Article 56Recidivist Offenses

第五十六条(再犯)

If a person sentenced to imprisonment, reoffends within five years from the day on which the authorities have finished executing that sentence or the person was granted a discharge from its execution, and the person is sentenced to imprisonment for a definite term, this crime constitutes a recidivist offense.

拘禁刑に処せられた者がその執行を終わった日又はその執行の免除を得た日から五年以内に更に罪を犯した場合において、その者を有期拘禁刑に処するときは、再犯とする。

The preceding paragraph also applies if a person sentenced to the death penalty commits a crime again within five years from the day on which the person was granted a discharge from the execution of that sentence or, from the day on which the authorities have finished executing the reduced sentence imposed after the death penalty was reduced to imprisonment or the day on which the person was granted a discharge from its execution, and the person is to be sentenced to imprisonment for a definite term.

死刑に処せられた者がその執行の免除を得た日又は減刑により拘禁刑に減軽されてその執行を終わった日若しくはその執行の免除を得た日から五年以内に更に罪を犯した場合において、その者を有期拘禁刑に処するときも、前項と同様とする。
