provided, however, that this does not preclude the effect that arose under the provisions of the Civil Code before amendment (referred to as the "Former Act" in the following Article).
Supplementary Provisions, Article 3Transitional Measures Concerning Declarations of Interdiction and Quasi-Interdiction, etc.
第三条(禁治産及び準禁治産の宣告等に関する経過措置)
A declaration of interdiction under the provisions of the Former Act is deemed to be a decision for commencement of guardianship under the provisions of the New Act, and the interdicted person who received that declaration of interdiction and that person's guardian and guardian's supervisor are deemed to be the adult ward who received that decision for commencement of guardianship and that person's adult guardian and supervisor for the guardian of an adult.
A declaration of quasi-interdiction under the provisions of the Former Act on the ground of diminished mental capacity is deemed to be a decision for commencement of curatorship under the provisions of the New Act, and the quasi-interdicted person who received that declaration of quasi-interdiction and that person's curator are deemed to be the person under curatorship who received that decision for commencement of curatorship and that person's curator.
With respect to the application of the provisions of the Civil Code to quasi-interdicted persons other than the quasi-interdicted persons prescribed in the preceding paragraph and their curators, the provisions then in force continue to govern, except for the provisions amending Articles 846, 974 and 1009.
前項に規定する準禁治産者以外の準禁治産者及びその保佐人に関する民法の規定の適用については、第八百四十六条、第九百七十四条及び第千九条の改正規定を除き、なお従前の例による。
A petition for a declaration of interdiction or quasi-interdiction under the provisions of the Former Act (excluding one for which the adjudication pertaining to that petition became final before this Act comes into effect) is deemed to be a petition for a decision for commencement of guardianship or for commencement of curatorship under the provisions of the New Act.
