附 則

この法律は、公布の日から起算して六月をこえない範囲内において政令で定める日から施行する。ただし、次項の規定は、公布の日から施行する。

新法第三十八条から第四十三条までの規定は、この法律の施行前に締結された宅地若しくは建物の売買契約又はこの法律の施行前に締結された売買契約に係る宅地若しくは建物については、適用しない。

宅地建物取引業者が、この法律の施行前にこの法律による改正前の宅地建物取引業法（以下「旧法」という。）第二十条第一項から第三項まで又は第二十条の二第一項に規定する場合に該当した場合における当該宅地建物取引業者に対する処分については、新法第六十五条又は第六十六条に規定する相当の場合に該当したものとみなして、これらの規定を適用する。

旧法の規定により建設大臣又は都道府県知事がした処分その他の行為は、新法の規定により建設大臣又は都道府県知事がした処分その他の行為とみなす。

この法律の施行前にした行為に対する罰則の適用については、なお従前の例による。
