Supplementary Provisions, Article 5Transitional Measures Concerning a Person Entitled to Receive a Benefit, etc. under the Former National Pension Act
第五条（旧国民年金法による給付の受給権者等に係る経過措置）
With respect to a person who can claim payment of an unpaid pension pursuant to the provisions of Article 19 of the National Pension Act before the amendment under Article 1 of the Act Partially Amending the National Pension Act, etc. (Act No. 34 of 1985; hereinafter referred to as the "1985 Amendment Act") (referred to as the "former National Pension Act" in the following paragraph), for which the provisions then in force continue to govern pursuant to Article 32, paragraph (12) of the Supplementary Provisions of the 1985 Amendment Act, or other provisions concerning payment of an unpaid pension specified by Cabinet Order, the provisions of Article 14-2, paragraph (2) of the National Pension Act as amended by the item (iii) provisions apply by deeming that person to be a person who can claim payment of an unpaid pension pursuant to the provisions of Article 19 of the National Pension Act.
国民年金法等の一部を改正する法律（昭和六十年法律第三十四号。以下「昭和六十年改正法」という。）附則第三十二条第十二項の規定によりなお従前の例によるものとされた昭和六十年改正法第一条の規定による改正前の国民年金法（次項において「旧国民年金法」という。）第十九条の規定その他未支給の年金の支給に関する規定であって政令で定めるものにより未支給の年金の支給を請求することができる者については、国民年金法第十九条の規定により未支給の年金の支給を請求することができる者とみなして、第三号改正後国民年金法第十四条の二第二項の規定を適用する。
With respect to a person who can receive an orphan's pension under the former National Pension Act, or another benefit in the form of a pension with death as the ground for payment specified by Cabinet Order, for which the provisions then in force continue to govern pursuant to Article 32, paragraph (1) of the Supplementary Provisions of the 1985 Amendment Act, the provisions of Article 14-2, paragraph (2) of the National Pension Act as amended by the item (iii) provisions apply by deeming that person to be a spouse or child who can receive a survivors' basic pension under the National Pension Act.
昭和六十年改正法附則第三十二条第一項の規定によりなお従前の例によるものとされた旧国民年金法による遺児年金その他死亡を支給事由とする年金たる給付であって政令で定めるものを受けることができる者については、国民年金法による遺族基礎年金を受けることができる配偶者又は子とみなして、第三号改正後国民年金法第十四条の二第二項の規定を適用する。
In the cases referred to in the preceding two paragraphs, the necessary replacement of terms and other necessary matters concerning the application of the provisions of Article 14-2, paragraph (2) of the National Pension Act as amended by the item (iii) provisions are specified by Cabinet Order.
前二項の場合において、第三号改正後国民年金法第十四条の二第二項の規定の適用に関し必要な読替えその他必要な事項は、政令で定める。
