第十四条（障害厚生年金の支給に関する経過措置）
In the case where a person who has at some time held the right to receive an employees' disability pension under the Employees' Pension Insurance Act before the Effective Date (excluding a person who holds the right to receive that employees' disability pension on the Effective Date) has, on the Effective Date, due to the injury or illness that was the grounds for payment of that employees' disability pension, a disability of a degree of severity that is classified as a disability grade prescribed in Article 47, paragraph (2) of that Act (hereinafter in this Article referred to simply as a "disability grade"), or comes to have a disability of a degree of severity that is classified as a disability grade during the period from the day following the Effective Date until the day before the day on which the person reaches 65 years of age, the person may request payment of the employees' disability pension under Article 47, paragraph (1) of that Act during the period from the Effective Date (or, for a person who does not have a disability of a degree of severity that is classified as a disability grade on the Effective Date, from when the person comes to have a disability of a degree of severity that is classified as a disability grade) until the day before the day on which the person reaches 65 years of age.
施行日前に厚生年金保険法による障害厚生年金の受給権を有していたことがある者（施行日において当該障害厚生年金の受給権を有する者を除く。）が、当該障害厚生年金の支給事由となった傷病により、施行日において同法第四十七条第二項に規定する障害等級（以下この条において単に「障害等級」という。）に該当する程度の障害の状態にあるとき、又は施行日の翌日から六十五歳に達する日の前日までの間において、障害等級に該当する程度の障害の状態に該当するに至ったときは、その者は、施行日（施行日において障害等級に該当する程度の障害の状態にない者にあっては、障害等級に該当する程度の障害の状態に該当するに至ったとき）から六十五歳に達する日の前日までの間に、同法第四十七条第一項の障害厚生年金の支給を請求することができる。
In the case where a person who has at some time held, before the Effective Date, the right to receive a disability pension under the former Employees' Pension Insurance Act (including one that is to be paid by the government that administers employees' pension insurance pursuant to the provisions of Article 87, paragraph (2) of the Supplementary Provisions of the 1985 Amendment Act and one specified by Cabinet Order as equivalent thereto; hereinafter in this paragraph referred to as a "disability pension under the former Act") (excluding a person who holds the right to receive that disability pension under the former Act on the Effective Date) has, on the Effective Date, due to the injury or illness that was the grounds for payment of that disability pension under the former Act, a disability of a degree of severity that is classified as a disability grade, or comes to have a disability of a degree of severity that is classified as a disability grade during the period from the day following the Effective Date until the day before the day on which the person reaches 65 years of age, the person may request payment of the employees' disability pension under Article 47, paragraph (1) of the Employees' Pension Insurance Act during the period from the Effective Date (or, for a person who does not have a disability of a degree of severity that is classified as a disability grade on the Effective Date, from when the person comes to have a disability of a degree of severity that is classified as a disability grade) until the day before the day on which the person reaches 65 years of age.
施行日前に旧厚生年金保険法による障害年金（昭和六十年改正法附則第八十七条第二項の規定により厚生年金保険の管掌者たる政府が支給するものとされたもの及びこれに準ずるものとして政令で定めるものを含む。以下この項において「旧法障害年金」という。）の受給権を有していたことがある者（施行日において当該旧法障害年金の受給権を有する者を除く。）が、当該旧法障害年金の支給事由となった傷病により、施行日において障害等級に該当する程度の障害の状態にあるとき、又は施行日の翌日から六十五歳に達する日の前日までの間において、障害等級に該当する程度の障害の状態に該当するに至ったときは、その者は、施行日（施行日において障害等級に該当する程度の障害の状態にない者にあっては、障害等級に該当する程度の障害の状態に該当するに至ったとき）から六十五歳に達する日の前日までの間に、厚生年金保険法第四十七条第一項の障害厚生年金の支給を請求することができる。
When a request under the preceding two paragraphs has been made, notwithstanding Article 47, paragraph (1) of the Employees' Pension Insurance Act, the employees' disability pension under that paragraph is paid to the person who made the request.
前二項の請求があったときは、厚生年金保険法第四十七条第一項の規定にかかわらず、その請求をした者に同項の障害厚生年金を支給する。
