Supplementary Provisions, Article 7Transitional Measures Concerning Recipients of Benefits under the Former Employees' Pension Insurance Act
第七条（旧厚生年金保険法による給付の受給権者等に係る経過措置）
With regard to a person who is entitled to claim payment of unpaid insurance benefits under the provisions of Article 37 of the Employees' Pension Insurance Act before the amendment by the provisions of Article 3 of the 1985 Amendment Act, for which the provisions then in force continue to govern pursuant to the provisions of Article 78, paragraph (11) of the Supplementary Provisions of the 1985 Amendment Act (hereinafter referred to in the following paragraph as the "Former Employees' Pension Insurance Act"), or under any other provisions concerning the payment of unpaid insurance benefits that are specified by Cabinet Order, the provisions of Article 28-2, paragraph (2) of the Employees' Pension Insurance Act as Amended by the item (iii) Provisions apply, deeming that person to be a person who is entitled to claim payment of unpaid insurance benefits under the provisions of Article 37 of the Employees' Pension Insurance Act.
昭和六十年改正法附則第七十八条第十一項の規定によりなお従前の例によるものとされた昭和六十年改正法第三条の規定による改正前の厚生年金保険法（次項において「旧厚生年金保険法」という。）第三十七条の規定その他未支給の保険給付の支給に関する規定であって政令で定めるものにより未支給の保険給付の支給を請求することができる者については、厚生年金保険法第三十七条の規定により未支給の保険給付の支給を請求することができる者とみなして、第三号改正後厚生年金保険法第二十八条の二第二項の規定を適用する。
With regard to a person who can receive a pension for surviving family under the Former Employees' Pension Insurance Act, for which the provisions then in force continue to govern pursuant to the provisions of Article 78, paragraph (1) of the Supplementary Provisions of the 1985 Amendment Act, or any other pension insurance benefits for which death is the grounds for payment that are specified by Cabinet Order, the provisions of Article 28-2, paragraph (2) of the Employees' Pension Insurance Act as Amended by the item (iii) Provisions apply, deeming that person to be a surviving family member who can receive an employees' pension for surviving family under the Employees' Pension Insurance Act.
昭和六十年改正法附則第七十八条第一項の規定によりなお従前の例によるものとされた旧厚生年金保険法による遺族年金その他死亡を支給事由とする年金たる保険給付であって政令で定めるものを受けることができる者については、厚生年金保険法による遺族厚生年金を受けることができる遺族とみなして、第三号改正後厚生年金保険法第二十八条の二第二項の規定を適用する。
In the cases referred to in the preceding two paragraphs, Cabinet Order provides for the necessary replacement of terms and other necessary matters in connection with the application of the provisions of Article 28-2, paragraph (2) of the Employees' Pension Insurance Act as Amended by the item (iii) Provisions.
前二項の場合において、第三号改正後厚生年金保険法第二十八条の二第二項の規定の適用に関し必要な読替えその他必要な事項は、政令で定める。
