附 則

この法律は、公布の日から起算して一年を超えない範囲内において政令で定める日から施行する。ただし、第一条中宅地建物取引業法第六十四条の三第三項を同条第四項とし、同条第二項の次に一項を加える改正規定及び同法第六十四条の十二第七項の改正規定並びに附則第六項の規定は公布の日から、同法第三十四条の次に二条を加える改正規定は公布の日から起算して二年を経過する日から施行する。

この法律の施行の日から三年を経過する日までの間においては、この法律の施行の際現に改正前の宅地建物取引業法第十八条第一項の登録を受けている者は、その登録をしている都道府県知事が定める期間内に限り、改正後の宅地建物取引業法第二十二条の二第一項の宅地建物取引主任者証（以下「取引主任者証」という。）の交付を申請することができる。

都道府県知事は、この法律の施行前に、建設省令の定めるところにより、取引主任者証の交付を受けようとする者が受講すべき講習を指定することができる。

前項の講習の受講は、改正後の宅地建物取引業法の適用については、同法第二十二条の二第二項の講習の受講とみなす。

改正後の宅地建物取引業法第三十七条の二（改正後の積立式宅地建物販売業法第四十条において適用する場合を含む。）の規定は、この法律の施行前にされた宅地又は建物の買受けの申込み若しくは売買契約又は積立式宅地建物販売の相手方となる申込み若しくはその契約については、適用しない。

この法律の施行の際現に改正前の宅地建物取引業法第三条第一項の免許、同法第十八条第一項の登録、同法第四十一条第一項第一号の指定若しくは同法第六十四条の二第一項の指定又は積立式宅地建物販売業法第三条第一項の許可（以下「免許等」という。）を受けている者に対する免許等の取消しその他の監督上の処分に関しては、この法律の施行前に生じた事由については、なお従前の例による。
