①An employees' disability pension under Article 47-2, paragraph (1) of the Employees' Pension Insurance Act is not paid, notwithstanding the provisions of that paragraph, for a disability due to the same injury or illness, to a person who has had the right to receive a benefit in the form of a pension, having disability as the grounds for payment (including a benefit deemed to be such a benefit in the form of a pension under the provisions of other laws and regulations), under the pre-amendment National Public Officers Mutual Aid Association Act or the former National Public Officers, etc. Mutual Aid Association Act, the pre-amendment Local Public Officers, etc. Mutual Aid Association Act or the former Local Public Officers, etc. Mutual Aid Association Act, or the pre-amendment Private School Personnel Mutual Aid Association Act or the former Private School Personnel Mutual Aid Association Act, or to any other person specified by Cabinet Order.

②If a person who has, before the Effective Date, had the right to receive a benefit in the form of a pension, having disability as the grounds for payment, under the pre-amendment National Public Officers Mutual Aid Association Act or the former National Public Officers, etc. Mutual Aid Association Act, the pre-amendment Local Public Officers, etc. Mutual Aid Association Act or the former Local Public Officers, etc. Mutual Aid Association Act, or the pre-amendment Private School Personnel Mutual Aid Association Act or the former Private School Personnel Mutual Aid Association Act, and who has a former National Public Servants Mutual Aid Association member period, former Local Public Servants Mutual Aid Association member period or former Private School Personnel Mutual Aid participant period (excluding a person who has the right to receive that benefit on the Effective Date, and a person who has the right to receive, for the injury or illness that became the grounds for payment of that benefit, a disability mutual aid pension under the pre-amendment National Public Officers Mutual Aid Association Act paid pursuant to the provisions of Article 8, paragraph (3) of the Supplementary Provisions of the Act Partially Amending the National Public Officers, etc. Mutual Aid Association Act, etc. (Act No. 98 of 1994; referred to as the "1994 National Public Officers Mutual Aid Amendment Act" in this paragraph), a disability mutual aid pension under the pre-amendment Local Public Officers, etc. Mutual Aid Association Act paid pursuant to the provisions of Article 8, paragraph (3) of the Supplementary Provisions of the Act Partially Amending the Local Public Officers, etc. Mutual Aid Association Act, etc. (Act No. 99 of 1994), or a disability mutual aid pension under the pre-amendment Private School Personnel Mutual Aid Association Act paid pursuant to the provisions of Article 8, paragraph (3) of the Supplementary Provisions of the 1994 National Public Officers Mutual Aid Amendment Act, the example of which is followed pursuant to the provisions of Article 48-2 of the pre-amendment Private School Personnel Mutual Aid Association Act) is, due to the injury or illness that became the grounds for payment of that benefit, in a state of disability of a degree that falls under a disability grade prescribed in Article 47, paragraph (2) of the Employees' Pension Insurance Act (referred to simply as a "disability grade" in this paragraph) on the Effective Date, or comes to be in a state of disability of a degree that falls under a disability grade during the period from the day following the Effective Date until the day preceding the day on which the person reaches the age of 65, the person may claim payment of the employees' disability pension under paragraph (1) of that Article during the period from the Effective Date (for a person who is not in a state of disability of a degree that falls under a disability grade on the Effective Date, from when the person comes to be in a state of disability of a degree that falls under a disability grade) until the day preceding the day on which the person reaches the age of 65.

③When a claim under the provisions of the preceding paragraph has been made, the employees' disability pension under paragraph (1) of Article 47 of the Employees' Pension Insurance Act is paid to the person who made the claim, notwithstanding the provisions of that paragraph.
