第三条の九の二（法第五十六条第二号に規定する政令で定める者）
Article 3-9-2Persons Specified by Cabinet Order in Article 56, item (ii) of the Act
The persons specified by Cabinet Order as prescribed in Article 56, item (ii) of the Act are as follows:
法第五十六条第二号に規定する政令で定める者は、次のとおりとする。
a beneficiary of a disability basic pension under the National Pension Act who has gone three years, counting from the last day on which the beneficiary ceased to fall under a state of disability of a degree that falls under the disability grades prescribed in Article 47, paragraph (2) of the Act (hereinafter in this item referred to as the "state of disability"), without falling under the state of disability (limited to a person who does not currently fall under the state of disability); or
a beneficiary of a disability pension under the former National Pension Act who has gone three years, counting from the last day on which the beneficiary ceased to fall under a state of disability of the degree prescribed in the Appended Table of the former National Pension Act (hereinafter in this item referred to as the "state of disability"), without falling under the state of disability (limited to a person who does not currently fall under the state of disability).
旧国民年金法による障害年金の受給権者であつて、最後に旧国民年金法別表に定める程度の障害の状態（以下この号において「障害状態」という。）に該当しなくなつた日から起算して障害状態に該当することなく三年を経過したもの（現に障害状態に該当しない者に限る。）
