①An old-age defined-benefit early leaver, etc. may, where the person has acquired the status as a participant in a defined-benefit corporate pension and the articles of Association of the surviving Pension Fund Association and that defined-benefit corporate pension provide in advance that the reserves specified by the articles of Association of the surviving Pension Fund Association may be transferred from the surviving Pension Fund Association to the asset management and investment institution, etc. of that defined-benefit corporate pension, apply to the surviving Pension Fund Association for the transfer of those reserves; provided, however, that this does not apply where the old-age defined-benefit early leaver, etc. holds the right to receive the old-age benefit under the provisions of Article 91-2, paragraph (3), etc. of the pre-amendment Defined-Benefit Corporate Pension Act that remain in force or the surviving Pension Fund Association old-age benefit under Article 46, paragraph (3), Article 47, paragraph (3) or Article 49-2, paragraph (1) of the Supplementary Provisions.

②When an application has been made under the preceding paragraph, the surviving Pension Fund Association is to transfer to the asset management and investment institution, etc. of that defined-benefit corporate pension the reserves to which the application pertains.

③When the asset management and investment institution, etc. of that defined-benefit corporate pension has received the transfer of reserves pursuant to the preceding paragraph, the employer, etc. of that defined-benefit corporate pension is to pay old-age benefits, etc. to that old-age defined-benefit early leaver, etc., using the transferred Funds as the source and as provided by its articles of Association.

④When the surviving Pension Fund Association has transferred reserves pursuant to the provisions of paragraph (2), it is relieved of its obligation concerning the payment of the old-age benefit or the survivor benefit under the provisions of Article 91-2, paragraph (3), etc. of the pre-amendment Defined-Benefit Corporate Pension Act that remain in force, or of the surviving Pension Fund Association old-age benefit or the surviving Pension Fund Association survivor benefit under Article 46, paragraph (3), Article 47, paragraph (3) or Article 49-2, paragraph (1) of the Supplementary Provisions, pertaining to that old-age defined-benefit early leaver, etc.

⑤When the employer, etc. of that defined-benefit corporate pension has come to pay old-age benefits, etc. pursuant to the provisions of paragraph (3), it must notify that old-age defined-benefit early leaver, etc. to that effect.
