Supplementary Provisions, Article 46Measures Concerning Defined-Benefit Corporate Pension Early Leavers
第四十六条（確定給付企業年金中途脱退者に係る措置）
A defined-benefit corporate pension early leaver may apply to the employer, etc. of the defined-benefit corporate pension for the transfer of the amount equivalent to a defined-benefit corporate pension lump-sum withdrawal payment to the surviving Pension Fund Association.
確定給付企業年金中途脱退者は、確定給付企業年金の事業主等に確定給付企業年金脱退一時金相当額の存続連合会への移換を申し出ることができる。
When an application has been made under the preceding paragraph, the asset management and investment institution, etc. of that defined-benefit corporate pension is to transfer to the surviving Pension Fund Association the amount equivalent to a defined-benefit corporate pension lump-sum withdrawal payment to which the application pertains.
当該確定給付企業年金の資産管理運用機関等は、前項の規定による申出があったときは、存続連合会に当該申出に係る確定給付企業年金脱退一時金相当額を移換するものとする。
When the surviving Pension Fund Association has received the transfer of the amount equivalent to a defined-benefit corporate pension lump-sum withdrawal payment pursuant to the preceding paragraph, it is to pay, using the transferred Funds as the source and as specified by Cabinet Order, the surviving Pension Fund Association old-age benefit or the surviving Pension Fund Association survivor benefit to that defined-benefit corporate pension early leaver or that person's surviving family.
存続連合会は、前項の規定により確定給付企業年金脱退一時金相当額の移換を受けたときは、当該移換金を原資として、政令で定めるところにより、当該確定給付企業年金中途脱退者又はその遺族に対し、存続連合会老齢給付金又は存続連合会遺族給付金の支給を行うものとする。
When the asset management and investment institution, etc. of that defined-benefit corporate pension has transferred the amount equivalent to a defined-benefit corporate pension lump-sum withdrawal payment pursuant to the provisions of paragraph (2), the employer, etc. of that defined-benefit corporate pension is relieved of its obligation concerning the payment of the withdrawal lump-sum payment pertaining to that defined-benefit corporate pension early leaver.
当該確定給付企業年金の事業主等は、第二項の規定により当該確定給付企業年金の資産管理運用機関等が確定給付企業年金脱退一時金相当額を移換したときは、当該確定給付企業年金中途脱退者に係る脱退一時金の支給に関する義務を免れる。
When the surviving Pension Fund Association has come to pay the surviving Pension Fund Association old-age benefit or the surviving Pension Fund Association survivor benefit pursuant to the provisions of paragraph (3), it must notify that defined-benefit corporate pension early leaver or that person's surviving family to that effect.
存続連合会は、第三項の規定により存続連合会老齢給付金又は存続連合会遺族給付金の支給を行うこととなったときは、その旨を当該確定給付企業年金中途脱退者又はその遺族に通知しなければならない。
Where the surviving Pension Fund Association is unable to give the notice under the preceding paragraph because the whereabouts of the defined-benefit corporate pension early leaver or that person's surviving family are unknown, it must, in lieu of that notice, give public notice of the matters to be notified.
存続連合会は、確定給付企業年金中途脱退者又はその遺族の所在が明らかでないため前項の規定による通知をすることができないときは、当該通知に代えて、その通知すべき事項を公告しなければならない。
