Supplementary Provisions, Article 5
第五条
A person who, on the day before the date on which this Act comes into effect, was to receive medical treatment benefits under the provisions of the former Special Protection Act or the former Temporary Measures Act, and whom the Director of the Prefectural Labor Standards Bureau has found, pursuant to the provisions of Ministry of Labour Order, to require continued medical treatment on and after the date on which this Act comes into effect, is deemed, on that date, to be a person to whom the Industrial Accident Compensation Insurance Act applies and for whom a decision to provide compensation for persons with long-term illness or injury has been made.
With regard to a person who receives compensation for persons with long-term illness or injury pursuant to the provisions of the preceding paragraph, notwithstanding the provisions of the Industrial Accident Compensation Insurance Act as amended (hereinafter referred to as the "new Act"), benefits for surviving family and funeral benefits are not to be provided, and the annual amount of the illness or injury benefits (excluding the portion concerning medical treatment or medical treatment expenses pertaining to Type II illness or injury benefits) or the Type I disability benefits to be paid to that person is, respectively, the amount obtained by deducting 40 days' worth of the average wage from the annual amount under the provisions of the new Act.
前項の規定により長期傷病者補償を受ける者については、改正後の労働者災害補償保険法(以下「新法」という。)の規定にかかわらず、遺族給付及び葬祭給付は行なわないものとし、その者に支給すべき傷病給付(第二種傷病給付に係る療養又は療養の費用に関する部分を除く。)又は第一種障害給付の年額は、それぞれ、新法の規定による年額から平均賃金の四十日分を減じた額とする。
A person who is dissatisfied with a disposition concerning the finding by the Director of the Prefectural Labor Standards Bureau under the provisions of paragraph (1) may make a request for examination or re-examination, or file an action, in the same manner as for an objection to a decision on insurance proceeds under the provisions of the new Act.
