第六十四条（障害厚生年金等の支給要件の特例）
In the case of applying the provisions of the proviso to Article 47, paragraph (1) of the Employees' Pension Insurance Act (including as applied mutatis mutandis in Article 47-2, paragraph (2), Article 47-3, paragraph (2), Article 52, paragraph (5), Article 54, paragraph (3) and Article 55, paragraph (2) of that Act) to a disability resulting from an injury or illness for which the day of initial examination falls before April 1, 2036, the phrase "does not comprise at least two-thirds of the relevant insured period" in the proviso to Article 47, paragraph (1) of that Act is deemed to be replaced with "does not comprise at least two-thirds of the relevant insured period (excluding the case where, on the day before that day of initial examination, there is no insured period under National Pension other than the premium-paid period and premium-exemption period within the one-year period up to the month two months before the month that includes that day of initial examination)"; provided, however, that this does not apply where the person pertaining to the disability is 65 years of age or older on that day of initial examination.
初診日が令和十八年四月一日前にある傷病による障害について厚生年金保険法第四十七条第一項ただし書（同法第四十七条の二第二項、第四十七条の三第二項、第五十二条第五項、第五十四条第三項及び第五十五条第二項において準用する場合を含む。）の規定を適用する場合においては、同法第四十七条第一項ただし書中「三分の二に満たないとき」とあるのは、「三分の二に満たないとき（当該初診日の前日において当該初診日の属する月の前々月までの一年間のうちに保険料納付済期間及び保険料免除期間以外の国民年金の被保険者期間がないときを除く。）」とする。ただし、当該障害に係る者が当該初診日において六十五歳以上であるときは、この限りでない。
In the case of applying the provisions of the proviso to Article 58, paragraph (1) of the Employees' Pension Insurance Act to the death of a person who died before April 1, 2036, the phrase "does not comprise at least two-thirds of the relevant insured period" in the proviso to that paragraph is deemed to be replaced with "does not comprise at least two-thirds of the relevant insured period (excluding the case where, on the day before that day of death, there is no insured period under National Pension other than the premium-paid period and premium-exemption period within the one-year period up to the month two months before the month that includes that day of death (or, for a person who was not an insured under National Pension on that day of death, the one-year period up to the month of the most recent insured period under National Pension on or before the month two months before the month that includes that day of death))"; provided, however, that this does not apply where the person pertaining to the death is 65 years of age or older on that day of death.
令和十八年四月一日前に死亡した者の死亡について厚生年金保険法第五十八条第一項ただし書の規定を適用する場合においては、同項ただし書中「三分の二に満たないとき」とあるのは、「三分の二に満たないとき（当該死亡日の前日において当該死亡日の属する月の前々月までの一年間（当該死亡日において国民年金の被保険者でなかつた者については、当該死亡日の属する月の前々月以前における直近の国民年金の被保険者期間に係る月までの一年間）のうちに保険料納付済期間及び保険料免除期間以外の国民年金の被保険者期間がないときを除く。）」とする。ただし、当該死亡に係る者が当該死亡日において六十五歳以上であるときは、この限りでない。
