第二条（第一条の規定の施行に伴う経過措置）
The provisions then in force continue to govern the amounts of pension-type insurance benefits under the provisions of the Industrial Accident Compensation Insurance Act for periods before the date on which the provisions of Article 1 come into effect, and the amounts of disability compensation lump-sum payments, differential lump-sum payments of disability compensation pension and advance lump-sum payments of disability compensation pension, lump-sum compensation payments for surviving family and advance lump-sum payments of compensation pension for surviving family, disability lump-sum payments, differential lump-sum payments of disability pension and advance lump-sum payments of disability pension, and lump-sum payments for surviving family and advance lump-sum payments of pension for surviving family under the provisions of that Act for which the grounds for payment arose before that date.
第一条の規定の施行の日前の期間に係る労働者災害補償保険法の規定による年金たる保険給付の額並びに同日前に支給すべき事由の生じた同法の規定による障害補償一時金、障害補償年金差額一時金及び障害補償年金前払一時金並びに遺族補償一時金及び遺族補償年金前払一時金並びに障害一時金、障害年金差額一時金及び障害年金前払一時金並びに遺族一時金及び遺族年金前払一時金の額については、なお従前の例による。
With regard to the application of the provisions of Article 16-6 of the Industrial Accident Compensation Insurance Act as amended by the provisions of that Article in the case where a compensation pension for surviving family under the provisions of the Industrial Accident Compensation Insurance Act for periods before the date on which the provisions of Article 1 come into effect has been paid, the phrase "the fiscal year one year before the fiscal year of the month for which that compensation pension for surviving family is paid (in cases where that month is any of the months from April to July, the fiscal year two years before)" in paragraph (2) of that Article is deemed to be replaced with "the fiscal year of the date on which the grounds for calculation occurred (in cases where the amount of that compensation pension for surviving family has been revised pursuant to the provisions of Article 64 of the Industrial Accident Compensation Insurance Act before its amendment by the provisions of Article 1 of the Act Partially Amending the Industrial Accident Compensation Insurance Act, etc. (Act No. 40 of 1990) or the provisions of any other Act specified by Ministry of Labour Order, the fiscal year before the fiscal year of the first month for which the revised amount is to be the amount of the compensation pension for surviving family)".
第一条の規定の施行の日前の期間に係る労働者災害補償保険法の規定による遺族補償年金が支給された場合における同条の規定による改正後の労働者災害補償保険法第十六条の六の規定の適用については、同条第二項中「当該遺族補償年金の支給の対象とされた月の属する年度の前年度（当該月が四月から七月までの月に該当する場合にあつては、前々年度）」とあるのは、「算定事由発生日の属する年度（当該遺族補償年金の額が労働者災害補償保険法等の一部を改正する法律（平成二年法律第四十号）第一条の規定による改正前の労働者災害補償保険法第六十四条の規定その他労働省令で定める法律の規定により改定されたものである場合にあつては、当該改定後の額を遺族補償年金の額とすべき最初の月の属する年度の前年度）」とする。
The provisions of the preceding paragraph apply mutatis mutandis to the case where a pension for surviving family under the provisions of the Industrial Accident Compensation Insurance Act for periods before the date on which the provisions of Article 1 come into effect has been paid. In this case, the term "Article 16-6 of the Industrial Accident Compensation Insurance Act as amended by the provisions of that Article" in the preceding paragraph is deemed to be replaced with "Article 16-6 of the Industrial Accident Compensation Insurance Act as amended by the provisions of that Article, as read with the replacement of terms pursuant to the provisions of Article 22-4, paragraph (3) of that Act", and the term "compensation pension for surviving family" is deemed to be replaced with "pension for surviving family".
