When a punishment is to be aggravated or reduced in the same case, the following order applies:
同時に刑を加重し、又は減軽するときは、次の順序による。
an aggravation for a recidivist offense;
再犯加重
a statutory reduction;
法律上の減軽
an aggravation for consolidated punishment;
併合罪の加重
a reduction in light of extenuating circumstances.
